IT APPEARING THAT:
1. Aurora Gas, LLC, by application dated January 5, 2006 and received by the
Alaska Oil and Gas Conservation Commission ("Commission") on January 20,
2006 has requested the Commission to issue an order in conformance with 20
AAC 25.055 (d) allowing testing and regular production of gas from the Endeavor
No.1 exploration well within 1500 feet of a boundary between two landowners'
properties.
2. The Commission published notice of opportunity for public hearing in the
Anchorage Daily News on January 25, 2006, pursuant to 20 AAC 25.540.
3. Aurora Gas, LLC, supplied additional information regarding the Endeavor No.1
well spacing exception to the Commission on January 20,2006, February 21,
2006 and February 23, 2006.
4. No protests to the application or requests for hearing were received, and no third
parties have filed comments concerning this application.
FINDINGS:
1. The Endeavor No.1 well is proposed as an undeviated well with a surface and
bottom hole location 1834 feet from the West Line and 2268 feet from the South
Line of Section 3 T5S, R15W, Seward Merdian (S.M.).
2. The well will be drilled from the existing Griner No.1 exploratory well pad and
will be located 500 feet from a boundary between two landowners' properties
within Section 3.
3. The abandoned Griner No.1 exploratory well is the only well currently located in
Section 3.

4. The Endeavor No.1 well will test potentially productive oil and/or gas zones in
the Tyonek, Hemlock and West Foreland Formations.
5. Aurora Gas, LLC has given the required notice by certified mail to all known
owners, landowners and operators within 3,000 feet of the Endeavor No.1 well of
Aurora Gas, LLC's intention to drill the subject well.
6. The Endeavor No.1 well is located more than 1500 feet from the external
boundary of a group of contiguous leases of which Aurora Gas LLC is the owner.
7. Acreage unleased by Aurora Gas LLC is located within Section 3 and within
3,000 feet of the Endeavor No.1 well site.
8. If the Endeavor No.1 well discovers gas, the drilling unit for the pool will be a
governmental section; not more than one well may be drilled to and completed in
that pool on any governmental section; a well may not be drilled or completed
closer than 3,000 feet to any well drilling to or capable of producing from the
same pool.
9. The Endeavor No. 1 well may not begin regular production of gas from a property
that is smaller than the governmental section upon which the well is located,
unless the interests of the persons owning the drilling rights in and the right to
share in the production from the section have been pooled under AS 31.05.100
and 20 AAC 25.055(c).
10. An exception to the well spacing provisions of20 AAC 25.055 (a)(2) is necessary
for the drilling, completion, and testing and regular production of gas in the
Endeavor No.1 well.
11. The Commission received no comments, objections or protests in response to the
public notice regarding the Endeavor No.1 well or to the notification sent by
Aurora Gas, LLC to all known owners, landowners and operators within 3,000
feet of the Endeavor No.1 well.
CONCLUSIONS:
1. An exception to the well spacing requirements of 20 AAC 25.055 (a)(2) is
necessary to allow drilling, completion, and testing of gas in the Endeavor No.1
exploration well.
2. Prior to regular production of gas from the Endeavor No.1 well, the interests of
the persons owning the drilling rights in and the right to share in the production
from the section within which the well is located must be pooled under
AS 31.05.100 and 20 AAC 25.055(c).
3. Granting a spacing exception to allow drilling, completion, and testing of gas in
the Endeavor No.1 exploration well will not result in waste or jeopardize the
correlative rights of adjoining or nearby owners.

NOW, THEREFORE, IT IS ORDERED:
Aurora Gas, LLC's application for an exception to the spacing requirements of20 AAC
25.055 is granted in part, namely, for the purpose of authorizing the drilling, completion,
and testing of gas in the Endeavor No.1 exploration well. The well may NOT, however,
begin regular production until the requirements of20 AAC 25.055(b) and (c) have been
met.

AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file
with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23rd day following
the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the
application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day
period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an
order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for
rehearing is denied by non action of the Commission, the 30-day period for appeal to Superior Court runs from the date on which
the request is deemed denied (Le., 10th day after the application for rehearing was filed).

This letter answers your questions regarding Aurora's captioned Spacing
Exception Application.
Reference is made to 80 acres in Section 3 being the NW4NE4 and NE4NW4
(hereinafter referred to as the "80 acres"). These 80 acres are all leased to Aurora (except
for Messrs. McChessney and Knighton and Mrs. Window's (U-39) 50% mineral interest
each under 3 small tracts) under several leases. Aurora Leases 260-1, -8, -9, and -11
cover an undivided and cumulative 50% interest under the 80 acres and an additional 80
acres in Section 35 contiguous to and north of the aforementioned 80 acres in Section 3.
Then the other 50% mineral interest under each small tract within the 80 acres in Section
3 is covered under other lease(s) as to each tract and when individually added to the 260-
1, 8, 9, 11 totals 100% mineral interest as to the 80 acres in Section 3 being leased to
Aurora (except for Messrs. McChessney, Knighton and Mrs. Window's 50% mineral
interests ).
Aurora has 100% of the minerals subject to Section 3 (except for Messrs.
McChessney, Knighton and Mrs. Window's 500/0 mineral interests).
As shown on Exhibit" D - Page 1" and as. stated in Paragraph 3 both of my
Spacing Exception Application Letter dated January 5, the Endeavour No.1 Well location
is in excess of 1,500 from the west line of Section 3 being exactly 1,834' FWL of Section
3.
You should note the Griner Well spotted on Exhibit "B" of my Spacing Exception
Application Letter dated January 5, is not the Endeavour No.1 Well, but Unocal's Griner
Well drilled in 2002. In this regard you will note Aurora's Lease AK-258 which
contained the BHL ofUnocal's Griner Well in the NW4SW4 of Section 3 covers said 40
acres and the 40 acres contiguous to and north of Unocal' s Griner Well's BHL 40 acres
(SW4NW4) and the 40 acres contiguous to and west of the Griner Well's BHL 40 acres
in Section 4. You can see on Exhibit "B" all 3 40 acre parcels. The arrows on these 3
parcels are the leasehooks which connects these 3 tracts symbolizing all 3 tracts being
covered by the same AK-258 lease.
Lease 283-A covers 100% of the oil rights. The gas rights were severed and
owned by an unlocatable mineral owner. Lease 251 cover 100% of the minerals in

NE4SE4. Lease 282 cover 1000/0 of the minerals in NW4NW4. The reason these 3 tracts
were not mentioned in my Spacing Exception Application Letter as "offsetting" owners is
because I didn't view these 3 tracts as being "offsetting" due to their oblique and non-
contiguous nature of their proximity to the drillsite lease. Leases AK-282 and AK-283
could be added to the other leases "north" of the drillsite lease and Lease AK-251 could
be added to the other leases "east" of the drillsite lease.
As stated in Page 2, Paragraph 8 of my Spacing Exception Application Letter, and
Page 2, Paragraph 3 of my Affidavit of Facts, Aurora sent certified copies of its
Application to all landowners, owners and operators within a 3,000' radius from the drill
site location. These owners are listed as the "cc" parties to my January, 5th letter.

Pursuant to our'discussion today, Aurora's Spacing Exception Application

I f the Endeavor. No. 1 well appears to be capable of the production of gas in
commercial qu~tities, we are seeki ng via the Spacing Exception Application
AOG'CC approval to test and complete said well. Futhcrmore, we recognize: that
since landownership changes with the aforementioned 1,500' radii that AOCrCC
approval of the: Spacing Application will not allow Aurora to be able comm.cnce
regular produc~ion until either a Participating Area is formed and approved by the
D'NR and other interested parties (since a. DNR lease fall within the 1500' radii) or
the Com,mission enters an order pooling and integrating these interests for the
developlnent of their lands as a drilling unit for the prevention of waste, for the
protection of correlative rights, or to avoid the drilling of unnecessary wells, as per
Sec. 31.05.1 OO( Establishment of drilling units for pools).
The reason the:owners of the McChessney and Knighton tracts weren't sent a copy
of our Spacing: Application is because our previous letters requesting a lea~le from

Randall here are the requirements for a spacing exception application;
(d) The commission will review an application for an exception to the provisions of this section in accordance with 20 AAC
25.540. The applicant for an exception shall send notice of the application by certified mail to the owners, landowners, and
operators described in (1) of this subsection and shall furnish the commission with a copy of the notice, the date of
mailing, and the addresses to which the notice was sent. The application must include
(1) the names of all owners, landowners, and operators of all properties within 1,000 feet of a well drilling for oil or
within 3,000 feet of a well drilling for gas for which an exception is sought;
(2) a plat drawn to a scale of one inch equaling 2,640 feet or larger, showing the location of the well for which the
exception is sought, all other completed and drilling wells on the property, and all adjoining properties and wells; and
(3) an affidavit by a person acquainted with the facts, verifying that all facts are true and that the plat correctly
portrays pertinent and required data.
The map you submitted does not even cover the western portion of the wells spacing unit, let alone the adjoining properties.
We expect the map described in two to cover the area descibed in one. This is usually not a problem because people generally
use such a map to compile a list of parties to notify. In any case the exhibit B-1 is not acceptable, can you send one that
shows the locations of the parcels you notified?

Alaska Oil and Gas Conservation Commission
Aurora Gas, LLC. by letter dated January 5, 2006 and received by the Alaska Oil
and Gas Conservation Commission (The Commission) on January 20, 2006, has applied
for an exception to the well spacing requirements of 20 AAC 25.055 (a)(2) for the
drilling, completion and production of the Endeavor No.1 gas well. The subject well is
proposed as a straight hole with a surface location and bottom hole location 1834 feet
from the west line and 2268 feet from the south line of Section 3 T5S, R15W, Seward
Merdian (S.M.).
The Commission has tentatively scheduled a public hearing on this application for
Februar6' 28, 2006 at 9:00 am at the Alaska Oil and Gas Conservation Commission at 333
West i Avenue, Suite 100, Anchorage, Alaska 99501. A person may request that the
tentatively scheduled hearing be held by filing a written request with the Commission no
later than 4:30 pm on February 10, 2006.
If a request for a hearing is not timely filed, the Commission will consider the
issuance of an order without a hearing. To learn if the Commission will hold the public
hearing, please call 793-1221 after February 17,2006.
In addition, a person may submit written comments regarding this application to
the Alaska Oil and Gas Conservation Commission at 333 West ih Avenue, Suite 100,
Anchorage, Alaska 99501. Written comments must be received no later than 4:30 pm on
February 27, 2006 except that if the Commission decides to hold a public hearing, written
protest or comments must be received no later than the conclusion of the February 28,
2006 hearing.

Reference is made to the recently submitted Application for Pennit to Drill (APD)
in behalf of Aurora Gas, LLC (AURORA), as Operator of and applicable to the captioned
proposed exploratory well. Pursuant to 20 AAC 25.540, this letter respectfully requests
the APD be approved with a spacing exception and certain limitations placed upon
AURORA, as discussed below.
The Endeavour No.1 Well is to be drilled as an oil well situated 500' from the
westerly lease line of the captioned lease. This oil test will also evaluate several potential
gas intervals situated at a shallower level than the primary oil objective intervals. By
virtue of these anticipated secondary objective gas intervals to be tested and if in the
event the primary oil objectives are non-commercial, AURORA hereby seeks a spacing
exception for the captioned well in order to be properly allowed to test and produce these
anticipated secondary gas objectives without any administrative delays if the oil
objectives are non-commercial. Therefore, this spacing exception application seeks
AOGCC approval to allow the captioned wellbore to be open to test or regular production
of gaseous hydrocarbons at a location less than 1,500' from the aforementioned westerly
lease line of the captioned lease since the owners of the tract contiguous to and west of
the captioned tract/lease are different.
There are no wells currently producing upon the captioned lease situated
generally in the middle of Section 3, Township 5 South, Range 15 West, SM. The
proposed well is planned to test oil at Hernlock Fonnation and gas at several Tyonek
intervals shown on the attached Exhibit "A", but unfortunately the well is planned to
have a SL and a BHL within the NE1I4SW4 of Section 3 situated 1,834' from the west
line and 2,268' from the south line of Section 3, but only 500' from the westerly lease
line of the captioned lease. The captioned well would be lease well and not situated
within the confines of any unit. Consequently, the proposed well will require a spacing
exception location pursuant to 20 AAC 25.055 & 20 AAC 25.540.
Consequently, this letter respectfully requests the AOGCC give favorable
consideration to approving AURORA's APD, and AURORA recognizes, if approved, the
AOGCC would allow AURORA's ability to produce said well from possible Tyonek
producing gas zones seen between 1,640' to 5,500' TVD.

However, in anticipation of a presumable conditionally approved APD, please be
advised AURORA may elect to accept all business risks associated with the drilling,
perforating and testing of this well prior to the spacing exception process; including, but
not limited to, the thirty (30) day public notice period being fully completed.
AURORA's operational, drilling and testing program is briefly discussed below
for your benefit. AURORA plans to drill the proposed Endeavour No.1 Well to sufficient
depth to test the Hemlock Fonnation, which is believed to be productive in the nearby
temporarily abandoned Hansen No.1 Well, and to penetrate the Lower Tertiary
Unconfonnity. Secondary objectives within the wellbore are Lower Tertiary and West
Foreland sands, which were seen in the nearby Anchor Point No.1 well.
The plan is to drill the proposed well to 9,200'MD/TVD from the same pad used
by Unocal for its Griner No.1 to minimize surface damage, possibly cutting some
cores, and to run a full suite of open-hole logs, probably including: array induction,
fonnation density, compensated neutron, di-pole sonic, fonnation micro imager, side-
wall cores and fonnation pressure tests (Schlumberger's MDT tool). If the well appears
to have productive potential, 7" production casing will be run and cemented. If the well
has apparent oil production potential, those apparently oil-productive zones will be
perforated and tested (expected to be below 7,200'). If: a) these zones do not test
commercial oil or if the logs and other fonnation evaluation data do not indicate that
there are any potentially commercial oil-bearing zones and b) gas potential is indicated
by the logs and other data, these potential gas producing zones will be perforated and
tested-probably all zones that appear to be gas productive without water will be
perforated in one set-up in an overbalanced well bore condition. The zones will be
isolated with a packer (and bridge plugs, as needed) and briefly tested individually (or in
groups of2-3 adjacent zones with similar log characteristics) from the bottom up
to detennine gas production rates and to detennine if water will be produced. Upon
detennination of the productivity of each zone, the gas-bearing zones may be stimulated
(hydraulically fractured), and an appropriate completion string will be run to produce
them, if the combined zones appear commercial.
It should be noted there are no issues regarding any injury to the correlative rights
of any offsetting owners. Attached hereto as Exhibit "B" is a plat of the captioned Lease
and surrounding Aurora leases. As you can see the offsetting landowners of the tracts
contiguous to and north of the drillsite lease, AK-273, for the proposed well are the

in same that all the facts herein are true and correct and that the plats furnished herewith

REGARDING SPACING EXCEPTION APPLICATION
ENDEAVOUR NO.1 WELL
KENAI PENINSULA BOROUGH, COOK INLET, ALASKA.
The purpose of this AFFIDAVIT OF FACTS dated effective January 5,2006 is
to confinn to the Alaska Oil and Gas Conservation Commission, 333 W 7th Avenue,
Suite No. 100, Anchorage, Alaska 99501-3533, Attn: Mr. Steve Davies, Petroleum
Geologist, certain facts and stipulations regarding the ownership of the minerals, surface
ownership and other pertinent facts regarding certain lands, leases, and leasehold interests
pertaining to lands situated within the captioned borough and subj ect to a Spacing
Exception Application recently submitted by Aurora Gas, LLC, as Operator of the
proposed well cited in the Application, to the Alaska Oil and Gas Conservation
Commission, hereinafter referred to as the "AOGCC", pursuant to 20 AAC 25.055.
WHEREAS, my name is Randall D. Jones, CPL and I am employed as Manager,
LAND & Negotiations at Aurora Gas, LLC, hereinafter referred to as "AURORA". I
have over twenty-six years of experience in Land Management and my present
responsibilities encompass all Land Management duties at AURORA allowing me to be
knowledgeable about the facts contained within this AFFIDAVIT.
WHEREAS, let it be known AURORA's Endeavour No.1 Well is neither
currently producing oil nor gas from the primary objective, the Hemlock Formation,
which is believed to be productive in the )1earby temporarily abandoned Hansen No.1
Well, and to penetrate the Lower Tertiary Unconfonnity. Secondary objectives within the
wellbore are Lower Tertiary and West Foreland sands, which were seen in the nearby
Anchor Point No.1 well. Its surface location is situated in the NE4SW4 of Section 3,
Township 5 South, Range 15 West, SM. The proposed Endeavour No.1 Well is also
planned to test gas at several intervals with all oil and gas intervals being shown as
follows:

, but unfortunately said well is also planned to have a SL and a BHL situated as noted
above in NE4SW4 of Section 3 at 1,834' from the west line and 2,268' from the south
line of Section 3, but only 500' from the westerly lease line of Aurora's Dale Griner, et
al. Lease. The proposed Endeavour No.1 Well will be a lease well under AURORA'S
AK-273 Lease and not situated within the confines of any unit. Consequently, the
proposed Endeavour No.1 Well will require a spacing exception location pursuant to 20
AAC 25.055 & 20 AAC 25.540 if the oil objectives are non-commercial and Aurora finds
the gas intervals as commercial and wishes to open said gas intervals to open production.
WHEREAS, reference is herein made to that certain Oil & Gas Lease dated
effective February 23, 1998 covering 134.00 gross and net acres being TRACT 2B of the
Griner Subdivision Too, Plat No. 86-31, as plat is recorded on April 29, 1986, Township
5 South, Range 15 West, SM, with a Memorandum of Lease recorded on April 23, 1998
at Volume 273, Page 784, Homer Recording District, hereinafter referred to as the
"LEASE", from Dale Griner, a married man dealing in his separate property and Diane
Alyn Grebe, a married woman dealing in her separate property, as Lessors, and Anadarko
Petroleum Corporation, as Lessee. AURORA is the only owner (leaseholder) of the
LEASE at present, the Lessors are the only owners (mineral rights owners) of the LEASE
and the surface of the LEASE is all owned by Dale Griner and Diane Alyn Grebe,
P.O. Box 101, Anchor Point, AK 99556.
WHEREAS, it should be noted there are no issues with any injury to the correlative
rights of any landowners, owners nor operators offsetting the LEASE and within 3,000' of
the proposed BHL location for the proposed Endeavour No.1 Well, pursuant to the
requirements of20 AAC 25.540. As can be seen on Exhibit "A" attached hereto is a plat of
the captioned Lease and surrounding Aurora leases. As you can see the offsetting
landowners of the tracts contiguous to and north of the drillsite lease, AK-273, for the
Endeavour Well are the following:

FUTHERMORE, by certified copy return receipt requested of my letter dated
January 5,2006 to the AOGCC written notice to all owners, landowners, and operators of
all properties within 3,000 feet of the proposed Endeavour No.1 Well and/or all owners,
landowners, and operators of contiguous tracts thereto requiring the spacing exception
was effected on January 17, 2006. Proof of such mailing reflecting proper mailing to
these parties with a list of addresses to which the notice was sent is reflected on Exhibit
"B" attached hereto.
CONCLUDING, please be advised the reasons for the proposed Endeavour
No.1 Well's current planned location are: a) to utilize a large portion of an existing
previously disturbed area for the SL drilling pad originally constructed by Unocal Oil
Company of California in its unsuccessful D. Griner No.1 Well thereby minimizing
environmental disturbance and existing roads (it runs right to the pad) without disturbing
any significant amount of new, virgin areas which avoids the many wetlands in the area,
and b) the drilling pad is located in a preferred optimal placement based on current
geological interpretation for oil such that it is in a near favorable position geologically
(structurally high and near the center of the structure, as seen on seismic lines and
subsurface mapping).
