The Alaska Oil and Gas Conservation Commission ("AOGCC") published notice on
September 1 0, 2006, of applications submitted by Kerr-McGee Oil and Gas Corporation
("Kerr-McGee") for spacing exceptions to allow the Oliktok 1-1 and 1-2 service wells. The
AOGCC tentatively set a public hearing for October 12, 2006.
On September 18, 2006, before comments were due to the AOGCC, Kerr-McGee withdrew
its applications.
ConocoPhillips Alaska, Inc. ("CPAI") understands that both Kerr-McGee applications have
been withdrawn, no related hearing will be held, and no related order will issue. CPAI also
understands that any new application for a spacing order will be publicly noticed. If that
understanding conflicts with the actual status of this matter, I would be pleased to hear from
the AOGCC.

Alaska Oil and Gas Conservation Commission
Re: The application of Kerr-McGee Oil and Gas Corporation ("Kerr-McGee") for a
spacing exception to allow the drilling, testing and operation of the Oliktok 1-2
service well.
Kerr-McGee, by application dated August 23, 2006 and received by the Alaska Oil and
Gas Conservation Commission ("Commission") on August 24, 2006, has requested the
Commission to issue an order in conformance with 20 AAC 25.055 (a)(1) allowing
drilling, testing and operation of the Oliktok 1-2 service well, which if productive may be
open to regular injection within 500 feet of a property line where ownership or
landownership changes. The surface location of this proposed deviated well is 1526 feet
from the east line and 3224 feet from the south line of Section 5, T13N, R9E, Umiat
Meridian ("UM"). The productive interval will be intersected 50 feet from the east line
and 50 feet from the south line of Section 31, TI4N, R9E, UM. The bottom hole location
of the well will lie 389 feet from the west line and 25 feet from the north line of Section
31, TI4N, R9E, UM.
The Commission has tentatively set a public hearing on this application for October 12,
2006 at 9:00 am at the Alaska Oil and Gas Conservation Commission at 333 West ih
Avenue, Suite 100, Anchorage, Alaska 99501. A person may request that the tentatively
scheduled hearing be held by filing a written request with the Commission no later than
4:30 pm on September 27,2006.
If a request for a hearing is not timely filed, the Commission may consider the issuance
of an order without a hearing. To learn if the Commission will hold the public hearing,
please call 793-1221.
In addition, a person may submit written comments regarding this application to the
Alaska Oil and Gas Conservation Commission at 333 West ih Avenue, Suite 100,
Anchorage, Alaska 99501. Written comments must be received no later than 4:30 pm on
October 11, 2006 except that if the Commission decides to hold a public hearing, written
protest or comments must be received no later than the conclusion of the October 12,
2006 hearing.

Kerr-McGee Oil & Gas Corporation plans to spud two wells from Oliktok Point later this
year with a total of five horizontal injector wells and four horizontal producers drilled
during 2006 and 2007 in the southern part of Sections 31.32, and 33, T14N, R9E, UM.
The wells will have a Southeast to Northwest orientation. Later we plan to drill
additional wells in ADL 388582 and ADL 390615. We would prefer to locate the
horizontal segments of the eastern wells in those two leases on the east lines of the
leases.
We request your agreement to our application for an exception to the rules to permit the
drilling of horizontal injector and producing wells in ADL 388582 and ADL 390615 with
the horizontal segments extending to the east line of the two leases. If you so agree, we
will agree to reciprocal location exceptions for BP.
Locating these wells along the east line of the above described leases is necessary to
maximize recovery from the area and avoid the waste of hydrocarbons. Please indicate

Kerr-McGee Oil & Gas Corporation plans to spud two wells &om Oliktok Point later this year. One will
be a horizontal well with the heal in Section 31, Township l4N, R9E, UM. The well will have a
Southeast to Northwest orientation. We would prefer to locate the heal of the well on the south lease line
of Section 31 at the following NAD21 coordinates:

This well is planned as an injector well for the Nikaitchuq Project. Our plan includes five horizontal
injector wells and four horizontal producers with the heals of each along the southern edge of the
following sections:
Secs 31.32, and 33, Tl4N, R9E, UM
It is possible we will later want to drill wells along the southern boundary of Sec 36, Tl4N, R8E, UM.
We request your agreement to our application for an exception to the rules to permit the wells to be
located on the south line of the above described sections and for the eastern most injector well in Section
33, T14N, R9E UM to be located on the east line of the section. If you so agree, we will agree to a
reciprocal location exception permitting the KRU to locate wells adjacent to the northern boundary of the
sections to the south of those described above.

Nikaitchuq development project. It will be in Section 31 T14N, R9E, UM, in that portion of ADL 355024 we earned from the
KRU owners (the Kigun area). I expect the portion of ADL 355024 we earned to be segregated later so that it has a
separate lease number, but that has not yet happened. I also expect the Nikaitchuq Unit to be expanded to include what is
now the Tuvaaq Unit, the Kigun Area, ADL 390615, ADL 390616, and a portion of ADL 355021. That has not yet
happened and probably won't be completed by year end.
The other well we plan to drill this year will be a pilot hole extending from Oliktok Point to the southeast corner of ADL
390615. We intend to take samples from that well, but it will not be completed as a producer or injector. We may be able
to later use a portion of the well bore to drill our eastern most injector well for the project.
We want to locate the horizontal segments of our injectors and producers in a generally SE/NW direction with the southern
most wells extending all the way to the south line of our property and the eastern most wells extending to the east line of
ADL 390615 and ADL 388582.
I understand we need to notify the offset operators (CPAI to the south and BP to the east) of our application for a location
exception and that if we obtain their approval, a hearing probably will not be required. I have drafted letters to both
companies and am attaching them to this email. I would like to know this will be sufficient evidence of no objection if they
agree. Our current needs are only for the two wells mentioned above, but we don't want to drill the western injector at the
property line if the other wells are not likely to also be permitted to extend to the same line and thus be part of a pattern. I
don't know if we need an exception now for the eastern well since it will not be a "keeper". I tried to structure the letters so
CPAI and BP would be agreeing to location exceptions all along the south and east lines in the hope that we can use that
agreement when we are ready to apply for exceptions to drill those wells.
I will call you later this morning with some additional questions, but thought it would be helpful if you could see this in
advance.
