The AOGCC tentatively set a public hearing for October 12,2006. On September 18, 2006, before comments were due to the AOGCC, Kerr-McGee withdrew its applications. ConocoPhillips Alaska, Inc. ("CPAI") understands that both Kerr-McGee applications have been withdrawn, no related hearing will be held, and no related order will issue. CPAI also understands that any new application for a spacing order will be publicly noticed. The bottom row of wells wíll be drilled from Oliktok Point It is our hope to place the heal of the horizontal segments on the south yellow line which is an ownership line For ADL 390615 and 616 it is also a lease line. For the Kigun area immediately to the west of ADL 390616 it is at present not a lease line. We acquired the portion of ADL 355024 north of the south yellow line on the drawing, but the lease itself also includes lands to the south of the yellow line. It is expected that the lease will be segregated along the yellow line later this year or early next year as we go through the unitization process. The remaining wells are planned to be drilled from an artificial island to be located approximately where you see "spy island pad". For those wells, it would be the toe of the horizontal segment we would like to place on the east line of ADL 355021 and ADL 388582. You will see two wells where the toe is shown to be in ADL 355021. That was a mistake We own Sag River rights in that lease, but these wells are Schrader Bluff wells and we do not own rights to that depth in the lease. We would propose to place the toe of those two wells on the east lease line. I have drafted letters to both companies and am attaching them to this email. I would like to know this will be sufficient evidence of no objection if they agree. Our current needs are only for the two wells mentioned above, but we don't want to drill the western injector at the property line if the other wells are not likely to also be permitted to extend to the same line and thus be part of a pattern. I don't know if we need an exception now for the eastern well since it will not be a "keeper". I tried to structure the letters so CPAI and BP would be agreeing to location exceptions all along the south and east lines in the hope that we can use that agreement when we are ready to apply for exceptions to drill those wells.
