IT APPEARING THAT: ) ) ) ) ) ) ) ) Conservation Order No. 580 Ninilchik State No.3 Delineation Gas Well January 29,2007 1. Marathon Oil Company ("MOC"), by letter dated December 6, 2006 and received by the Alaska Oil and Gas Conservation Commission ("Commission") on December 6, 2006 has requested an order allowing an exception to the spacing requirements of 20 AAC 25.055(a)(4) to allow drilling, completion, testing and regular production of the Ninilchik State No.3 gas delineation well within 3000 feet of a the Ninilchik State No.1 well which is capable of producing from the same interval. 2. The Commission published notice of opportunity for public hearing in the Anchorage Daily News on December 12, 2006, pursuant to 20 AAC 25.540; 3. Additional information was requested from MOC on December 7,2006 and received on December 15,2006. 4. No protests to the application or requests for hearing were received. 5. The public hearing was vacated on January 9,2007. FINDINGS: 1. MOC is the operator of the Ninilchik No.3 well. 2. Ninilchik State No.3 is proposed as a deviated gas delineation well with a surface location of 1116 feet from the west line (FWL) and 850 feet from the north line (FNL) of Section 34, TIN, R13W, Seward Meridian ("S.M."), and a projected bottom hole location for this well is 1693 feet FWL, 997 feet FNL, Section 28, TIN, R13W, S.M. 3. The Ninilchik State No.3 well will target gas reservoirs in the Tyonek Formation which can be discontinuous. 4. The portion of State of Alaska oil and gas lease ADL 389180 that the Ninilchik State No.3 will penetrate is within the Grassim OskolkoffParticipating Area of the Ninilchik Unit. 5. MOC sent notice ofthe application for exception to the well spacing requirements of 20 AAC 25.055 by certified mail to all owners, landowners, and operators of all properties within 3000 feet of the anticipated productive interval of the proposed Ninilchik State No.3 well. e e CONCLUSIONS: 1. An exception to 20 AAC 25.055(a)(4) is necessary to allow drilling, completion, testing and regular production of the Ninilchik State No.3 gas delineation well in order to evaluate gas reservoirs in the Tyonek Formation in the Grassim OskolkoffParticipating Area. 2. The properties affected by this spacing exception are within the boundaries of the Grassim Oskolkoff Participating Area of the Ninilckik Unit. 3. Granting a spacing exception to allow drilling, completion, testing and regular production of the Ninilchik State No.3 well will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: MOC's application for exception to the well spacing provision of 20 AAC 25.055(a)(4) for the purpose of drilling, completion, testing and regular production of the Ninilchik State No. 3 well is approved. AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23rd day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. The Public Notice was published on December 8, 2006 and the public Hearing is scheduled for Thursday, January 11, 2007, at 9:00am. We have received no comments from the public on this request. AOGCC Regulations require Marathon to apply for a location exception for the Ninilchik State #3 well as the targeted productive interval of the well is located within 3,000' (ft) of a well capable of producing from the same interval (being the Grassim Oskolkoff No. 3 well). This spacing exception is necessary because the drainage areas of the other wells drilled in the vicinity are often limited due to the discontinuous nature of the Tyonek reservoirs. It is anticipated that wells productive in the Tyonek intervals may drain less than 640 acres. I agree with this assessment at this time. In the future, as more wells are drilled in the field and pressure data is compiled, a better understanding of the connectivity of the Tyonek sands may be made, and pool rules established. As we have received no Public comments concerning this spacing exception, and I know of no mitigating circumstances, I recommend we vacate the scheduled Public Hearing. I'm still learning the procedures here at the Commission, but I could not answer some of the questions Cammy raised from the Application information you submitted. Most of the other information in the Application is sufficient, but would you please provide the following additional information for us: 1- A concise explanation of why a spacing exception is necessary. I realize that the GO-5 will be within 3000 feet of another well capable of producing from the same intervals, but please state that. The NS-3 will be the second well in a Section (less than 640 acre spacing for a gas well); 2- A justifcation for granting a spacing exception. This may be a brief geologic or engineering description which will explain why a spacing exception should be granted by the Commission. My goal is to make the process of applying for spacing exceptions quicker and cleaner for both you and the Commission, I'm not trying to cause you more work. Also, on future Spacing Exception requests, would you please make the following changes: 1- Inclusion of numbers 1 & 2 above; 2- Please adjust the maps so that the lease lines are heavier black lines than the Section lines, with the appropriate lease numbers, Township and Range designations, and an small Index map displaying the area of interest within the State; 3- Please submit an original Application and map, plus a second copy for our records a Xerox copy is sufficient). If you can supply the information for the GO-5 quickly, we will still have sufficient time to consider cancelling the scheduled hearing. Please feel free to give me a call to discuss this (793-1247).
