Marathon Oil Company ("MOC"), by letter dated and received by the Alaska Oil and Gas Conservation Commission ("Commission") on May 2, 2007, has requested an order allowing an exception to the spacing requirement of20 AAC 25.055(a)(2) to provide for the drilling, completion, testing and regular production of the Sterling Unit ("SU") 41-15RD gas delineation well within 1500 feet of a section line within the undefined pool. 2. On May 7, 2007, pursuant to 20 AAC 25.540, the Commission published in the Anchorage Daily News and on May 9, 2007 in the Peninsula Clarion, notice of opportunity for public hearing on June 21,2007. 3. No protests to the application or requests for a hearing were received. 4. The public hearing was vacated on June 11,2007. FINDINGS: 1. MaC is the operator of the Sterling Unit. 2. The SU 41-15RD is proposed as a deviated gas delineation well with a surface location 456 feet from the east line (FEL) and 2332 feet from the south line (FSL) of Section 9, T5N, RIOW, Seward Meridian ("S.M."), and a projected bottom hole location 1108 feet FEL, 464 feet FNL, Section 15, T5N, RI0W, S.M. 3. The SU 41-l5RD well will target gas sand reservoirs that possibly are discontinuous in the Lower Beluga and Tyonek Formations. 4. The properties affected by this spacing requirement would be within the boundaries of the Sterling Unit, Kenai Peninsula Borough. 5. MaC sent notice of the application for exception to the well spacing requirement of 20 AAC 25.055(a)(2) by certified mail to all owners, landowners, and operators of all properties within 1500 feet of the anticipated productive interval of the proposed SU 41-15RD well. 6. The SU 41-15RD would be within 1500 feet of a section line within the undefined pool. CONCLUSIONS: . . 1. An exception to 20 AAC 25.055(a)(2) is necessary to allow drilling, completion, testing and regular production of the Sterling Unit 4l-l5RD gas delineation well in order to recover gas reserves in the Lower Beluga and Tyonek Formations, in the Lower BelugaJTyonek Participating Area, Sterling Unit, Kenai Peninsula Borough, Alaska. 2. Granting a spacing exception to allow drilling, completion, testing and regular production of the Sterling Unit 41-15RD well will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: Pursuant to the Commissio's authority under AS 31.05.030 and AS 31.05.100, the Commission hereby approves MaC's application for exception to the well spacing provisions of20 AAC 25.055(a)(2) for the purpose of drilling, completion, testing and regular production of the Sterling Unit 4l-15RD well. MaC may proceed with regular production as long as it complies with the terms of the Commingled Lower BelugaJTyonek Participating Area agreement and applica laws. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. The ability to encounter the maximum thickness of gas-filled sand and recover the maximum amount of reserves is dependent on locating the well high on the structure of the target intervals. Sterling Unit Kenai Peninsula Borough, Alaska Dear Mr. Saltmarsh: Marathon Oil Company (Marathon) respectfully requests the following location exception for the referenced well: Surface Location: 456' FEL & 2332' FSL, Section 9, T5N, RlOW, S.M. Target: Estimated Top of Lower Beluga Production Estimate @ 8080' TVD, 10,081' MD 1660' FEL & 103' FNL, Section 15, T5N, RlOW, S.M. Bottom Hole: Estimated @ 9495' TVD, 11,642' MD 1108' FEL & 464' FNL, Section 15, T5N, RlOW, S.M. The Sterling Unit 4l-l5RD targets reserves in the Lower Beluga and Tyonek Formations. The original SU 41-15 well was completed in the same intervals, but stimulations procedures employed in the original hole were damaging to the formation. SU 4l-l5RD aims to recover the reserves remaining from this location utilizing proven completion technology used in similar reservoir in adjacent fields (Kenai Gas Field, Cannery Loop, Beaver Creek). AOGCC Regulations require that Marathon apply for a location exception for the SU 4l-l5RD well because the well intersects the targeted horizons (Lower Beluga and Tyonek) at a location closer than 1,500 feet ITom a section line within the undefined gas pool. Marathon requests the spacing exception to this rule because the ability to encounter the maximum thickness of gas- filled sand and recover the maximum amount of reserves is dependent on locating the well high on the structure of the target intervals. The best structural position for the well is closer than 1500 ft to the section line (structure maps attached).
