BY DIRECTION OF THE COMMISSION bie ant to the Commission • STATE OF ALASKA ALASKA OIL AND GAS CONSERVATION COMMISSION 333 West Seventh Avenue, Suite 100 Anchorage Alaska 99501 Re: THE APPLICATION OF Marathon Oil ) Conservation Order No. 592 Company for an order granting an exception ) to the spacing requirements of ) Paxton No. 2 20 AAC 25.055(a)(4) to provide for the ) Ninilchik Unit, Tyonek Pool drilling, completion, testing and regular ) production of the Paxton No. 2 well ) within 3000 feet of a well capable of producing ) from the same interval. ) December 10, 2007 IT APPEARING THAT: Marathon Oil Company ("MOC"), by letter dated October 9, 2007 and received by the Alaska Oil and Gas Conservation Commission ("Commission") on October 10, 2007, has requested an order allowing an exception to the spacing requirements of 20 AAC 25.055(a)(4) to provide for the drilling, completion, testing and regular production of the Paxton No. 2 gas well within 3000 feet of a Paxton No. 1 well capable of producing from the same interval, within the proposed Susan Dionne/Paxton Participating Area, Kenai Peninsula Borough, Alaska. 2. On October 26, 2007, pursuant to 20 AAC 25.540, the Commission published in the Anchorage Daily News notice of opportunity for public hearing on December 4, 2007. 3. No protests to the application or requests for hearing were received. 4. The public hearing was vacated on November 30, 2007. FINDINGS: 1. MOC is the operator of the Paxton Gas Well within the proposed Susan Dionne/Paxton Participating Area, Kenai Peninsula Borough, Alaska. 2. Paxton No. 2 is proposed as a deviated gas delineation well with a surface location 2939 feet from the east line (FEL) and 653 feet from the north line (FNL) of Section 13, T1N, R14W, Seward Meridian ("S.M."), and a projected bottom hole location 2606 feet FEL, 854 feet FSL, Section 12, T1N, R14W, S.M. 3. The Paxton No. 2 well will target gas reservoirs that can be discontinuous in the Tyonek Formation. 4. MOC sent notice of the application for exception to the well spacing requirements of 20 AAC 25.055 by certified mail to all owners, landowners, and operators of all properties within 3000 feet of the anticipated productive interval of the proposed Paxton No. 2 well. 5. The Paxton No. 2 well is within 3000 feet of the Paxton No. 1 well. • CONCLUSIONS: 1. Exceptions to 20 AAC 20.25.055(a)(4) are necessary to allow drilling, completion, testing and regular production of the Paxton No. 2 gas well in order to evaluate Tyonek gas reservoirs in the proposed Susan Dionne/Paxton Participating Area. 2. The properties affected by this spacing exception are within the boundaries of the proposed Susan Dionne/Paxton Participating Area. 3. Granting a spacing exception to allow drilling, completion, testing and regular production of the Paxton No. 2 will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: Pursuant to the Commissions authority under AS 31.05.030 and AS 31.05.100, the Commission hereby approves MOC's application for exception to the well spacing provisions of 20 AAC 25.055(a)(4) for the purpose of drilling, completion, testing and regular production of the Paxton No. 2 well. Because the properties affected by this spacing exception are wholly contained within the proposed Susan Dionne/Paxton Participating Area, MOC may proceed with regular production as long as it complies with the terms of the Susan Dionne/Paxton Participating Area agr ne t and applicable laws. Seamount, Jr., Commissioner Alaska Oil and Gas Conservation Commission AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23`d day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the re uq est is deemed denied (i.e., 10`h day after the application for rehearing was filed). Further, the Tyonek sand reservoirs "can be discontinuous" requiring closer spacing than required by the Regulations. The only properties in the affected area are within the Ninilchik Unit and the proposed Susan Dionne / Paxton Participating Area. Target: Estimated Top of Tyonek Production: Tyonek Productive Interval @ 3945' MD, 3465' TVD 2606' FEL & 854' FSL, Section 12, T1S, R14W, S.M. Bottom Hole: Estimated @ 8645' MD, 8165' TVD 2606' FEL & 854' FSL, Section 12, TIS, R14W, S.M. The Paxton No. 2 well targets gas bearing Tyonek reservoirs. The well is to be drilled as a development well within the proposed Susan Dionne/Paxton Participating Area targeting the Tyonek gas sands in State of Alaska ADL 384372. A location exception is required because the productive interval of the well is within 3,000 feet of a well capable of producing from the same interval, as shown in Exhibit "A". The Paxton No. 1 well currently produces from the Tyonek within 3,000 feet. There are no other wells, productive or non-productive, that penetrate the Tyonek within 3,000 feet. The Paxton No. 2 well targets gas bearing Tyonek reservoirs. The Paxton No. 2 well is to be drilled as a development well within the proposed Susan Dionne/Paxton Participating Area targeting the Tyonek gas sands in State of Alaska ADL 384372. A location exception is required because the productive interval of the well is within 3,000 feet of a well capable of producing from the same interval, as shown in Exhibit "A". The Paxton No. 1 well currently produces from the Tyonek within 3,000 feet. There are no other wells, productive or non-productive, that penetrate the Tyonek within 3,000 feet.
