IT APPEARING THAT:
Marathon Oil Company ("MOC"), by letter dated October 9, 2007 and received by the Alaska Oil
and Gas Conservation Commission ("Commission") on October 10, 2007, has requested an order
allowing an exception to the spacing requirements of 20 AAC 25.055(a)(4) to provide for the
drilling, completion, testing and regular production of the Paxton No. 2 gas well within 3000 feet of a
Paxton No. 1 well capable of producing from the same interval, within the proposed Susan
Dionne/Paxton Participating Area, Kenai Peninsula Borough, Alaska.
2. On October 26, 2007, pursuant to 20 AAC 25.540, the Commission published in the Anchorage
Daily News notice of opportunity for public hearing on December 4, 2007.
3. No protests to the application or requests for hearing were received.
4. The public hearing was vacated on November 30, 2007.
FINDINGS:
1. MOC is the operator of the Paxton Gas Well within the proposed Susan Dionne/Paxton Participating
Area, Kenai Peninsula Borough, Alaska.
2. Paxton No. 2 is proposed as a deviated gas delineation well with a surface location 2939 feet from
the east line (FEL) and 653 feet from the north line (FNL) of Section 13, T1N, R14W, Seward
Meridian ("S.M."), and a projected bottom hole location 2606 feet FEL, 854 feet FSL, Section 12,
T1N, R14W, S.M.
3. The Paxton No. 2 well will target gas reservoirs that can be discontinuous in the Tyonek Formation.
4. MOC sent notice of the application for exception to the well spacing requirements of 20 AAC 25.055
by certified mail to all owners, landowners, and operators of all properties within 3000 feet of the
anticipated productive interval of the proposed Paxton No. 2 well.
5. The Paxton No. 2 well is within 3000 feet of the Paxton No. 1 well.
•
CONCLUSIONS:
1. Exceptions to 20 AAC 20.25.055(a)(4) are necessary to allow drilling, completion, testing and
regular production of the Paxton No. 2 gas well in order to evaluate Tyonek gas reservoirs in the
proposed Susan Dionne/Paxton Participating Area.
2. The properties affected by this spacing exception are within the boundaries of the proposed Susan
Dionne/Paxton Participating Area.
3. Granting a spacing exception to allow drilling, completion, testing and regular production of the
Paxton No. 2 will not result in waste or jeopardize the correlative rights of adjoining or nearby
owners.
NOW, THEREFORE, IT IS ORDERED:
Pursuant to the Commissions authority under AS 31.05.030 and AS 31.05.100, the Commission hereby
approves MOC's application for exception to the well spacing provisions of 20 AAC 25.055(a)(4) for the
purpose of drilling, completion, testing and regular production of the Paxton No. 2 well. Because the
properties affected by this spacing exception are wholly contained within the proposed Susan
Dionne/Paxton Participating Area, MOC may proceed with regular production as long as it complies with
the terms of the Susan Dionne/Paxton Participating Area agr ne t and applicable laws.

AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected
by it may file with the Commission an application for rehearing. A request for rehearing must be received by

Mr.. Donkel:
The spacing exception for the Paxton # 2 well has been granted by the Commission under 20 ACC 25.055(a)(4)
which allows "drilling, testing and regular production of a well within 3,000 feet of a well capable of producing from
the same interval." Further, the Tyonek sand reservoirs "can be discontinuous" requiring closer spacing than
required by the Regulations. The only properties in the affected area are within the Ninilchik Unit and the
proposed Susan Dionne / Paxton Participating Area.

Will this order or Ninilchik unit activity harm me like the others that are Alaskan Homesteaders and

Marathon Oil Company, by a letter dated October 9, 2007 and received by the
Alaska Oil and Gas Conservation Commission ("Commission") on October 10, 2007 has
requested an order allowing an exception to the spacing requirements of 20 AAC 25.055

RE: Location Exception Application
Marathon Oil Company
Ninilchik Unit, -Proposed Susan Dionne/Paxton Participating Area
Paxton #2 Well
Kenai Peninsula Borough, Alaska
Dear Mr. Saltmarsh:
Marathon Oil Company respectfully requests the following location exception for the
referenced well:
Surface Location: 2939' FEL & 653' FNL, Section 13, T1S, R14W, S.M.
Target: Estimated Top of Tyonek Production:
Tyonek Productive Interval @ 3945' MD, 3465' TVD
2606' FEL & 854' FSL, Section 12, T1S, R14W, S.M.
Bottom Hole: Estimated @ 8645' MD, 8165' TVD
2606' FEL & 854' FSL, Section 12, TIS, R14W, S.M.
The Paxton No. 2 well targets gas bearing Tyonek reservoirs. The well is to be drilled as a
development well within the proposed Susan Dionne/Paxton Participating Area targeting
the Tyonek gas sands in State of Alaska ADL 384372. A location exception is required
because the productive interval of the well is within 3,000 feet of a well capable of
producing from the same interval, as shown in Exhibit "A". The Paxton No. 1 well
currently produces from the Tyonek within 3,000 feet. There are no other wells,
productive or non-productive, that penetrate the Tyonek within 3,000 feet. This spacing
exception is necessary to efficiently drain the Tyonek reservoirs that often have limited
drainage areas due to the discontinuous nature of Tyonek sands:

Attached is a plat showing the Paxton No. 2 surface location and well paths from the
Paxton Pad. The Top Tyonek cut point is noted on the Paxton No. 1 well path, which is
producing from the Tyonek. Also attached is a pre-drill directional survey for the Paxton
No. 2 well. Furthermore, the parties listed on Exhibit "B" are entitled to notice of this
application and have been duly notified.
Should you have any questions related to land or ownership issues, please contact Robert
Province at 907-565-3044, or for questions regarding the technical aspects of this
application, please contact Scott Szalkowski at 713-296-3390.

AFFIDAVIT
Comes now D. Scott Szalkowski, and first being duly sworn upon his oath, states and deposes as follows:
1. That I am over the age of 21 years and mentally competent to make this affidavit.
2. That I am knowledgeable and fully informed concerning the facts contained in this affidavit.
That for approximately the past two years I have worked as a geologist for Marathon Oil
Company (MOC) on the Alaska Asset Team. My responsibilities have included geology of the
Cook Inlet/Kenai Peninsula Areas.
4. That I have been responsible for the geological work related to a Location Exception application
for the Marathon Paxton No. 2 Well with a surface location in Section 13, T1 S, R14W, S.M. and
bottom hole location in Section 12, T1 S, R14W, S.M.
5. The Paxton No. 2 well targets gas bearing Tyonek reservoirs.
The Paxton No. 2 well is to be drilled as a development well within the proposed Susan
Dionne/Paxton Participating Area targeting the Tyonek gas sands in State of Alaska ADL
384372. A location exception is required because the productive interval of the well is within
3,000 feet of a well capable of producing from the same interval, as shown in Exhibit "A". The
Paxton No. 1 well currently produces from the Tyonek within 3,000 feet. There are no other
wells, productive or non-productive, that penetrate the Tyonek within 3,000 feet. This spacing
exception is necessary to efficiently drain the Tyonek reservoirs that often have limited drainage
areas due to the discontinuous nature of Tyonek sands
