Armstrong Cook Inlet, LLC ("Armstrong"), by letter dated March 3, 2008 and received by the Alaska Oil and Gas Conservation Commission ("Commission") on March 5, 2008, has requested an order allowing exceptions to the spacing requirements of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) to provide for the drilling, completion, testing and regular production of the North Fork 34-26 gas exploration well within 1,500 feet of a property line and 3,000 feet of the North Fork 41-35 well, which is capable of producing from the same interval. l 2. The proposed North Fork 34-26 gas well is adjacent to the North Fork Unit Participating Area on the southern Kenai Peninsula and is within 3,000 feet of the North Fork 41-35 gas well. 3. The surface and bottom hole locations of the proposed well are 1,721 feet from the east line (FEL) and 649 feet from the south line (FSL) of Section 26, T4S, R14W, Seward Meridian (S.M.). 4. On March 19, 2008, pursuant to 20 AAC 25.540, the Commission published in the ANCHORAGE DAILY N>ws, notice of opportunity to comment on the application and request that a public hearing, which was tentatively scheduled for April 24 , 2008, be held. 5. No comments on the application or request that the tentatively scheduled hearing be held were received. 120 AAC 25.055(a)(4) provides that "a well may not be drilled or completed closer than 3,000 feet to any well drilling to or capable of producing from the same pool." There is (as yet) no defined pool into which the proposed North Fork 34-26 gas well will be drilled. Therefore, to address this requirement, the Commission considers here the appropriateness of a spacing exception where the proposed well will be drilled within 3,000 feet of another well capable of producing from the same interval. If granting a spacing exception for a well drilled within 3,000 feet of another well capable of producing from the same pool is appropriate, then granting an exception for a well within 3,000 feet of another well capable of producing from the same interval is appropriate. • • 6. The tentatively scheduled public hearing was cancelled on April 21, 2008. FINDINGS: 1. Armstrong is the operator of the North Fork Gas Field. 2. The North Fork 34-26 well is proposed as a gas exploration well with surface and bottom hole locations 1,721 feet from the east line (FEL) and 649 feet from the south line (FSL) of Section 26, T4S, R14W, S.M. 3. The proposed North Fork 34-26 well will target potentially discontinuous gas sand reservoirs in the Tyonek and Beluga Formations. 4. Armstrong sent notice of the spacing exception application by certified mail to the owners, landowners, and operators of all properties within 3,000 feet of the anticipated productive interval of the proposed North Fork 34-26 well. 5. The proposed North Fork 34-26 well will be within 3,000 feet of the North Fork 41-35 well. The North Fork 34-26 and North Fork 41-35 wells will be in the same interval. 6. Granting a spacing exception to allow drilling, completion, testing and regular production of the North Fork 34-26 well will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. CONCLUSIONS: 1. Exceptions to 20 AAC 25.055(a)(2) and 20 AAC 20.25.055(a)(4) are necessary to allow drilling, completion,,testing and regular production of the North Fork 34-26 gas exploration well in order to evaluate gas reservoirs in the Tyonek and Beluga Formations in the North Fork Gas Field. 2. Granting spacing exceptions to allow drilling, completion, testing and regular production of the North Fork 34-26 well will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: Armstrong's application for exceptions to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) for the purpose of drilling, completion, testing and regular production Conservation Order No. 601 Effective May 21, 2008 Page 2 of 3 • • of the North Fork 34-26 gas exploration well is approved. Because the properties affected by this spacing exception are within the North Fork Gas Field, Armstrong may proceed with drilling, completion, testing and regular production as long as it complies with the North Fork Unit Agreement and all applicable Alaska and federal laws. F and Caas~onservation Commission Oil and Gas Conservation Commission RECONSIDERATION AND APPEAL NOTICE As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the Commission grants for good cause shown, a person affected by it may file with the Commission an application for reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10-days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the Commission grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the Commission, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited to the questions presented to the Commission by the application for reconsideration." In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00 p.m. on the next day that does not fall on a weekend or state holiday. Dear Mr. Maunder and Mr. Davies: Armstrong Cook Inlet, LLC (Armstrong) has embarked on a program to further explore, delineate and develop the North Fork Unit and surrounding acreage. The first well in this program will be the North Fork #34-26 gas well, which will be located 1721' FEL, and 649' FSL, Sec 26, T.4S., R. 14 W., SM. This location is less than 3000 ft from North Fork Unit #41-35, which is the discovery well for the North Fork field, and which was drilled in 1965. North Fork #34-26 is optimally located from a geologic perspective to be the first step in an orderly delineation of the field, however because of the proximity of the #41-35 well, a spacing exception as per 20 AAC 25.055 is required in order for the well to be drilled at the proposed location. Drilling at the #34-261ocation is scheduled to start in June, 20Q8. The primary objective of the North Fork 34-26 is to test multiple Tyonek sands within the stratigraphic interval proven to be gas productive by the North Fork Unit 41-35. The NFU 41-35 recovered gas from two mid-Tyonek fluvial sands near the crest of a northeast-trending anticlinal closure. The Tyonek Formation consists of inter-bedded fluvial and alluvial sandstones, conglomerates, siltstones, mudstones and coal. Sands within the Tyonek are generally fining-upward fluvial deposits with limited lateral extent. Armstrong has proposed to drill the North Fork 34-26 approximately 1,700 feet northwest and 40 to 70 feet down-dip of the NFU 41-35. We111og correlations suggest the_ upper gas sand in the NFU 41-35 (8,005'-8,045'MD) occurs within an interval of discontinuous fluvial sands. The Application for Permit to Drill (APD) for the #34-26 well will be submitted to the AOGCC in the near future. This Application for Spacing Exception is submitted in advance of the APD due to the potentially lengthy review period required, should the Application go to a hearing, and still allow us time to meet our spud date objective. Depending on the outcome of the drilling of this well, and the geologic parameters revealed, Armstrong may wish to request an expansion of the North Fork Unit to include the subject well and other acreage that can be shown to be structurally and stratigraphically connected. Obviously this possibility cannot be addressed until after the well is completed, and the data evaluated, but it is Armstrong's objective to keep this option open.
