IT APPEARING THAT: Conservation Order No. 608 Docket No. CO-08-42 November 20, 2008 1. ConocoPhillips Alaska, Inc. (CPAI), by letter dated July 22, 2008, and received on July 24, 2008, requests that the Alaska Oil and Gas Conservation Commission (Commission) enter an order providing for exceptions to the well spacing requirements of 20 AAC 25.055(a)(1) to allow drilling, completion, and water injection of the proposed Kuparuk River Unit (KRU) 3K-108 and KRU 3K- 108L1 service wells within 500 feet of a property line. 2. On October 17, 2008, pursuant to 20 AAC 25.540, the Commission published in the ANCHORAGE DAILY NEws notice of the opportunity for a public hearing on November 19, 2008, at 9:OOam. 3. No protest to the application or request for a hearing was received. 4. The public hearing was vacated on November 4, 2008. FINDINGS: 1. CPAI will operate the KRU 3K-108 and KRU 3K-108L1 service wells. 2. The KRU 3K-108 and KRU 3K-108L1 wells are proposed as water injection wells. The proposed surface location of the KRU 3K-108 well is 1,472 feet from the south line (FSL), 318 feet from the west line (FWL) of Section 35, T13N, R9E, Umiat Meridian (U.M.); the projected bottom hole location is 994 feet from the north line (FNL), 238 feet from the east line (FEL) of Section 36, T13N, R9E, U.M. The proposed surface location of the KRU 3K-108L1 well is 1,472 feet FSL, 318 feet FWL of Section 35, T13N, R9E, U.M.; the projected. bottom hole location is 994 feet FNL, 238 FEL of Section 36, T13N, R9E, U.M. The proposed KRU 3K-108 and KRU 3K-108L1 wells will supply injection water for West Sak production. 4. The KRU 3K-108 and KRU 3K-108L1 wells will have bottom hole locations that are less than 500 feet from the property line of the Milne Point Unit to the east. 5. The Owners of the Kuparuk River Unit are different than the owners of the Milne Point Unit. • By certified mail, CPAI sent notice of its application for an order granting exceptions to the well spacing requirements of 20 AAC 25.055(a)(1) to all owners, .landowners, and operators of all properties within 1000 feet of the proposed wells. CONCLUSIONS: Exceptions to 20 AAC 20.25.055(a)(1) are necessary to allow drilling, completion, and water injection of the proposed KRU 3K-108 and KRU 3K-108L1 service wells into the West Sak oil reservoir of the KRU. Granting spacing exceptions to allow drilling, completion, and water injection of the proposed KRU 3K-108 and. KRU 3K-108L1 wells will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: Pursuant to the Commission's authority under AS 31.05.030 and 20 AAC 25.055, the Commission approves CPAI's application for an order granting exceptions to the well spacing provisions of 20 AAC 25.055(a)(1) to allow drilling, completion, and water injection of the proposed KRU 3K-108 and KRU 3K-108L1 service wells. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10-days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was tiled. That request sought a special accommodation: i. e., to stay until the afternoon of November 19, 2008, or reschedule for the afternoon of another day a public hearing- then tentatively scheduled for the morning of November 19, 2008-on a ConocoPhillips Alaska, Inc. (CPAI) application, dated August 4, 2008. In your November 10, 2008, response, you stated that you "await accommodation, or written denial of why I am penalized in participating." The Commission is treating the response as an application for reconsideration of the Commission's November 5, 2008, decision denying your special accommodation request. The Commission recognizes that it must provide persons with disabilities meaningful access to hearings, but not to the extent that doing so would be unreasonably burdensome to the Commission. You have not identified how the Commission, in denying your request, failed to provide meaningful access. In the Commission's November 5, 2008, letter, the Commission explained the basis for the denial. Specifically, you identified no disability, let alone one preventing your attendance at a morning hearing in person, telephonically, or through a representative; nor did. you provide any reason-and the Commission is aware of none-that staying or rescheduling the hearing would be a reasonable special accommodation (i. e., would not unreasonably burden the Commission), especially under the circumstances. ~ Moreover, you identified no interest in the CPAI application. In your reconsideration application, you stated that, "[s]ince I o~rm my own oil & gas ir. ~ For example, for the Commission to reschedule the hearing, it would need to re-notice hearing, and that would delay a decision on the CPAI application. CPAI's application, however, is not about unitization, but an exception to the spacing requirements of 20 AAC 25.055(a)(2) for two Kuparuk River Unit wells. Accordingly, because your November 10, 2008, reconsideration application identifies no basis for concluding that the Commission's decision might be erroneous, the application is denied. The Commission's denials of your special accommodation request and reconsideration application are final. The Commission has tentatively scheduled a public hearing on this application for September 25, 2008 at 9:00 am at the offices of the Alaska Oil and Gas Conservation Commission at 333 West 7`'' Avenue, Suite 100, Anchorage, Alaska 99501. Winfree §§ Michael A. Winfree, being first duly sworn, upon oath, deposes and states as follows: 1.My name is Michael A. Winfree. I am over 19 years old and have personal knowledge of the matters set forth herein. 2. I am an Engineer for the well operator, ConocoPhillips Alaska, Inc. ("CPAI"). 3. I am acquainted with the facts associated with the drilling of Kuparuk River Unit 3K-108 and 3K-108 L1 (collectively hereinafter "the Well"). 3. The purpose of the requested exception is to allow the Well to cross a fault and it is expected this will allow the Well to provide water injection support to the toe of 3K-102. Accordingly the exception is requested to allow the Well to be drilled within 238 feet of the boundary with MPU lease ADL 25517. 4. I have reviewed the application submitted for the exception to 20 AAC 25.055. To the best of my knowledge and belief all facts therein are true and accurate. 5. I have reviewed the plat attached as Exhibit "1" and it correctly portrays pertinent and required data. 6. Pursuant to 20 AAC 25.055 (b), CPAI, the well operator, prepared a Notice of Request for Exception to the Provision of 20 AAC 25.055. A copy of this notice is attached hereto. Of even date herewith, pursuant to 20 AAC 25.055 (b), CPAI sent a copy of said notice by certified mail to the last known address of all owners and operators of governmental quarter sections directly and diagonally offsetting the governmental quarter section of the proposed location of the Well.
