On October 27, 2008, pursuant to 20 AAC 25.540, the Commission published in the ANCHORAGE DAILY NEws notice of the opportunity for a public hearing on December 1, 2008. 3. No protest to the application or request for a hearing was received. 4. The public hearing was vacated on November 20, 2008. FINDINGS: 1. MOC is the operator of the Beaver Creek Unit and will be the operator of the BC-18 well, which will be within the Beaver Creek Unit, Beluga /Upper Tyonek Participating Area, Kenai Peninsula Borough, Alaska. The BC-18 well is proposed as a deviated gas development well with a surface location 1,114 feet from the north line (FNL) and 1672 feet from the west line (FWL) of Section 34, T7N, R10W, Seward Meridian (S.M.), and a projected bottom hole location 741' FSL, 1880' FEL, of Section 27, T7N, R10W, S.M. 3. The BC-18 well will target gas reservoirs that can be discontinuous in the Lower Beluga Formation. 4. The BC-18 well is within 3,000 feet of the BC-10, BC-11 wells, which are producing from the Lower Beluga reservoirs within the Beaver Creek Unit, Beluga /Upper Tyonek Participating Area. • • The BC-3DPN, and BC-6, wells are within 3,000 feet of the BC-18 well but are not productive from the Lower Beluga Formation. The BC-18 will penetrate the Upper Beluga and Sterling Formation reservoirs that are capable of producing gas within the Beaver Creek Unit, Beluga /Upper Tyonek Participating Area. 6. The BC-5 well penetrates the Beluga and Sterling Formations, but produces oil from the Tyonek reservoirs within the Beaver Creek Unit, Beluga /Upper Tyonek Participating Area. 7. By certified mail, MOC sent notice of the application for an order granting an exception to the well spacing requirements of 20 AAC 25.055 to all owners, landowners, and operators of all properties within 3,000 feet of the anticipated productive intervals of the proposed BC-198 well. CONCLUSIONS: Exceptions to 20 AAC 20.25.055(a)(4) are necessary to allow drilling, completion, testing, and regular production of the BC-18 gas well. This well is needed to recover gas reserves and Lower Beluga Formation gas reservoirs that would be left behind due to the discontinuous nature of the Beluga reservoir. 2. Granting a spacing exception to allow drilling, completion, testing, and regular production of the BC- 18well will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: Pursuant to the Commission's authority under AS 31.05.030, and 20 AAC 25.055, the Commission approves MOC's application for an order granting an exception to the well spacing provisions of 20 AAC 25.055(a)(4) to allow drilling, completion, testing, and regular production of the BC-18 well. Because the properties affected by this spacing exception are wholly within the Beaver Creek Unit, Beluga / Tyonek Participating Area, MOC may proceed with regular production as long as it complies with the terms of the Beaver Creek Unit, Beluga /Tyonek Participating Area agreements and all other legal requirements. A request for rehearing must be received by 4:30 PM on the 23`d day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon reheazing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for reheazing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied (i.e., 10~' day after the application for reheazing was filed). Targets: Estimated Top of Beluga Production: Beluga Productive Interval @ 7722' MD, 7129' TVD 741' FSL & 1880' FEL, Section 27, T7N, R10W, S.M. Bottom Hole: Estimated @ 9272' MD, 8679' TVD 741' FSL & 1880' FEL, Section 27, T7N, R10W, S.M. The Beaver Creek No. 18 (BC-18) is to be drilled as a development well within the Beaver Creek Participating Area targeting Lower Beluga gas sands in the Federal Lease A-028083. BC-18 will be drilled to produce gas bearing sands in the Lower Beluga Formation. Specifically, the BC-18 will target the higher pressure, highly discontinuous reservoirs in the deeper section of the Lower Beluga Formation. These. sands have been successfully targeted in the Beaver Creek 16RD (BC-16RD) and the Beaver Creek 19 (BC-19) wells that were drilled in 2007 and 2008, respectively. A location exception is required because the Lower Beluga productive intervals of the BC-18 well will be within a 3,000 foot radius of wells capable of producing from the same Lower Beluga reservoirs, as shown in Exhibit "A." The wells currently producing from the Lower Beluga reservoirs within a 3,000 foot radius of the BC-18 well location are Beaver Creek No. 10 (BC-10) and No. 11 (BC-11). The Beaver Creek No. 3DPN (BC-3DPN) and No. 6 (BC-6) wells are also within 3,000 feet of the same Lower Beluga intervals in BC-18, but are not productive in the Lower Beluga intervals. My responsibilities have included geology of the Cook In1etlKenai Peninsula Areas. 4. That I have been responsible for the geological work related to a Location Exception application for the Marathon Beaver Creek No. 18 Well (BC-18) with a surface location in Section 34, T7N, R10W, S.M. and bottom hole location in Section 27, T7N, R10W, S.M. The BC-18 will be drilled to produce gas bearing sands in the Lower Beluga Formation. Specifically, the BC-18 will target the higher pressure, highly discontinuous reservoirs in the deeper section of the Lower Beluga Formation. These sands have been successfully targeted in the Beaver Creek 16RD (BC-16RD) and the Beaver Creek 19 (BC-19) wells that were drilled in 2007 and 2008, respectively. A location exception is required because the Lower Beluga productive intervals of the BC-18 well will be within a 3,000 foot radius of wells capable of producing from the same Lower Beluga reservoirs, as shown in Exhibit "A." The wells currently producing from the Lower Beluga reservoirs within a 3,000 foot radius of the BC-18 well location are Beaver Creek No. 10 (BC-10) and No. 11 (BC-11). The Beaver Creek No. 3DPN (BC-3DPN) and No. 6 (BC-6) wells are also within 3,000 feet of the same Lower Beluga intervals in BC-18, but are not productive in the Lower Beluga intervals. The Beaver Creek No. 5 (BC-5) is within 3,000 feet of the Lower Beluga intervals in BC-18, but is a Tyonek oil well. There are no other wells productive or non-productive that penetrate the Lower Beluga within 3,000 feet.
