IT APPEARING THAT:
1. BP Exploration (Alaska) Inc. (BPXA), by letter dated November 13, 2008 and received
November 14, 2008 by the Alaska Oil and Gas Conservation Commission (Commission),
requests an order granting an exception to the well spacing requirements of 20 AAC
25.055(a)(3) to allow drilling, completion, testing, and regular production of the proposed
Milne Point Unit No. 5-43 (MPU 5-43) oil development well within the same governmental
quarter section as the MPU 5-37 and proposed MPU S-41A wells, and within 1000 feet of
the proposed MPU S-41A well, within the Milne Point Unit, Ugnu Undefined Oil Pool,
North Slope Borough, Alaska.
2. On November 26, 2008, pursuant to 20 AAC 25.540, the Commission published in the
ANCt-~oRA~E DAtt,Y NEws notice of the opportunity for a public hearing on January 6, 2009.
3. No protest to the application or request for a hearing was received.
4. The public hearing was vacated on December 31, 2008.
FINDINGS:
1. BPXA is the operator of the Milne Point Unit and will be the operator of the MPU 5-43 well,
which will be within the Milne Point Unit, Ugnu Undefined Oil Pool, North Slope Borough,
Alaska.
2. The MPU 5-43 well is proposed as a deviated oil development well with a surface location
3216 feet from the south line (FSL) and 547 feet from the east line (FEL) of Section 12,
T12N, R10E, Umiat Meridian (U.M.), and a projected bottom hole location 743' FSL, 4473'
FEL of Section 7, T12N, R11E, U.M.
3. The MPU 5-43 well will open Ugnu Undefined Oil Pool reservoirs-that are, or may be,
capable of production in the MPU 5-37 and proposed MPU S-41A wells-within the
southwest quarter of Section 7, T12N, R11E, U.M. The anticipated Ugnu productive pool in

MPU 5-37 and proposed MPU S-41A and MPU 5-43 will all lie in the same governmental
quarter section.
4. The anticipated Ugnu productive pool in MPU 5-43 will lie within 1000 feet of the Ugnu
productive pool in the proposed MPU S-41A well: i. e., the MPU 5-43 well will be drilled
and completed within 1000 feet of another well (proposed MPU S-41A drilled to or possibly
capable of producing from the same pool).
5. By certified mail, BPXA sent notice of the application for an order granting an exception to
the well spacing requirements of 20 AAC 25.055 to all owners, landowners, and operators of
all properties within 1000 feet of each anticipated productive interval of the proposed MPU
S-43 well. BPXA provided the Commission the notice, date of mailing, and addresses to
which the notice was sent.
6. MPU S-43 is part of a multi-well pilot project that is intended to test different techniques to
recover cold, viscous oil from the relatively shallow and unconsolidated reservoir sands of
the Ugnu Undefined Oil Pool. It will be drilled to a location within the crest of a structural
compartment to confirm the feasibility of an experimental method of recovering oil and sand
from the Ugnu reservoirs. By modifying the spacing requirements for the pilot project wells,
BPXA will be able to more accurately compare the MPU 5-43 recovery rate with the
recovery rate of the nearby MPU S-41A conventional horizontal well.
CONCLUSIONS:
1. The requested exceptions to 20 AAC 25.055(a)(3) are necessary to allow drilling,
completion, testing, and regular production of the proposed MPU 5-43 oil development well.
This well is needed to determine which production methods will promote more effective
recovery of oil from the Ugnu Undefined Oil Pool.
2. Granting a spacing exception to allow drilling, completion, testing, and regular production of
the MPU 5-43 well will not result in waste or jeopardize the correlative rights of adjoining or
nearby owners.
NOW, THEREFORE, IT IS ORDERED:
Pursuant to the Commission's authority under AS 31.05.030 and 20 AAC 25.055, the
Commission approves BPXA's application for an order granting an exception to the well spacing
provisions of 20 AAC 25.055(a)(3) to allow drilling, completion, testing, and regular production

of the MPU S-43 well. BPXA may proceed with regular production as long as it complies with
the terms of the Milne Point Unit agreement and all other legal requirements.

RECONSIDERATION AND APPEAL NOTICE
As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as
the Commission grants for good cause shown, a person affected by it may file with the Commission an application for
reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An
application for reconsideration must set out the respect in which the order or decision is believed to be erroneous.
The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed.
Failure to act on it within 10-days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this
order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be
filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the
order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within
40 days after the date on which the application for reconsideration was filed.
If the Commission grants an application for reconsideration, this order or decision does not become final. Rather, the order or
decision on reconsideration will be the FINAL order or decision of the Commission, and it may be appealed to superior court.
That appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission
otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on
appeal are limited to the questions presented to the Commission by the application for reconsideration."
In computing a period of time above, the date of the event or default after which the designated period begins to run is not
included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the
period runs until 5:00 p.m. on the next day that does not fall on a weekend or state holiday.

BP Exploration (Alaska) Inc. (BP), by letters received November 4 and November 14,
2008, requests the Alaska Oil and Gas Conservation Commission (Commission) issue orders for
exceptions to the spacing requirements of 20 AAC 25.055(a)(3) to drill the Milne Point Unit No.
S-41A and S-43 development oil wells in the Milne Point Unit, within the same governmental
quarter section and within 1000 feet of wells capable of producing from the same interval.

Surface Location: 3216 feet FSL and 547 feet FEL of Section 12, T12N, R10E, U.M.
Bottomhole Location: 743 feet FSL and 4473 feet FEL, of Section 7, T12N, R1 lE, U.M.
The Commission has tentatively scheduled a public hearing on this application for
January 6, 2009 at 9:00 a.m. at the Alaska Oil and Gas Conservation Commission, at 333 West 7`~'
Avenue, Suite 100, Anchorage, Alaska 99501. To request that the tentatively scheduled hearing
be held, a written request must be filed with the Commission no later than 4:30 p.m. on December
12, 2008.
If a request for a hearing is not timely filed, the Commission may consider the issuance
of an order without a hearing. To learn if the Commission will hold the hearing, call 793-1221
after December 22, 2008.
In addition, written comments regarding this application may be submitted to the Alaska
Oil and Gas Conservation Commission, at 333 West 7`~' Avenue, Suite 100, Anchorage, Alaska

Dear Commissioner Norman:
BP Exploration (Alaska) Inc. (`BP") is appling for an exception to the provisions
of 20 AAC 25.055 for the drilling of MPU S-43 (the "Well") and request approval
to drill the well as described in this Spacing Exception Application.
A brief explanation for why the operator has chosen to drill the specified
location.
The well is part of a multi-year appraisal of the Ugnu heavy oil reservoirs at the
Milne Point S-Pad. The objective of the well is to test the cold heavy oil
production with sand method. The location was selected based on oil column
thickness and location within the crest of the structural compartment. The well is
currently being permitted and is scheduled to be drilled in December of 2008.
The completion and production test of the Well will commence in the summer of
2009 following tract operation approval.
The names of all Owners, landowners, and operators of all properties
within 1,000 feet of the well or portion of the well requiring the spacing
exception that is drilled for oil or within 3,000 feet of a well or portion of
a well that is drilled for gas.

BP Exploration (Alaska) Inc. ("BP") hereby gives notice that it has applied to the
Alaska Oil and Gas Conservation Commission ("AOGCC") for a exception to the
provisions of 20 AAC 25.055 for the drilling of MPU S-43 (the "Well") and request
approval to drill the well as described in the Spacing Exception Application. The
Well will require a spacing exception per the statewide rules of 20 AAC 25.055
(a)(3) because the Well opens the same productive interval as an existing well
that falls within the same quarter governmental section and the Well is closer
than 1000' of a well capable of producing from the same pool. As can be seen
from the enclosed plat the reservoir section of the Well will be completed in the
SW quarter section of Section 7, Township 12, Range 11, Umiat meridian and
falls in the same quarter governmental section as the Milne Point S-37 and S-41A
wells.
BP is appraising the recovery of heavy oil from the Ugnu reservoirs in the Milne
Point Unit. BP's initial efforts are focused on the Milne Point S-Pad area. MPS-43
will test the cold heavy oil production with sand recovery method. The Well will
be drilled this year but will not be completed and produced until summer of
2009.
Since the productive interval to be opened by the well fall within 1000 feet of a
lease in which you are an owner, landowner, or operator you are being notified
of this request for exception from the well spacing rule.

Point Unit. BP's initial efforts are focused on the Milne Point S-Pad area. MPS-43
will test the cold heavy oil production with sand recovery method. The Well will
be drilled this year but will not be completed and produced until summer of
2009.
Since the productive interval to be opened by the well fall within 1000 feet of a
lease in which you are an owner, landowner, or operator you are being notified
of this request for exception from the well spacing rule.
