Union Oil Company of California (UNOCAL), by letter dated November 20, 2008 and received November 24, 2008 by the Alaska Oil and Gas Conservation Commission (Commission), requests an order granting an exception to the well spacing requirements of 20 AAC 25.055(a)(4) to allow drilling, completion, testing, and regular production of the proposed Ivan River Unit No. 11-06 (IRU 11-06) gas development well within the same governmental section as, and within 3000 feet of, other wells in the Ivan River Unit (i.e., the IRU 13-31, IRU 41-01, IRU 44-01 and IRU 44-36 wells) that are, or may be, capable of producing from the same pool (i. e., the Ivan River Undefined Gas Pool), which is in the Kenai Borough, Alaska. 2. On November 26, 2008, pursuant to 20 AAC 25.540, the Commission published in the ANCHORAGE DAILY NEws notice of the opportunity for a public hearing on January 7, 2009. 3. No protest to the application or request for a hearing was received. 4. The public hearing was vacated on December 31, 2008. FINDINGS: 1. UNOCAL is the operator of the Ivan River Unit and will be the operator of the IRU 11-06 well, which will be within the Ivan River Unit, Ivan River Undefined Gas Pool, Kenai Borough, Alaska. 2. The IRU 11-06 well is proposed as a deviated gas development well with a surface location 585 feet from the south line (FSL) and 630 feet from the east line (FEL) of Section 1, T13N, R9W, Seward Meridian (S.M.), and a projected bottom hole location 5040' FSL, 4878' FEL of Section 6, T13N, R8W, S.M. 3. The IRU 11-06 well may open Ivan River Undefined Gas Pool reservoirs from which other wells within Section 1, T13N, R9W, S.M. (i. e., the active IRU 44-O1 gas production well and inactive IRU 13-31, IRU 41-01 and IRU 44-36 gas production wells) are, or may be, capable of producing. 4. The IRU 11-06 well is proposed to be drilled and completed within 3000 feet of other wells (i. e., the active IRU 44-01 gas production well and inactive IRU 13-31, IRU 41-01 and IRU 44-36 gas production wells) drilled to, or possibly capable of producing from, the same pool (i. e., the Ivan River Undefined Gas Pool). • 5. By certified mail, UNOCAL sent notice of the application to all owners, landowners, and operators of all properties within 3000 feet of each anticipated productive pool of the proposed IRU 11-06 well. UNOCAL provided the Commission the notice, date of mailing, and addresses to which the notice was sent. 6. The IRU 11-06 well is needed to recover Ivan River Undefined Gas Pool reserves that are not accessible with existing wells because of the lenticular, discontinuous nature of the reservoir sands. CONCLUSIONS: 1. Exceptions to 20 AAC 20.25.055(a)(4) are necessary to allow drilling, completion, testing, and regular production of the IRU 11-06 gas development well. This well is needed to recover Ivan River Undefined Gas Pool reserves that are not accessible with existing wells. 2. Granting a spacing exception to allow drilling, completion, testing, and regular production of the IRU 11-06 well will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: Pursuant to the Commission's authority under AS 31.05.030 and 20 AAC 25.055, the Commission approves UNOCAL's application for an order granting an exception to the well spacing provisions of 20 AAC 25.055(a)(4) to allow drilling, completion, testing, and regular production of the IRU 11-06 well. UNOCAL may proceed with regular production as long as it complies with the terms of the Ivan River Unit agreement and all other legal requirements. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10-days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the Commission grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the Commission, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited to the questions presented to the Commission by the application for reconsideration." In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs unti15:00 p.m. on the next day that does not fall on a weekend or state holiday. EXCEPTION Ivan River Unit IRU Well 11-06 ADL 32930 Dear Chair Seamount: ~~~„`~ i J :~ Union Oil Company of California ("Union") hereby submits this Application for Spacing Ex- ception to drill the referenced Ivan River Unit ("IRU") Well 11-06. Our anticipated spud date for the well is December 2008. It is anticipated that a Permit to Drill and associated filing fees will follow this letter. The anticipated productive intervals for the IRU Well 11-06 are the Sterling, Beluga, and Tyonek sands. All zones are commingled in the Gas Pool # 1 PA formed in 2000 and located inside the IRU boundaries. Projected Bottom Hole Location 5040 FSL 4878 FEL Sec 06 T13N R9W S.M. 20 AAC 25.055(a)(2) provides, "[fJor a well drilling for gas, a wellbore may be open to test or regular production within 1,500 feet of a property line only if the owner is the same and the landowner is the same on both sides of the line." 20 AAC 25.055 (a)(4) provides in pertinent part, "[a] well may not be drilled or completed closer than 3,000 feet to any well drilling to or capable of producing from the same pool." Union owns 100% working interest in all of the oil and gas leases which are held by the IRU (both inside and outside the Unit). The State of Alaska is the royalty owner of all such leases. Therefore, because the "owner" and "landowner" are the same in all offsetting oil and gas leases which are held by IRU, a spacing exception is not required pursu- ant to 20 AAC 25.055 (a)(2). However, as depicted on the attached plat, IRU Well 11-06 will penetrate the Anticipated Productive Intervals within approximately 2,865 feet of the currently active producer, IRU 44-01. Moreover, IRU Well 11-06 will be within 3,000 feet of other currently inactive gas wells, including IRU 44-36 and IRU 41-01, which are capable of producing from these same - Intervals. For these reasons, a spacing exception is required under 20 AAC 25.055 (a)(4). At the date of this mailing, in accordance with 20 AAC 25.055 (d)(1), notice of this applica- tion has been sent by certified mail to all owners, landowners, and operators within 3,000 feet of the IRU Well 11-06. Certified mailing receipts are attached to this application. Pursuant to 20 AAC 25.055 (d)(2), enclosed is a plat, identified as Exhibit "A", which shows the location of the well for which the exception is sought and all adjoining properties. Also enclosed, Ex- hibit "A-1" identifies the owners, landowners and operators associated with each affected lease. Pursuant to 20 AAC 25.055 (d)(3), an affidavit is enclosed stating the undersigned is acquainted with the facts and verifying that all facts are true. The correlative rights of all landowners (State of Alaska), owners and operators (Union) are adequately protected in this instance, and therefore, Union respectfully requests a spacing ex- ception to authorize the drilling of the IRU Well 11-06.
