IT APPEARING THAT: 1. By application dated and received by the Alaska Oil and Gas Conservation Commission (Commission) on October 1, 2009, Marathon Oil Company "MOC requested an exception to the spacing requirements of 20 AAC 25.055(a)(4) to allow drilling, completion, testing and regular production of the Ninilchik Unit Paxton No. 3 (Paxton No. 3) gas delineation well, Susan Dionne Paxton Participating Area, Kenai Peninsula Borough, Alaska. 2. Pursuant to 20 AAC 25.540, the Commission published notices of opportunity for public hearing in the Anchorage Daily News on October 5, 2009. 3. No protests to the application or requests for hearing were received. 4. Because MOC provided sufficient information upon which to make an informed decision, the Commission determined it could resolve the request without a hearing. The public hearing was vacated on October 30, 2009. FINDINGS: 1. MOC is the operator of the Ninilchik Unit Paxton No. 3 well. 2. Paxton No. 3 will be a deviated gas delineation and production well with a surface location 2921 feet from the east line (FEL) and 617 feet from the north line (FNL) of Section 13, T1S, R14W, Seward Meridian (S.M.), and a projected bottom hole location of 3499 feet FEL, 747 feet FNL, Section 12, TIS, R14W, S.M. 3. The Paxton No. 3 well will target gas reservoirs in the Beluga and Tyonek Formations which can have limited drainage due to the discontinuous nature of the Beluga and Tyonek reservoir sands. 4. MOC has provided the Commission with copies of the notices of the application for exception to the well spacing requirements sent by certified mail from MOC to all owners, landowners, and operators of all properties within 3000 feet of the anticipated productive interval of the proposed Paxton No. 3 well. CONCLUSIONS: 1. An exception to 20 AAC 25.055(a)(4) is necessary to allow drilling, completion, testing and regular production of the Paxton No. 3 well in order to evaluate and produce from gas reservoirs in the Beluga and Tyonek Formations. 2. The properties affected by this spacing exception are within the boundaries of the Ninilchik Unit, Susan Dionne Paxton Participating Area. 3. A spacing exception to allow drilling, completion, testing and regular production of the Paxton No. 3 well will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: MOC's application for exception to the well spacing provision of 20 AAC 25.055(a)(4) for the purpose of drilling, completion, testing and regular production of the Ninilchik Unit Paxton No. 3 well is approved. Because the properties affected by this spacing exception are wholly contained within the Ninilchik Unit Susan Dionne Paxton Participating Area, MOC may proceed with regular production as long as it is in compliance with the terms of the Unit and Participating Area agreements and applicable Alaska law. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10 -days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. A location exception is required because the productive interval of the well is within 3,000 feet of a well capable of producing from the same interval, as shown in Exhibit "A The Susan Dionne No. 6 currently produces from the Tyonek T1 within 3,000 feet of the Paxton No. 3. The Paxton No. 1 and Susan Dionne No. 4 penetrate the Tyonek T1 interval within 3,000 feet but do not produce from this zone. The Beluga is present in the Paxton Location Exception Application October 1, 2009 Marathon Oil Company Page 2 Ninilchik Unit, Susan Dionne/Paxton P.A., Paxton No. 3 Well Kenai Peninsula Borough, Alaska No. 1, Paxton No.2, Susan Dionne No. 4, and Susan Dionne No. 6 within 3,000 feet, but is not currently producing in these wells. The Paxton No. 3 is designed to test the viability of Beluga production in the area. There are no other wells, productive or non productive, that penetrate the Beluga or Tyonek T1 within 3,000 feet. This spacing exception is necessary to efficiently drain the Beluga and Tyonek reservoirs that often have limited drainage areas due to the discontinuous nature of Beluga and Tyonek sands. Attached is a plat showing the Pax -3 surface location and well paths from the Paxton Pad. The Beluga B1 and Beluga B2 cut points are noted on the Paxton No. 1, Paxton No. 2, Susan Dionne No. 4, and Susan Dionne No. 6 well paths. The well is to be drilled as a development well within the Dionne /Paxton Participating Area targeting the Beluga and Tyonek T1 gas sands in the Ninilchik Unit Tract 8 (ADL- 384372). A location exception is required because the productive interval of the well is within 3,000 feet of a well capable of producing from the same interval, as shown in Exhibit "A The Susan Dionne No. 6 currently produces from the Tyonek T1 within 3,000 feet of the Paxton No. 3. The Paxton No. I and Susan Dionne No. 4 penetrate the Tyonek T1 interval within 3,000 feet but do not produce from this zone. The Beluga is present in the Paxton No. 1, Paxton No.2, Susan Dionne No. 4, and Susan Dionne No. 6 within 3,000 feet, but is not currently producing in these wells. The Paxton No. 3 is designed to test the viability of Beluga production in the area. There are no other wells, productive or non productive, that penetrate the Beluga or Tyonek TI within 3,000 feet. This spacing exception is necessary to efficiently drain the Beluga and Tyonek reservoirs that often have limited drainage areas due to the discontinuous nature of Beluga and Tyonek sands.
