IT APPEARING THAT:
1. On July 26, 2010, LINC Energy Operations, Inc (LILAC), requested the Alaska Oil
and Gas Conservation Commission (Commission) issue an order for an exception to
the requirements of 20 AAC 25.055(a)(2) to drill the LEA #1 gas exploration well
within 1500 feet of an adjacent property line.
2. Pursuant to 20 AAC 25.540, the Commission published notice of opportunity for a
public hearing in the Alaska Journal of Commerce on August 8, 2010and The
Frontiersman on August 1, 2010. LINC has provided the Commission with copies of
the notice of the application for exception to the well spacing requirements sent by
certified mail to all owners, landowners, and operators, of all properties within 1500
feet of the anticipated productive intervals of the LEA #1 well.
3. A request for hearing was received by the Commission from CIRI. The hearings
convened on September 14, 2010 and September 20, 2010.
4. At the hearing CIRI expressed concern regarding protection of its correlative rights.
The hearing was continued until September 20, 2010 to allow LINC to provide
additional information.
5. Based upon LINC's representation that it would not produce from the LEA #1 well
without requesting and obtaining the prior written approval of the Commission, at the
September 20, 2010 hearing CIRI withdrew its objection to LINC's request for an
exception to 20 AAC 25.055(a)(2).
FINDINGS:
1. LINC is the operator of the proposed LEA #1 gas exploration well.
2. The proposed LEA #1 is a gas exploration well with a surface and botton hole
location of, 1169 feet FSL and 1895 feet FEL, Section 30, T16N, R3W, Seward
Meridian.

3. The LEA #1 well will target potential gas reservoirs in the Tyonek and Hemlock
Formations.
4. LINC currently holds the State lease where the proposed LEA #1 will be located
(ADL0039588).
5. The proposed location of the LEA #1 well is 1169 feet to the north of an adjacent
lease owned by CIRI and leased to GeoPetro Resources Company (#C-061661).
6. The proposed location for the LEA #1 well lies at the highest point on the structure as
mapped by LILAC.
7. Geologic and geographic features, including a bluff and a housing development,
make moving the location of the LEA #1 well in order to comply with 20 AAC
25.055(a)(2) difficult.
CONCLUSIONS:
1. An exception to spacing requirements of 20 AAC 25.055(a)(2) is necessary to allow
drilling, completion and testing of the proposed LEA #1 gas exploration well.
2. The proposed LEA 41 gas exploration well is within 1500 feet of adjacent property
owners. A spacing exception to allow drilling, completion, and testing of the LEA #1
well will not result in resource waste.
3. In order to protect the correlative rights of adjacent owners, landowners and
operators, prior to production from the LEA #1 well, LINC must request and obtain
the written approval of the Commission.
NOW, THERFORE, IT IS ORDERED:
1. LINC's request for an exception to the requirements of 20 AAC 25.055(a)(2) is
GRANTED. LINC may proceed with drilling, completion, and testing of the LEA
#1 as long as it is in compliance with the terms of the lease, this order and Alaska
Law.

2. LINC's request for approval of regular production of the LEA # 1 is DENIED.
Production from the LEA #1 well may not be undertaken without the Commission's
prior written approval.

RECONSIDERATION AND APPEAL NOTICE
As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the
Commission grants for good cause shown, a person affected by it may file with the Commission an application for reconsideration of
the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration
must set out the respect in which the order or decision is believed to be erroneous.
The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to
act on it within 10-days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this order or decision
and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after
the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision denying
reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which
the application for reconsideration was filed.
If the Commission grants an application for reconsideration, this order or decision does not become final. Rather, the order or
decision on reconsideration will be the FINAL order or decision of the Commission, and it may be appealed to superior court. That
appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise
distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited
to the questions presented to the Commission by the application for reconsideration."
In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in
the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00
p.m. on the next day that does not fall on a weekend or state holiday.

10:30 a.m. We're at the offices of the Alaska Oil & Gas
Conservation Commission located at 333 West Seventh Avenue,
Suite 100, Anchorage, Alaska. To my left is Commissioner Cathy
Foerster, to my right is Commissioner John Norman and I am Dan
Seamount, the Chair.
This is a hearing that has been continued for the second
time from September 14th, 2010.

Notice of this hearing was published on August 1st, 2010
in the Frontiersman, August 8th, 2010 in the Journal of
Commerce as well as the State of Alaska on-line notices and the
AOGCC web site.
The AOGCC received one comment from Cook Inlet Region,
Incorporated.
This hearing is being held in accordance with 20 AAC
25.540, of the Alaska Administrative Code. The hearing will be

MS. FEIGE: All right. My name is Corri Feige, I'm Alaska
Project Manager for Linc Energy Operations.
When we convened the hearing last week on the 14th of
September we came away with a request for Linc to provide data
to CIRI to have them verify the location of the LEA #1. Upon
review of that data it was discovered that there is a
nondisclosure CA agreement which prohibits Linc from
distributing or disclosing that data. We contacted Ms.
Cunningham at CIRI and sent a letter of follow-up to that -- to
that end explaining the situation with that data. And at this
time we have copies of that letter for the Commission if you
would like.
CHAIR SEAMOUNT: We'll enter this in the record, a letter
dated September 16th, 2010 from Linc Energy to Ms. Kim
Cunningham of Cook Inlet Region, Incorporated. Okay.
MS. FEIGE: Okay. Thank you. And essentially what we
once again expressed to CIRI was that we're very interested in
understanding how they believe that their interest may be
harmed by the placement of the LEA 1. It is neither Linc's
intent nor in Linc's interest to cause issues for the rights or
surrounding landowners, that all Linc is trying to do is get

out and make a good solid test of that structure to determine
if a resource is present and we believe that the LEA 1 program
as proposed achieves both of those goals.
CHAIR SEAMOUNT: Commissioner Norman, do you have any
questions, comments?
COMMISSIONER NORMAN: Yes. I think you've asked the
adjacent owner that your proposed project, the hole abuts, to
state how they may be harmed and as I understood it what they
asked for is some additional information so that they could
determine how they're going to be harmed. And now I understand
you can't provide that because of a nondisclosure agreement?
MS. FEIGE: That is correct. We cannot provide the data.
What we were able to provide was the line number, it is
brokered data. We were able to provide the line number and the
physical location of that line of data that's germane to the
LEA program.
COMMISSIONER NORMAN: And without going into any details
on what you can't disclose, but who is your nondisclosure
agreement with?
MS. FEIGE: It would be with the broker from whom we
purchased the data which I believe is Seismic Exchange.
COMMISSIONER NORMAN: Well, can you state who it is with?
MS. FEIGE: Yeah, I believe it is Seismic Exchange.
COMMISSIONER NORMAN: Okay. To the best of your knowledge
it's Seismic Exchange.

that you're asking us to override the general statewide
regulations and do something exceptional, have you asked them

team who advised me that we could not disclose that data
because of the agreement in place with the broker.

MS CUNNINGHAM: My name is Kim Cunningham, I'm
representing CIRI, I'm the Land & Resources Director for CIRI.
As you heard, both Corri Feige and I tried to work through
issues related to accessing the data. Late last week we -- the
steps, I guess, that CIRI has taken at this point are to --
once she indicated that there was an inability to share the
data because of a confidentiality agreement which, you know, I
certainly understand that many times that's how that works and
you can't hand things over. So what we've tried to do is
contact our lessee, Geopetral, to find out if they actually
have any seismic data or interpretations that they can share
with CIRI that would be on our lease acreage that may allow us
to understand this structure better. At this point we have not
heard anything back from them so I don't -- still don't have
anything to look at.
We did take a look at the seismic line as it relates to
the location of the LEA #1 well. I did forward the picture of
that to David Hite who basically said, you know, that's great
to see that seismic line, but it doesn't really tell me enough
technical information about this structure to know whether
there's -- you know, to answer the questions that we would have
about whether this is a good drilling location or not.
When I inquired last week about whether the seismic would
be available through a broker there wasn't any indication to me
about who that broker might be so I've also asked Geopetral if

they can forward to me the name of the broker. It's possible
that CIRI could go enter into an agreement with that broker and
acquire the seismic line ourselves and we would certainly be
willing to do more legwork to look at the data and understand
what the structure actually looks like.
The only thing that in going back through our lease file
to try to understand a little bit more about the well and the
spacing exception and where the structure is at, the only other
thing that I could find in my files was that there was some
indication that the structure was an 11,400 acre structure
which raises even more questions in our minds as far as being
able to look at the data.
And so we -- you know, we come before the Commission this
morning and apologize for having people convene again this
morning, but we really would like to have an opportunity to see
some technical data before we move forward with this issue. So
I'm definitely prepared to try to gather that, whether that's
through a seismic broker or whatever we have to do.

COMMISSIONER FOERSTER: You said that your consultant told
you that he didn't have enough information to determine if
Lines drilling location is a good one or not. Why does CIRI
need to determine whether Linc is drilling in a good location
or not.

MS. CUNNINGHAM: Well, as I stated last time we convened
the hearing, we are concerned about correlative rights and we
don't -- we don't have any data in our possession that allows
us to understand how we might be affected by that.
COMMISSIONER FOERSTER: So how does the quality of Linc's
drilling location selection affect your correlative rights?
MS. CUNNINGHAM: It -- I'm going to look at the notes that
I have from visiting with our technical consultant about that,
but he said basically we were provided with the location of a
single seismic line and that seismic line does not pass through
the well location. So that gives us questions about the
orientation of the structure, it gives us questions about
whether there is an anticline with the cross cutting fault, is
there a tilted fault block, those were the kinds of questions
that came to him as he was trying to look at this for us.
COMMISSIONER FOERSTER: Okay.
CHAIR SEAMOUNT: Commissioner Norman.
COMMISSIONER NORMAN: Yes. Ms. Cunningham, because it was
indicated last time one thing that's puzzling is the absence of
your lessee here and your lessee, I believe the file reflects,
did receive notice some time ago of these proceedings. We
would interpret silence that your lessee has no objection to
going forward. And I'm, again, finding that curious if you as
a landowner are concerned. You pick the lessee, they generally
have an obligation, a good faith covenant to develop, they have

an obligation to protect you against your tract being drained
and yet they're not here. And that is the cause as I see it of
the delay, were they here I think that -- and had they been
here last time, I think this would be a more orderly
proceedings.
And I somewhat am frustrated that we're shadowboxing while
you try to contact your lessee and I'm puzzled again why it
would take that long, I mean, the telephone exists, you
certainly know where they are. So tell me what efforts have
you made to contact your lessee?
MS. CUNNINGHAM: I have sent my lessee e-mail with read
and reply receipts so that I would an understanding of whether
he received the e-mail. We do not have any indication that our
lessee has a current contact person here in Anchorage or an
office here in Anchorage. So what I can tell you is to repeat
the same -- the scenario that has happened is that the lessee
intended to dispose of the lease when he disposed of the other
assets that he had in Anchorage and that did not happen from a
CIRI standpoint, the assignment did not take place.
And I do not know why our lessee is not present, I am
trying to establish communication with him and see if we can
get data from the lessee.
COMMISSIONER NORMAN: True. Thank you. Is it possible

MS. FEIGE: If I could add, we did receive a call from
Stuart Doshee of Geopetral just shortly after they received the
notification letter and I was looking through my notes to
determine what day I received that call on and I'm just not
finding it at the moment. But they did call us to -- said they
have received the notification letter, just asked questions
about the location of the well, what the anticipated spud date
was and just verified the information in the letter and that
was the extent of the conversation and we've heard no more from
them.
COMMISSIONER FOERSTER: So they do have a phone.
COMMISSIONER NORMAN: Well, Ms. Cunningham, last time I
understood Ms. Feige, and I'd ask her to correct me if I
misstate it, to acknowledge that if a discovery is made then
this matter would come back to the Commission and then there
would be presumably the normal pattern is there's a pooling
agreement, parties enter into an agreement.
At that time before you would enter into an agreement you
would certainly have access to something better than the
seismic, you'd have some actual results from the drilling. So
right now insofar as correlative rights are concerned, if you
know that the Commission would continue to retain jurisdiction
and would not allow regular production until there has been

some agreement reached for this pool as is determined to exist,
does that ease any of your concerns?
MS. CUNNINGHAM: Yes, that absolutely would ease my
concerns, yes.
MS. FEIGE: And I would like to note as well that the
Commission does have the data, the confidential data, that it
was a part of our 401 application to drill. And so the data --
the Commission does have before it the information on the
structure and on the location.
COMMISSIONER NORMAN: Very well. I don't have any further

think what we would like to do is withdraw our objection to the
spacing exception and, you know, have that subject to the
requirements that you mentioned, Commissioner Norman, and that
way they could proceed with the drilling and I think all
parties would ultimately be satisfied with the results of that.
MS. FEIGE: And also I would just like to state that, you
know, Linc is very comfortable in coming back before the
Commission if we can't work this out amicably and, you know, we
can come back and revisit this after the well is drilled.
We're happy to work it out that way and come back again.

Thank you for talking with me Wednesday morning about the seismic data coverage for the LEA #1
location. As we discussed, after the AOGCC hearing on Monday, we determined that Linc is bound by a
non -disclosure/ confidentiality agreement that prohibits Linc from disclosing or distributing the
geophysical data relevant to the prospect we are drilling at the LEA #1 well.
As I stressed during our call, Linc is very interested in understanding how GIRT believes its interests may
be harmed by the drilling of the LEA #1 at the proposed location. Linc's intent is not to create issues for
surrounding landowners but simply to make a geologically sound test of the LEA prospect to determine
if a resource is present. We believe the LEA #1 program as proposed achieves both of those missions.
If the LEA #1 well is successful, additional drilling would likely be required to delineate the reservoir.
CIRI would receive notice of that delineation activity. Additionally, as was stated at the September 10
hearing, with success at the LEA #1, Linc would be required to seek unitization of the reservoir for the
protection of all affected mineral interest owners in the reservoir. CIRI would receive notice of any
unitization proceeding. Moreover, none of Lines proposed lease activities would prevent CIRI and/or its
lessee from conducting drilling operations on the CIRI lease.
Linc is keen to establish better communication between our two companies In an effort to resolve any
potential issues as we move forward with the LEA #1 program. As Linc communicated to CIRI in the
letter delivered to your offices on 6 May 2010, we would greatly appreciate the opportunity to sit dawn
with you to discuss our plans in Alaska and how we might work together on endeavors like the LEA #1>

MS. FEIGE: No, no, and -- and my apology. For the record
Linc Energy Operations has applied for the routine spacing
exception on the LEA #1 exploratory well in order to -- to test
the structure that's been identified in geological and
geophysical data that we have for the project area. The
location of the LEA 1 represents the best location for a
geologic test of the structure, it places us at the high point,
it places us very near to an existing seismic line and
operationally the LEA #1 location is also optimal for Linc
because in searching for a location for the well Linc looked
for a location that would create a minimum of disturbance to
private property owners in the area. This 10 acre parcel on
which the LEA #1 is located was for sale at the time that Linc
started looking for a parcel. Linc acquired the parcel and is
able to then establish the pad and all -- all operational
aspects on surface land that is owned by the company, therefore

no surface use authorizations are required and there's no
disturbance or damage being done to private property on the
lease surrounding the LEA 41.
It is a vertical exploratory well and has been placed as
far north on the 10 acre parcel purchased by Linc as could be
accommodated by the bounds of that property. If we move to the
north to expand out to 1,500 feet it would place the LEA #1 in
our opinion too close to what is an apparent cross cutting
structure on the north side of the seismic line. And so
geologically we wish to avoid the complexities that can come
and possible bad hole conditions that can come from being that
close to the structure. So the LEA #1, both operationally and
geologically, represents the best location for the exploratory
well and the test of this structure.
CHAIR SEAMOUNT: Thank you, Ms. Feige. Commissioner

were talking about, the optimal position, and it appears this
is driven mainly by the surface location that you've been able

feet here, 32 feet, whatever. So you have considered whether
that would be feasible to adjust it and explain to me again why
you could not move the location that distance.....
MS. FEIGE: To the north.
COMMISSIONER NORMAN: .....331 feet, that's what about one
football field, a little more?
MS. FEIGE: If you move 330 feet to the north from the
current location topographically there is a steep ridge that
rolls off and -- and, you know, our interpretation is
expression of structure through topography, would be that we're
getting close to the -- the structure that appears to present
itself in the data. And so from an operational standpoint we
would have to move much, much farther north to avoid that ridge
and get into an area where we can establish the pad. That also
puts us squarely in the middle of an area to the north where
the private property owner is building several houses for their
family. So it would require much greater than a simple 330
foot move and additional movement to the north puts us into the
Goose Creek wetland area.
COMMISSIONER NORMAN: And just a follow-up question, the
simple movement to the north a little more than one football

field and then the use of directional drilling wouldn't.....
MS. FEIGE: Use of directional in our -- in our opinion is
not feasible economically. For this we actually did look at
several other locations in the area that we thought possibly
could be reached directionally for better surface locations,
but given the depth of this target we don't believe that it's
feasible.

Director of Land & Resources for Cook Inlet Region,
Incorporated, known as CIRI. I will not be giving any
technical testimony, I'm simply here to ask some questions on
behalf of the landowner.

MS. CUNNINGHAM: Okay. The reason that we requested the
hearing is that we currently have the lease that is depicted on
the map that was provided on LEA 41 well location, the lease
proximity map. The lease that is listed as Geopetral lease C-
061661 in that map is a lease that CIRI has currently with
Geopetral. At least at this point in time that lease has not
been terminated by us or by them. And Geopetral had approached
CIRI to take the lease out because they wanted to drill a well
at this site and had already prepared a pad and drilled a water
well in order to drill that well. And so I am simply coming
forward asking to understand a little bit more about what has
happened with the -- you know, how the spacing exception
affects our current situation with a lessee who had intended to
drill a well on this property. So I would like to understand
the situation a little bit better.
COMMISSIONER FOERSTER: Well, let me make sure I
understand you because I'm not sure I do. You leased your land

to Geopetral and as far as you're concerned they are still the
leaseholder?

record of the lease being farmed out to Linc, but now Linc is
wanting to drill a well on land that you thought you had leased
to Geopetral?
MS. CUNNINGHAM: No, it's not the same land that they're
planning to drill on, it's this -- it's the -- the position on
the map that they're showing as being 1,169 feet away from the
boundary.
COMMISSIONER FOERSTER: Okay. So the land -- okay. Okay.
So does Geopetral still have the lease that -- on the land that
you're referring to and that's not part of anything that you
guys acquired from Geopetral?
MS. FEIGE: Correct, no.
CHAIR SEAMOUNT: So we're talking two separate companies
and two separate leases?
MS. FEIGE: Uh-huh.
COMMISSIONER FOERSTER: But the land that you acquired,
you did acquire from Geopetral?
MS. FEIGE: Correct. Linc acquired the State of Alaska
and Mental Health Trust leases from Geopetral.
COMMISSIONER FOERSTER: Okay. So it -- and you guys have
no ownership in the land on which they intend to drill?

don't drill in the -- a normal spacing that how it would impact
Geopetral's well?
MS. CUNNINGHAM: I guess what I would like to understand
and I should make clear for the record that I'm not here to
contest the drilling of that well, what I am here to try to do
is understand whether there is an impact to our property and
whether there is the ability for us to see the data associated
with the well that's planned to be drilled. So it's more of a
fact finding mission, I guess, on my part.
CHAIR SEAMOUNT: Well, if we give a definition of
correlative rights or -- I mean, if you're not contesting it I
would think that you could talk to our staff and talk to Linc
and get those answers. I -- you know, we protect your -- we
protect Geopetral's correlative rights just like we protect
Linc.
MS. CUNNINGHAM: Correct.
CHAIR SEAMOUNT: So, I mean, if they wanted to drill
outside of a normal spacing unit that they'd have to come in
for a spacing exception. If they wouldn't, then there wouldn't
be -- you know, there wouldn't even be a question, they'd have
the right to drill. And we still haven't made a decision
whether we're going to grant the spacing exception.

anticipated on the Geopetral lease to the south, what was the
anticipated location of that lease?
MS. CUNNINGHAM: Are you asking where they intended to
drill?
COMMISSIONER NORMAN: Where was the well going to be
drilled, yeah.
MS. CUNNINGHAM: It's my understanding and I don't have a
CIRI map here, I brought the one that was in the package, but
the location where they had intended to drill the well was
right about here.
COMMISSIONER NORMAN: Uh-huh. Well, that -- if that was
right there that also then would be abutting up to Linc's well,
would it not, so CIRI or Geopetral would have needed a spacing
exception likewise to drill there. Okay. The land -- just for
clarity, the land immediately to the east, it looks like a 40
acre parcel, that's part of the overall lease ending in 588, is
that correct?
MS. CUNNINGHAM: Yes.
COMMISSIONER NORMAN: Okay. So and then let me just
circle around this real quick too. And then University lands,
the University was given notice and what is the measured

distance from your proposed location to the corner of the
University lands?
MS. FEIGE: To the corner, I don't have that figure in
front of me, but it's about 1,900 feet, yeah. No, I correct
that, Commissioner Norman, it may be just under 1,500 feet.
COMMISSIONER NORMAN: And if it is under 1,500 feet then
that -- well, they have not objected, they received notice,
they have not objected, they're on notice of these proceedings
so we won't dwell on that any further. And so back to -- Ms.
Cunningham, then back to CIRI, your concern is simply to
understand and gain information. Have you had discussions with
Linc on this, often that's the way these things get resolved is
parties have some discussion on it and there's a variety of
ways it could get resolved.
MS. CUNNINGHAM: Okay. That discussion has not taken
place.
COMMISSIONER NORMAN: Okay. Then I think you -- well,
then a way you could proceed is to discuss this with the AOGCC
staff and our mission is -- once this well is drilled then it's
going to have an affect on where the next well could be
drilled, first in the neighborhood in other words. So.....
MS. CUNNINGHAM: Okay.
COMMISSIONER NORMAN: .....that's something you need to
think about and you need to think about it today and you need
to think about it if you want to object to this spacing or if

COMMISSIONER FOERSTER: Typically if no one objects then
we don't worry about -- you know, if you say we're not worried
about correlative rights then we don't worry about it for you.

COMMISSIONER FOERSTER: So if you don't -- if no one
objects on a basis of correlative rights then we put that
matter aside and worry about the other matters that we worry
about in the course of our business. So it's really incumbent
upon you to decide whether this infringes upon your correlative
rights or not and if you feel that it does to object, and if
you feel that it doesn't not to object.
MS. CUNNINGHAM: Okay.
COMMISSIONER FOERSTER: And any other fact finding that
you guys need to do for other purposes doesn't have a place in
this hearing.

decision on geology, whether it's the best structural location

a swamp or -- I mean, there could be a number of geographical
reasons to approve it.
MS. CUNNINGHAM: Right. And I did bring a technical
advisor with me today because that is part of the question. As
I under -- we don't have enough information to understand
whether this is a problem or not. So I came here today hoping
to find out a little bit more about why the spacing exception
needed to be requested so that we could come to some
conclusion.
CHAIR SEAMOUNT: Ms. Feige, she did allude to the reasons
you might want to see if -- I mean.....
MS. FEIGE: First of all if I could say if CIRI would like
to contact Linc we'd be more than happy to sit down and work
something out with you to talk about the location of the well
and potentially work out a confidentiality agreement to show
you the data coming from the well because we do recognize that
within the Geopetral lease package as a whole you do own some
various parcels that are all part of Geopetral's lease. So
please, yes, you know, we'd be more than happy to talk to you
about that and work something out.
In terms of the location as I stated before, moving toward
the north puts us -- there is -- you know, there's the sharp
drop off the edge of the ridge which rolls us then down off of
the optimal location of the structure. By the time we were to
get the well moved out far enough to be away from that ridge

and that cliff and then moving that far out to the north then
places us in the middle of the Goose Creek wetland which you'll
see on that map is immediately to the north there. And so
really and truly to get the best possible test of that
structure that is -- that's how we ended up there, it's really
just worked out to be an optimal location.
And as I do recall though I cannot speak and it may not be
appropriate for me to speak to the position of Geopetral's pad,
but I was involved in the construction of that pad on behalf of
them and the location that they had selected for their well is
just about 2,200 feet from the LEA #1 location. So while we're
within 1,500 feet of the lease line, we're actually greater
than 1,500 from the -- Geopetral's previously proposed location
for their well.
COMMISSIONER NORMAN: But, Ms. Feige, if production is
established here though then you would be closer than 3,000
feet.....
MS. FEIGE: Correct.
COMMISSIONER NORMAN: .....in proximity to a well.....
MS. FEIGE: Correct.
COMMISSIONER NORMAN: .....so and I think that's what Ms.
Cunningham is searching for.
Mr. Chairman, what I would suggest, I think Ms.
Cunningham's wondering what if a discovery is made here, what
ramifications does this have. I would suggest perhaps that we

of the structure that you're testing, if you were to make a
discovery and produce it, would you be draining CIRI land with
your discovery?
MS. FEIGE: You mean in terms of the dimension and the
shape and the direction of the structure?
COMMISSIONER FOERSTER: Yes.
MS. FEIGE: Yes, their acreage would be involved.

indicated that Linc is aware that in the drilling of the well
if a discovery is made and you're ready to go on to commercial
production that you would return to this Commission at that
time and the Commission then would examine correlative rights
based on the data you file. And if it does appear that
property rights of adjacent owners are affected then there's
two ways that it could be handled. One of them is that the
owners, which is most often the case incidentally, you make a
voluntary agreement and you're both happy, but the other route
is that the -- one or the other parties petitions and presents
it to the Commission, we receive the evidence, subsurface data
on that reservoir, and then we made a decision concerning the
extent to which each party should participate in the fullest
sense, meaning get the costs and enjoy the production.

MS. CUNNINGHAM: I can't tell you why Geopetral is not
here, they are not located in Anchorage and I don't know why
they're not here today. We would normally not be put in this
position because our lease -- our lessee is usually in a
position where they come in and they keep us informed about
what's happening and we rely on them for that purpose. So I
apologize if this is awkward, but it does put us in an awkward
spot.
CHAIR SEAMOUNT: It's not awkward, just different.
COMMISSIONER FOERSTER: Yeah. Yeah, we needed something

understand more fully what some of the technical issues would
be that we would need to be concerned with. And one of the
things that we are concerned about is that we could see the
evidence of the cross -- the cross cutting structure that was
referred to and the evidence that there is a feature that
exists that would require the drilling to take place where it's
at. So we would like to be able to see that that is actually
the case.
COMMISSIONER NORMAN: Well, and I believe that Ms. Feige
indicated that were you willing to sign a confidentiality
agreement that that information could be shared with you.
MS. FEIGE: Yeah, absolutely.
COMMISSIONER NORMAN: Okay. And so the record should show
that Ms. Feige is nodding her affirmation.
COMMISSIONER FOERSTER: So we need to resolve whether you
guys are contesting this spacing requirement or not before we
close out this hearing.

know, to put things in the right perspective, we would be in a
position where we would object to that happening until such
time as we see the data that assures us that this is the
location that needs to be drilled.

Linc Energy Operations, Inc.
Application for Exception to Spacing Requirements
Dear Ms. Colombie:
Cook Inlet Region, Inc. (CIRI) respectfully requests a continuance of the above
referenced Public Hearing. I am serving as a juror in a case presided over by Superior
Court Judge Michael R. Spaan and the case is expected to continue through next week.
Unfortunately, this will conflict with the above -referenced hearing and I do not know
how to accommodate both obligations on the same day. I had planned to be present
to testify for CIRI at this hearing but will not be able to do so.
I understand the hearing will need to be convened since it has already been
scheduled, but would respectfully request that the meeting be re -convened on
September 20, 2010 so that I may participate on CIRI's behalf.

Thank you for sharing Ms. Cunningham's request to delay the hearing on Linc's;Application for Exception
to Spacing Requirements. Respectfully, Linc objects to any delay in the Commission's proceedings in
regard to the requested spacing exception. Given our tight operational time -line for the LEA #1 well, we
ask that the Commission proceed with the scheduled hearing on 14 September 2010.
We appreciate that Ms. Cunningham might not be available for the hearing at the scheduled time on 14
September; however, any concerns Cook Inlet Region, Inc. (CIRI) might have in regard to our routine
application certainly could be communicated to the Commission by another CIRI representative and/or
communicated to the Commission in the form of a written submission. 'Moreover, we understand that
the Anchorage Superior Court trial calendars only run until 1:30P. If the Commission is inclined to delay
the hearing to facilitate Ms. Cunningham's direct participation (as opposed to CIRI sending another
representative and/or submitting any objections in writing), we would ask that the Commission set the
hearing for the afternoon of September 14 so Ms. Cunningham might attend following the completion
of the trial calendar on September 14.

The Commission has tentatively scheduled a public hearing on this application for
September 14, 2010 at 9:00 a.m. at the Alaska Oil and Gas Conservation Commission, at 333
West 71h Avenue, Suite 100, Anchorage, Alaska 99501. To request that the tentatively scheduled
hearing be held, a written request must be filed with the Commission no later than 4:30 p.m. on
August 25, 2010.
If a request for a hearing is not timely filed, the Commission may consider the issuance
of an order without a hearing. To learn if the Commission will hold the hearing, call 793-1221

Linc Energy Operations, Inc. ("Linc") plans to drill an exploratory natural gas well, LEA#1, on State of
Alaska Oil & Gas Lease ADL #390588 located in T16N, R3W, Seward Meridian within the Matanuska-
Susitna Borough in late September, 2010 or as soon thereafter as possible. The LEA #1 will reside within
1500 feet of an adjoining lease line. Under the requirements of 20 AAC 25.055(a)(2) and 20 AAC
25.055(d), Linc hereby requests a Spacing Exception for the LEA #1.
Surrounding owners and landowners within 3,000 of the LEA #1 location are listed in the following table
and are shown on the attached Vicinity and Proximity Maps, as well. No completed wells exist on the
property or on adjoining properties. Per the requirements of 20 AAC 25.055(d), Linc has sent a notice of
this application by Certified Mail to those listed in the following table. Acopy of that notice and the
associated Certified Mail receipts, are attached.

Linc Energy Operations, Inc. ("Linc") has applied for a Spacing Exception under the provisions of
20 AAC 25.055(a)(2) for the LEA #1 exploratory natural gas well to be placed on State of Alaska Oil & Gas
Lease ADL #390588 in Section 30, T16N, 113W, Seward meridian, within the Matanuska-Susitna Borough,
Alaska. You are being notified of this application pursuant to the requirements of 20 AAC 25.055(d), as
the LEA #1 will be located within 1500 feet of the northern lease boundary of Cook Inlet Region, Inc. oil
and gas lease #C-061661 currently held by GeoPetro Alaska LLC. A Proximity Map showing the planned
location of the LEA #1 relative to northern boundary of lease #C-061661 is attached for your reference.
Upon receipt of Linc's Application for Spacing Exception, the Alaska Oil and Gas Conservation
Commission will review the application and request public comment prior to making a final decision
regarding the requested Spacing Exception.
