BY DIRECTION OF THE COMMISSION • STATE OF ALASKA ALASKA OIL AND GAS CONSERVATION COMMISSION 333 West Seventh Avenue, Suite 100 Anchorage Alaska 99501 Re: The Application of Aurora Gas, LLC ) Conservation Order No. 637 for an order granting an exception ) to 20 AAC 25.055(a)(2) to provide for ) Cohoe Unit # 1 the re-entry, completion and regular ) production of the Exploratory Cohoe Unit # 1 ) development gas well within ) 1500 feet of an adjacent property line. ) October 14, 2010 IT APPEARING THAT: On August 2, 2010 Aurora Gas, LLC (Aurora) requested the Alaska Oil and Gas Conservation Commission (Commission) grant an exception to the spacing requirements of 20 AAC 25.055(a)(2) to re-enter the Cohoe Unit #1 development gas well, within 1500 feet of an adjacent property line. 2. Pursuant to 20 AAC 25.540, the Commission published notice of opportunity for a public hearing in the Alaska Journal of Commerce on August 29, 2010 and the Peninsula Clarion on August 20, 2010. 3. Aurora has provided the Commission with copies of the notices of the application for exception to 20 AAC 25.055(a)(2) sent by certified mail to all owners, landowners, and operators within 3000 feet of the Cohoe Unit # 1 well. 4. No protests to the application or requests for hearing were received. Because Aurora provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. 5. The public hearing was vacated on September 28, 2010. FINDINGS: 1. Aurora is the operator of the Cohoe Unit #1 well. 2. The Cohoe Unit #1 well is a development gas well with a surface location 819.4 feet from the south line and 1301.6 from the east line of Section 8, Township 3 North, Range 11 West, Seward Meridian. 3. The Cohoe Unit #1 well is a development gas well drilled in 1973 (PTD # 173025). In accordance with applicable regulations, it was plugged and abandoned December 21, 1973. The re-entry into the Cohoe Unit #1 will target the Sterling, Beluga and Tyonek sands in the well. • 4. There are no other wells within 5 miles of the Cohoe Unit # 1 well. Aurora currently holds the subsurface lease from the Department of Natural Resources (ADL 390364) where the well is located and the adjacent CIRI lease. CONCLUSIONS: 1. An exception to 20 AAC 25.055(a)(2) is necessary to allow the re-entry, completion, testing and regular production of the Cohoe Unit #1 in order to evaluate and produce gas from the Sterling, Beluga and Tyonek Formations. 2. The Cohoe Unit # 1 well is within 1500 feet of adjacent property owners. 3. A spacing exception to allow drilling, completion, testing and regular production of the Cohoe Unit #1 well will not result in waste or jeopardize correlative rights of the adjoining or nearby owners. NOW, THERFORE, IT IS ORDERED: Aurora's application for exception to the well spacing provision of 20 AAC 25.055(a)(2) for the purpose of re-entry, completion, testing and regular production of the Cohoe Unit # 1 well is approved. Because the well is located on DNR lease ADL 390364 and Aurora owns the CIRI lease, Aurora may proceed with regular production as long as it is in compliance with the terms of the Lease and applicable Alaska law. The Cohoe #1 is located on the east side of the Cook Inlet, approximately one -mile west of the Sterling Highway, near the community of Kasilo£ A Permit to Drill (#173-025-0) was issued on August 10, 1973. The well was spudded by Unocal on August 12`h and subsequently plugged and abandoned on December 21. 1973. The Cohoe #1 will be targeting gas in the Beluga, Tyonek and Sterling gas sands. There are no other producing wells within five miles of the Cohoe #1. Final engineering design is still being completed and Aurora anticipates re-entering this winter in September 2010. Aurora is the lessee and Operator of the State of Alaska oil and gas lease and the adjoining Cook Inlet Region, Incorporated ("CIRI") oil and gas lease. The Kenai Peninsula Borough is the surface owner. The only affected landowners of this application, within 1,500 feet of the Cohoe #1 well are the Department of Natural Resources ("DNR"), CHU, Rick and Barbara Kraxberger, and the Barbara K.
