IT APPEARING THAT:
1. On November 22, 2010, Cook Inlet Energy, LLC (CIE) requested the Alaska Oil and Gas
Conservation Commission (Commission) grant an exception to the spacing provisions of
20 AAC 25.055(a)(2) to allow drilling and testing of the Stingray No. 2 (Stingray 2)
exploratory well within 1,500 feet of a property line where ownership and landownership
changes.
2. Pursuant to 20 AAC 25.540, on December 1, 2010 the Commission published in the
ANCHORAGE DAILY NEWS notice of the opportunity for a public hearing on January 6,
2011. This notice was also published on the State of Alaska's Online Public Notice
website and on the Commission's website.
3. By certified mail, CIE sent notice of the application to all owners, landowners, and
operators of all properties within 3,000 feet of the anticipated Stingray 2 well. CIE
provided the Commission the notice, date of mailing, addresses to which the notice was
sent, and proof of mailing.
4. No protest to the application or request for hearing was received.
5. The public hearing was vacated on December 28, 2010.
FINDINGS:
1. CIE will be the operator of the proposed Stingray 2 exploratory well located within the
Kenai Peninsula Borough, Alaska.
2. The surface and bottom hole locations for this proposed vertical exploratory well are 527'
from the south line (FSL) and 1,214' from the east line (FEL) of Section 31, TO9N,
R14W, Seward Meridian, Kenai Peninsula Borough.
3. The planned path for Stingray 2 is based on seismic and nearby well information.
4. The prospective exploratory interval and the planned total depth of Stingray 2 lie within
State of Alaska lease ADL- 390735.
5. CIE owns the drilling rights for lease ADL- 390735. The State of Alaska is the landowner
for this lease.
6. The proposed location for Stingray 2 was selected within 1,500 feet of a property line to
evaluate target reservoirs at the optimum location with respect to geologic structure and
potential trapping faults.
7. The Commission received no comments, objections or protests in response to the public
notice regarding the Stingray 2 well or to the notification sent by CIE to all known
owners, landowners and operators within 3,000 feet of the proposed Stingray 2 well.
CONCLUSIONS:
1. Because CIE provided sufficient information upon which to make an informed decision,
the request can be resolved without a hearing.
2. An exception to 20 AAC 25.055(a)(2) is necessary to allow drilling and testing of the
Stingray 2 exploratory well within 1,500 feet of a property line where ownership and
landownership changes.
3. A spacing exception to allow drilling and testing of the Stingray 2 well is consistent with
sound engineering and geoscience principles and will not result in waste or jeopardize
correlative rights of adjoining or nearby owners.
NOW, THEREFORE, IT IS ORDERED:
Pursuant to the Commission's authority under AS 31.05.030 and 20 AAC 25.055, the
Commission approves CIE's application for an order granting exception to the well spacing
provisions of 20 AAC 25.055(a)(2) to allow drilling and testing of the Stingray 2 well. CIE
may proceed with exploratory operations as long as CIE complies with applicable
Commission regulations, Alaska laws, and all o : - , al requirements.

RECONSIDERATION AND APPEAL NOTICE
As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the
Commission grants for good cause shown, a person affected by it may file with the Commission an application for reconsideration of
the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration
must set out the respect in which the order or decision is believed to be erroneous.
The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to
act on it within 10 -days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this order or decision
and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after
the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision denying
reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which
the application for reconsideration was filed.
If the Commission grants an application for reconsideration, this order or decision does not become final. Rather, the order or
decision on reconsideration will be the FINAL order or decision of the Commission, and it may be appealed to superior court. That
appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise
distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited
to the questions presented to the Commission by the application for reconsideration."
In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in
the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00
p.m. on the next day that does not fall on a weekend or state holiday.

Mr. McCutcheon:
The Commission has not yet approved a permit to drill for the Stingray 1 or Stingray 2 exploratory wells. We are bound by
Regulation 20 AAC 25.537(a)(1) and cannot release any information about a well before a permit to drill is approved. After the
permit to drill has been approved, according to that same regulation, the Commission can only release the surface and proposed
bottom -hole locations for the well. These locations are published in the Commission's Weekly Drilling Permit Report, which can
be found on the Internet at http: / /doa.alaska.gov /ogc /drilling /dindex.html. Also, under Regulation 20 AAC 25.537, the
Commission can't say anything about a well beyond the depth, location, status, and any regular production or injection data
until the confidentiality period for the well expires, which is 25 months after the well has been completed, suspended, or
plugged and abandoned.
My apologies, but those are the rules that govern Commission actions.

onshore, on the west side of the Cook Inlet, about 1 mile NW of the Trading Bay Production Facility in the Kustatan
area of the West Forelands (ref. Cook Inlet Oil and Gas Activity Map by Mapmakers Alaska).

Here is the justification given by our geologist:
An exception location is necessary for the proposed well due to geological considerations. The trapping
normal fault strikes in a Northeast Southwest direction. At the top of Beluga as mapped, the fault trace is
less than 600' Northwest of the proposed location. A legal location greater that 1500' off the South line
would fall on the opposite side of the interpreted trapping fault. The proposed location was planned so
that a maximum amount of the Beluga can be evaluated prior to going upthrown on the fault.

Sorry for the delayed response, I was out of the office last week.
Cook Inlet Energy is responsible for preparing and mailing notice to adjacent landowners, owners and operators. Cook
Inlet Energy must furnish AOGCC a copy of that notice, the date of mailing (by providing copies of the certified mail
receipts), and the addresses to which the notice was sent. See 20 AAC 25.055(d).

Re: Docket # CO- 10 -22. Cook Inlet Energy, LLC (CIE), by a letter received
November 22, 2010 and supplementary documentation received November 29, 2010,
requests the Alaska Oil and Gas Conservation Commission (Commission) issue an order
for an exception to the spacing requirements of 20 AAC 25.055 to drill the Stingray No. 2
gas exploration well within 1,500 feet of a property line where ownership and
landownership changes. The proposed location of this vertical well is:
Stingray No. 2
Surface Location: 527' from the south line (FSL) and 1214' from the east line (FEL) of
Section 31, TO9N, R14W, Seward Meridian (S.M.), Kenai Peninsula Borough.
Top Productive Interval Location: Same
Bottom Hole Location: Same
The Commission has tentatively scheduled a public hearing on this matter for January 6,
2011 at 9:00 am. To request that the hearing be held, a written request must be filed by
4:30 p.m. on December 20, 2010.

Re: Spacing Exception for the Stingray #2 Gas Exploration Well
Dear Mr. Seamount,
Cook Inlet Energy, LLC (CIE) hereby applies for an exception under 20 AAC 25.055(d) to the
well spacing requirements in 20 AAC 25.055(a)(2). Specifically, CIE requests approval to drill
the Stingray #2 Well for gas within 1,500 feet of a property line where the owner and landowner
is not the same on both sides of the line.
CIE proposes to drill the Stingray #2 Well from a surface location within Section 31, T. 9 N., R.
14 W., S.M. 1,214 feet from the east section line and 527 feet from the south section line. The
well is a straight hole and will have the same bottomhole location.
The attached Exhibit A lists the owners, landowners, and operators within 3,000 feet of the
Stingray #2 Well and their contact information.
The attached Exhibit B is a plat prepared on Alaska Mapper, the State of Alaska's mapping
program, at a scale which complies with 20 AAC 25.055(d)(2).
The attached Exhibit C is an affidavit from Mr. Pirtle Bates, Jr., Certified Professional Landman
# 56864 and Land Manager for CIE, verifying the plat and facts contained herein.

1. I, Pirtle Bates, Jr., am Land Manager for Cook Inlet Energy, LLC and a Certified
Professional Landman #56864.
2. I have prepared the foregoing Exhibits following a thorough review of land status records
at the State of Alaska, Department of Natural Resources, Division of Oil and Gas and the
State Recorder's Office for the Anchorage Recording District.
3. The Landowners, Owners and Operators, as defined in relevant state statutes and

Re: Notice of Application for Spacing Exception for the Stingray #2 Gas Exploration Well
Landowners, Owners and Operators:
Cook Inlet Energy, LLC (CIE) is applying for an exception under 20 AAC 25.055(d) to the well
spacing requirements in 20 AAC 25.055(a)(2). Specifically, CIE is requesting approval to drill
the Stingray #2 Well for gas within 1,500 feet of a property line where the owner and landowner
is not the same on both sides of the line.
CIE has identified you as an owner, landowner or operator requiring notice of its application.
CIE proposes to drill the Stingray #2 Well from a surface location within Section 31, T. 9 N., R.
14 W., S.M. 1,214 feet from the east section line and 527 feet from the south section line. The
well is a straight hole and will have the same bottomhole location.
The attached Exhibit A lists the owners, landowners, and operators within 3,000 feet of the
Stingray #2 Well and their contact information.
The attached Exhibit B is a plat prepared 011 Alaska Mapper, the State of Alaska's mapping
program, at a scale which complies with 20 AAC 25.055(d)(2).
The attached Exhibit C is an affidavit from Mr. Pirtle Bates, Jr., Certified Professional Landman
# 56864 and Land Manager for CIE, verifying the plat and facts contained herein.
