By letter received August 15, 2012, Aurora Gas, LLC (Aurora) requests the Alaska Oil and Gas Conservation Commission (AOGCC) issue an order for an exception to the spacing requirements of 20 AAC 25.055 to drill and complete the Nicolai Creek Unit No. 13 (NCU 13) development gas well within the same governmental section and within 3,000 feet of wells that are, or may be capable of, producing from the same pool, and within 1,500 feet of a property line where ownership or landownership changes. 2. On August 13, 2012, by certified mail, Aurora sent notice of the application to all owners, landowners, and operators of all properties within 3,000 feet of the planned NCU 13 well. Aurora provided the AOGCC the notice, date of mailing, addresses to which the notice was sent, and proof of certified mailing. 3. Pursuant to 20 AAC 25.540, the AOGCC tentatively scheduled a public hearing for October 23, 2012. On September 6, 2012, the AOGCC mailed printed copies of the notice of the opportunity for public hearing to all persons on the AOGCC's mailing distribution list, published notice of the opportunity for that hearing on the State of Alaska's Online Public Notice website and on the AOGCC' s website, and electronically transmitted the notice to all persons on the AOGCC's email distribution list. On September 16, 2012, the notice was published in the ALASKA JOURNAL OF COMMERCE. 4. No protest to the application or request for hearing was received. 5. The tentatively scheduled public hearing was vacated on October 17, 2012. 6. Because Aurora provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. Order 667 • • December 17, 2012 Page 2 of 3 FINDINGS: 1. Aurora is the operator of the Nicolai Creek Unit and the planned NCU 13 development gas well, which are located in the Kenai Peninsula Borough, Alaska. 2. NCU 13 will be an onshore, deviated development gas well with a surface location 1,724' from the north line and 2,607' from the east line of Section 29, T11N, R12W, Seward Meridian (S.M.). The estimated top of the productive interval is 1,724' from the north line and 2,607' from the east line of Section 29, T11N, R12W, S.M. The projected bottom hole location is 2,394' from the north line and 1,908' from the west line of Section 29, T11N, R12W, S.M. 3. NCU 13 will be located within State of Alaska lease ADL- 391472. 4. Other potentially affected owners, landowners, and operators —those within a 3,000 -foot radius of the well—are the State of Alaska, Alaska Mental Health Trust Land Office, Apache Alaska Corporation, and ConocoPhillips Alaska, Inc. Aurora sent notice of its application to these entities by certified mail on August 13, 2012. 5. Development gas wells NCU 1B, NCU 2, and NCU 9 currently produce within 3,000 feet of, and within the same governmental section as, the planned well NCU 13. 6. The reservoir sands accessed by NCU 13 are discontinuous fluvial sands. 7. The AOGCC received no comments, objections or protests in response to the public notice regarding NCU 13 or to the notification sent by Aurora to all known owners, landowners and operators within 3,000 feet of NCU 13. CONCLUSIONS: 1. Exceptions to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) are necessary to allow drilling and completion of the NCU 13 development well in gas reservoirs in order to maximize recovery of reserves. 2. NCU 13 will recover reserves that are not accessible to other existing wells. 3. A spacing exception to allow drilling and completion of NCU 13 is consistent with sound engineering and geoscience principles and will not result in waste or jeopardize correlative rights of adjoining or nearby owners. 4. Exceptions to the requirements of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) will not promote waste or jeopardize correlative rights. Order 667 • • December 17, 2012 Page 3 of 3 NOW THEREFORE IT IS ORDERED: Aurora's August 13, 2012 application for an order granting exceptions to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) to allow drilling, completion, and regular production of the NCU 13 development gas well are hereby approved. Aurora may proceed with regular production as long as it complies with the terms of the Nicolai Creek Unit Agreement, applicable Alaska laws, and all other legal requirements. Sea sunt, Jr. �, ?x� Commissioner - ommissioner RECONSIDERATION AND APPEAL NOTICE As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the AOGCC grants for good cause shown, a person affected by it may file with the AOGCC an application for reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10 -days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(6), "[t]he questions reviewed on appeal are limited to the questions presented to the AOGCC by the application for reconsideration." In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00 p.m. on the next day that does not fall on a weekend or state holiday. This is the first of 2 or 3 development or extension wells which we plan to permit, and more such seismic displays and maps will be submitted, all of which we wish to hold confidential (we will so indicate on the next submittals). The seismic displays and maps come from proprietary seismic shot by Aurora, and there are non - affected competitors (other oil & gas companies) from whom we wish to keep our seismic and interpretations. As this information is submitted "voluntarily," i.e., not required to be provided under 20 AAC 25.537, we wish to hold it confidential. The Nicolai Creek Unit is operated by Aurora Gas, LLC (Aurora) and is located on the west side of the Cook Inlet. An AOGCC Form 10 -401 Permit to Drill is also being submitted herewith along with the surface location plat is attached, which shows the surface location will be on a new pad, and a map showing the BHL and subsurface ownership. The surface owner is the Mental Health Trust. The NCU 13 will be targeting gas in the Beluga Tsuga and Upper Tyonek Carya sands. These targeted sands are open to production in the NCU 1B, 2, and 9 wells, but are believed to be fault separated. This well is a test of the Nicolai Creek "Footwall" by accessing the referenced sands to the east, on the downthrown side of the north -south fault. The closest well to the proposed NCU 13 is the NCU 9 well, a straight hole approximately 2,800 feet to the southwest at the surface and will be almost 1900' from the vertical location of the BHL . Detailed directional engineering design is being requested from third -party service companies. Aurora anticipates drilling the well later this year. Aurora is the lessee and Unit Operator of the Nicolai Creek Unit and most surrounding oil and gas leases and adjoining governmental sections. The only affected mineral owner within 3000 feet of the well covered by this application is the State of Alaska, Department of Natural Resources (DNR), now the owner of all the Nicolai Creek mineral interests. However, one lease within 3000' (but greater than 1500' away) is held by Apache Alaska Corporation, who holds the ADL- 391266 lease in Section 28 to the east, and ConocoPhillips is a 25% working - interest owner in Segment 4 of ADL- 17585, within 1500' of the proposed bottom -hole and surface locations to the southeast.
