By letter received December 21, 2012, Aurora Gas, LLC (Aurora) requests an exception to the spacing requirements of 20 AAC 25.055(a)(2) to drill, perforate, complete, test and produce the Nicolai Creek Unit No. 14 (NCU 14) development gas well within 1500' of property lines where ownership or landownership changes. 2. On December 17, 2012, by certified mail, Aurora sent notice of the application to all owners, landowners, and operators of all properties within 3,000' of the planned NCU 14 well. Aurora provided the the Alaska Oil and Gas Conservation Commission (AOGCC) the notice, date of mailing, addresses to which the notice was sent, and proof of certified mailing. 3. A public hearing was scheduled for February 28, 2013. On January 8, 2013, the AOGCC mailed printed copies of the notice of the opportunity for public hearing to all persons on the AOGCC's mailing distribution list, published notice of the opportunity for that hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, and electronically transmitted the notice to all persons on the AOGCC's email distribution list. On January 20, 2013, the notice was published in the ALASKA JOURNAL OF COMMERCE. 4. No protest to the application was received. The AOGCC received one email stating no objection to Aurora's application. 5. At the public hearing held on February 28, 2013, Aurora presented testimony in support of the application. No other parties provided comments or testimony at the hearing. Order 669 • • April 18, 2013 Page 2 of 3 FINDINGS: 1. Aurora is owner and operator of the Nicolai Creek Unit and the planned NCU 14 development gas well, which are located on the west side of the Cook Inlet Basin, Kenai Peninsula Borough, Alaska. 2. NCU 14 will be an onshore, deviated development gas well with a surface location 973' from the south line and 624' from the east line of Section 18, T11N, R12W, Seward Meridian (S.M.). The estimated bottom -hole location is 2,038' from the south line and 1,337' from the east line of Section 18, T11N, R12W, S.M. 3. NCU 14 will be the only well in Section 18, T11N, R12W, S.M. 4. NCU 14 will access gas reserves at a structurally advantageous location that is structurally up -dip of, and more than 3,000' from, producing gas development well Nicolai Creek Unit No. 10. Aurora selected the planned location based on interpretation of 3D seismic data, information from nearby wells, and the boundaries of Aurora's leased acreage. 5. NCU 14 will be located within State of Alaska leases ADL- 391472 (surface location) and ADL- 391265 (anticipated productive intervals and bottom - hole), which are owned and operated by Aurora. 6. NCU 14 will access gas reserves within State of Alaska lease ADL- 391265, an irregularly shaped land parcel comprising approximately 167.6 acres' that is adjacent to CIRI acreage and MHT lease 9300066. The anticipated productive intervals lie within 1,500' of property lines where owners and landowners change. 7. Other potentially affected owners, landowners, and operators within a 3,000 -foot radius of the well are the State of Alaska, Department of Natural Resources (DNR); Alaska Mental Health Trust Land Office (MHT); Apache Alaska Corporation (Apache); and Cook Inlet Regional, Inc. (CIRI). Aurora sent notice of its application to these entities by certified mail on December 17, 2012 and provided copies of signed Certified Mail Domestic Return Receipts from each of these entities. On February 22 and 25, 2013, AOGCC contacted Apache and CIRI by telephone to verify receipt of Aurora's application. 8. By email dated February 26, 2013, Apache provided a statement of non - objection to Aurora's application. The AOGCC received no other comments, objections, or protests in response to to the notification sent by Aurora to all known owners, landowners, and operators within 3,000' of NCU 14. 9. Regulation 20 AAC 25.055(b) states in part: "A well may not begin...regular production of gas from a property that is smaller than the governmental section upon which the well is located, unless the interests of the persons owning the drilling rights in and the right to share in the production from the quarter section or section, respectively, have been pooled under AS 31.05.100." 10. Regulation 20 AAC 25.055(c) states: 1 State of Alaska, Department of Natural Resources, Alaska DNR Case Abstract, File Type - ADL, File Number - 391265, available via the Internet at http: / /dnr.alaska.gov /projects /las/Case Abstract.cfm Order 669 • 0 April 18, 2013 Page 3 of 3 "A pooling agreement under AS 31.05.100 must be filed with the commission before regular production from the affected property begins." CONCLUSIONS: 1. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) is necessary to allow drilling, testing, and regular production of the NCU 14 development well in gas reservoirs in order to maximize recovery of reserves. 2. NCU 14 will target reserves inaccessible to Aurora's other existing wells. 3. A spacing exception for NCU 14 is consistent with sound engineering and geoscience principles and will not result in waste. 4. This order authorizes drilling and testing of NCU 14. No production may occur from NCU 14 absent filing a pooling agreement between Aurora, Apache, CIRI, DNR and MHT. See, AS 31.05.100. NOW THEREFORE IT IS ORDERED: Aurora's December 21, 2012 application for an exception to the well spacing provisions of 20 AAC 25.055(a)(2) to allow drilling and testing of the NCU 14 development gas well is hereby approved. After filing a pooling agreement under AS 31.05.100 with the AOGCC, Aurora may proceed with regular production from NCU 14 as long as it complies with the terms of the Nicolai Creek Unit Agreement, applicable Alaska laws, and all other legal requirements. RECONSIDERATION AND APPEAL NOTICE ` ,W s provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the AOGCC grants for good cause shown, a person affected by it may file with the AOGCC an application for reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10 -days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Raper, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. I'll call 4 this hearing to order. Today is February 28th, 2013, 5 the time is 9:03 a.m. This hearing is being held at 6 the offices of the Alaska Oil and Gas Conservation 7 Commission, 333 West Seventh Avenue, Anchorage, Alaska. 8 The purpose of the hearing is to consider the 9 application of Aurora Gas, LLC for an exception to the 10 spacing requirements of Title 20 of the Alaska 11 Administrative Code, specifically Section 25.055(a)(2). 12 If anyone has special needs that would allow 13 you to participate in the proceeding please see Ms. 14 Jody Colombie in the rear of the room. 15 Computer Matrix will be recording this 16 proceeding, you can get a copy of the transcript from 17 Computer Matrix. 18 We'd like to remind those who are testifying to 19 speak into the microphones so that any persons in the 20 rear of the room can hear what you're saying. 21 The specific purpose of the application is for 22 a request for an exception to the well spacing 23 requirements in the Alaska regulations to allow a well 24 to be open to test or regular production within 1,500 25 feet of a property line where the owner and the 3 • S 1 landowner are not the same on both sides of the 2 property line. Aurora Gas, LLC by letter received 3 December 21st, 2012, requested the Alaska Oil and Gas 4 Conservation Commission issue an order for exception to 5 the spacing requirements cited previously to drill and 6 complete the Nicolai Creek Unit Number 15, development 7 gas well within 1,500 feet of a property line where 8 ownership or land ownership changes. 9 The record shows that notice of hearing was 10 published in the Alaska Journal of Commerce on January 11 20th, 2013 and on the State of Alaska online notices as 12 well as on the AOGCC's website. 13 Persons giving testimony will be given the 14 option to present sworn testimony. 15 And I think that covers the preliminaries. I'm 16 going to ask the other two Commissioners that I'll 17 introduce. Immediately to my left is the Commission 18 Chair, Cathy Foerster, and to her left is Commissioner 19 Dan Seamount. And I'll ask beginning with Commissioner 20 Foerster if either Commissioner has any comments. 21 CHAIR FOERSTER: I have no comments. 22 COMMISSIONER SEAMOUNT: I have none. 23 COMMISSIONER NORMAN: Okay. Then if the 24 applicant has a brief statement. The record -- I'll 25 add the record does reflect an affidavit indicating 4 • I 1 that notice was given to the State of Alaska Department 2 of Natural Resources, the Alaska Mental Health Trust 3 Land Office, the Cook Inlet Regional Corporation and to 4 Apache Alaska Corporation which is indicated holds an 5 option on the Cook Inlet Region acreage. 6 So, Mr. Pollock, would you like to proceed now? 7 If so, please raise your right hand. 8 (Oath administered) 9 MR. POLLOCK: I do. 10 GEORGE POLLOCK 11 called as a witness on behalf of Aurora Gas, LLC, 12 testified as follows on: 13 DIRECT EXAMINATION 14 COMMISSIONER NORMAN: Please state your name. 15 MR. POLLOCK: George Pollock. 16 COMMISSIONER NORMAN: And who you represent? 17 MR. POLLOCK: I'm an employee of Aurora Gas, 18 LLC. 19 COMMISSIONER NORMAN: And will you be speaking 20 as an expert or simply a general representative of the 21 company. 22 MR. POLLOCK: General representative of the 23 company. 24 COMMISSIONER NORMAN: Very well. Then you can 25 proceed to give us a general overview of the 5 • 1 application. 2 MR. POLLOCK: You got the location for our 3 planned Nicolai Creek 14 well. The location has been 4 based on three factors, one of those is the geology. 5 This is to get up -dip from our successful Nicolai Creek 6 number 10 well, a development well currently in 7 production and we're looking to stay up -dip of that 8 structural feature to the north /northwest. The second 9 is proximity to that existing well, staying within also 10 our previously captured 3D seismic program. We are 11 right at the northern edge of that State acquisition 12 zone. And the fourth is ownership, we want to stay 13 within the leases that are controlled by Aurora. 14 That's kind of a good general point and I can 15 take any further specific questions. 16 COMMISSIONER NORMAN: Very well. And your 17 application is complete. The -- if the other two 18 Commissioners don't have anything immediate, I have a 19 few questions. I don't think this will take very long. 20 Your icture then is that generally this is all p g Y 21 on one structure, you say you're on the same structure 22 up -dip? 23 MR. POLLOCK: That's our understanding. There 24 are multiple horizons that we're looking at, we believe 25 it to be the same tyonec sea (ph), main pay as in the 6 • ! 1 Nicolai Creek 10 well. And we believe that this is 2 further separated where there won't be drainage and 3 that's what we're pursuing staying within our lands. 4 COMMISSIONER NORMAN: Okay. One of my 5 questions relates to proximity to the Nicolai Creek 6 Unit 3, NCU -3 well and it is not precise, but on the 7 map it looked like one of the requirements for spacing 8 is that it not be within 3,000 feet of another 9 producing gas well. Do you have a pretty good idea -- 10 well, so this well could either be not within 3,000 11 feet or not producing from the same pool. What -- 12 which is it because you have not requested an exception 13 to allow you to drill and produce for that particular 14 requirement. In other words the regulation states that 15 a well may not be drilled or completed closer than 16 3,000 feet to any well drilling to or capable of 17 producing from the same pool, this appears to be very 18 close, if not within that 3,000 feet of the Nicolai 19 Creek 3. Would it help if I 20 MR. POLLOCK: What I've got, and I've got some 21 notes I'll read from. 22 COMMISSIONER NORMAN: Sure. 23 MR. POLLOCK: And what we have, and this with 24 more precise mapping, the map was a sketch that was 25 provided with the exception request. So far, we have only received Apache's receipt back, but we will scan and email you copies of all receipts when received. 2) We sent the offset parties only the application (cover letter, notice, and affidavit) with two plats (NAD 27 and NAD 83), the subsurface ownership map, and a copy of the G &G PowerPoint (16 pages) attached. I also emailed all the parties the same, including the PowerPoint in electronic version. Thus, we did not send the Application for Permit to Drill and its cover letter and attachments (except the plats). 3) As stated above, we will scan and send you copies of the certified mail receipts when received. The directional well will also be crossing lease boundaries, with the surface location on ADL- 391472 (inside the Nicolai Creek Unit) and the bottom -hole location on ADL- 391 -265 (currently outside the Unit), both ADNR leases. The Nicolai Creek Unit and both leases are operated by Aurora Gas, LLC (Aurora) and are located on the west side of the Cook Inlet. An AOGCC Form 10- 401 Permit to Drill is also being submitted herewith along with the surface location plat, which shows the surface location will be on a new pad, and a map showing the BHL and subsurface ownership. The surface owner is Cook Inlet Regional Inc. (CIRI). The NCU #14 will be targeting gas in the Beluga Tsuga and Upper Tyonek Carya sands. Some of the targeted sands are open to production in the NCU #3 and #10 wells, but are more than 3000' away and, in some cases, are believed to be fault separated. This well is step out, up -dip on the anticlinal "nose" structure on which Nicolai Creek #3 and #10 are drilled. The closest well to the proposed NCU #14 is the NCU #10 well, a directional hole approximately 3500 feet to the southeast at the surface, and which will be about this same distance from the wellbore at depth, as both wells are /will be directionally drilled to the northwest. Detailed directional engineering design is being requested from third -party service companies. Aurora anticipates drilling the well in May 2013. Aurora is the lessee of both leases and most surrounding oil and gas leases on adjoining governmental sections and is Unit Operator of the Nicolai Creek Unit. The affected mineral owners within 3000 feet of the well covered by this application are: the State of Alaska, Department of Natural Resources (DNR), now the owner of all the current Nicolai Creek mineral interests; Mental Health Trust; and CIRI. However, one lease within 3000' is ✓ unleased (i.e., about 600' away at TD BHL; thus, within 1500' of the proposed bottom -hole locations to the north), but it is under option to Apache Alaska Corporation, we understand — this is the CIRI lease covering all of Section 18, T11N, R12W, except the SE /4, which is covered by 2 DNR leases, ADL- 391472 and ADL- 391265, both of which are held by Aurora Gas at the depths involved (the deep rights of both lease are being segmented and assigned to Apache). An affidavit attesting to this and the other facts contained herein is attached. - - The #14 well is being drilled as located on the basis of Aurora' s 9-sq. mile 3 D seismic, obtained in 2003. This seismic has consistently been interpreted to show the north -north west to south - southeast structurally -high "nose" on which the producing NCU #3 and #10 are located. The dry -hole NCU #5 falls significantly down -dip to the west of this nose, just over 3000' south - southwest of #14's surface location. The old West Tyonek #1 dry-hole in Section 7 (T11N, R12W) is about 4550' to the north - northwest, but it is believed to be fault separated from this #14 BHL. The #14 will test several Beluga sands and the Upper Tyonek Carya 2 -1, 2 -2, 2 -3, 2 -4, 2 -5, and 2 -6 sands, most of which produced in the #3 (Carya 2 -1 and 2 -2 and Beluga) or #10 (Carya 2 -3, 2 -4, and 2 -5) at a structurally lower location in the same fault block ( #10) or across a fault ( #3). The proposed well is located in Section 18, Township 11 North, Range 12 West, of the Seward Meridian. It is planned to be drilled from a surface location approximately 973 feet from the south section line and 624 feet from the east section line, within the Nicolai Creek Unit located on the west side of the Cook Inlet. The nearest well capable of production from the same reservoir is the Nicolai Creek Unit #10, the surface location of which is about 3495' to the southeast of the proposed surface location in Section 20, and the PDTD bottom -hole location (of #10) is about 2190' from the #14 surface location.
