By a letter received July 30, 2012, NordAq Energy, Inc. ( NordAq) requested an exception to the spacing provisions of 20 AAC 25.055 (a)(2) to allow drilling of the Tiger Eye Central No. 2 exploratory well within 1500 feet of a property line where ownership or landownership changes. An exception to the spacing requirements of 20 AAC 25.055 (a)(4) to drill a well within 3,000 feet of a well that is drilling to or capable of producing from the same pool is also required. 2. The Alaska Oil and Gas Conservation Commission (AOGCC) scheduled a public hearing for September 18, 2012. On August 7, 2012, the AOGCC published notice of the opportunity for that hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, electronically transmitted the notice to all persons on the AOGCC's email distribution list, and mailed printed copies of the notice to all persons on the AOGCC's mailing distribution list. On August 12, 2012, the notice was published in the ALASKA JOURNAL OF COMMERCE. 3. By certified mail, NordAq sent notice of the application to all owners, landowners, and operators of all properties within 1,500 feet of the Tiger Eye Central No. 2 well. NordAq provided the AOGCC the notice, date of mailing, and addresses to which the notice was sent. 4. No protest to the application or request for hearing was received. 5. Because NordAq provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. 6. The tentatively scheduled public hearing was vacated on September 13, 2012. FINDINGS: 1. NordAq is the operator of the Tiger Eye Central No. 2 exploratory well, which is located on the west side of the Cook Inlet, Kenai Peninsula Borough, Alaska. 2. The Tiger Eye Central No. 2 will be an onshore, deviated exploratory well with a surface location 903' from the west line and 540' from the north line of Section 19, TO8N, Conservation Order 670 • • April 10, 2013 Page 2 of 3 R14W, Seward Meridian (S.M.). The projected bottom -hole location is 155' from the east line and 171' from the south line of Section 13, TO8N, R15W, S.M. 3. The surface location of Tiger Eye Central No. 2 will be situated on acreage owned by Cook Inlet Region, Inc. and Salamatof Native Association. The bottom -hole location of the well will lie within State of Alaska lease ADL- 391103. 4. Potentially affected owners, landowners, and operators within a 3,000 -foot radius of the well are the State of Alaska; NordAq; Cook Inlet Region, Inc. and Salamatof Native Association. NordAq sent notice of its application to these entities by certified mail on July 26, 2012. 5. The only nearby oil or gas well is the Tiger Eye Central No. 1 exploratory well located about 1,400 feet to the southwest. 6. The AOGCC received no comments, objections or protests in response to the public notice regarding the Tiger Eye Central No. 2 or to the notification sent by NordAq to all known owners, landowners and operators within 3,000 feet of the Tiger Eye Central No. 2 well. 7. Tiger Eye Central No. 2 is a proposed exploratory well that will test potential reservoir sands in the most structurally favorable position. CONCLUSIONS: 1. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) are necessary to allow drilling and testing of the Tiger Eye Central No. 2 exploratory well. 2. A spacing exception to allow drilling and testing of the Tiger Eye Central No. 2 exploratory well is consistent with sound engineering and geoscience principles and will not result in waste or jeopardize correlative rights of adjoining or nearby owners. 3. Exceptions to the requirements of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) will not promote waste or jeopardize correlative rights. NOW THEREFORE IT IS ORDERED: NordAq's July 30, 2012 application for an order granting an exception to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) to allow drilling and testing of the Tiger Eye Central No. 2 exploratory well is hereby approved as long as NordAq complies with the terms of all lease agreements, applicable Alaska laws, and all other legal requirements. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10 -days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited to the questions presented to the AOGCC by the application for reconsideration." (NordAq) requests a spacing exception under 20 AAC 25.055 (a)(2) to drill the NordAq Tiger Eye Central well within 1,500 feet of the property line of Lease ADL #391103. The well will be drilled into the Tyonek reservoirs and will be used as a potential producing well in the development of the reservoirs. The surface well location is located on Salamatof Native Association Land, with Cook Inlet Region (CIRI) being the owner of the subsurface mineral estate, which NordAq has leased.
