Re: THE APPLICATION OF Hilcorp Alaska,
LLC for an exception to the spacing
requirements of 20 AAC 25.055(a)(2) to test
and produce well Paxton No. 5 exploratory gas
well within 1,500' of a property line where the
owner and landowner are not the same on both
sides of the line.
APPEARING THAT:
Docket Number: CO-13-07
Conservation Order No. 672
Paxton No. 5
Exploratory Gas Well
Ninilchik Unit
Kenai Peninsula Borough, Alaska
July 17, 2013
Hilcorp, by letter received May 22, 2013, requested the Alaska Oil and Gas Conservation
Commission (AOGCC) issue an order for an exception to the spacing requirements of 20
AAC 25.055(a)(2) to test and produce the planned Paxton 5 exploratory gas well within
1,500' of a property line where the owner and landowner are not the same on both sides
of the line.
2. On May 21 and May 29, 2013, by certified mail, Hilcorp sent notice of the application to
all owners, landowners, and operators of all properties within 3,000' of the planned
Paxton 5 well. Hilcorp provided the AOGCC the notice, dates of mailing, addresses to
which the notice was sent, and proof of certified mailing.
A public hearing was scheduled for July 16, 2013. On May 30, 2013, the AOGCC
mailed copies of the Notice of Public Hearing to all persons on the AOGCC's mailing
distribution list, published notice of that hearing on the State of Alaska's Online Public
Notice website and on the AOGCC's website, and electronically transmitted the notice to
all persons on the AOGCC's email distribution list. On June 9, 2013, the notice was
published in the ALASKA JOURNAL OF COMMERCE.
4. No protest to the application or request for hearing was received.
5. The tentatively scheduled public hearing was vacated on July 2, 2013.
6. Because Hilcorp provided sufficient information upon which to make an informed
decision, the request can be resolved without a hearing.
FINDINGS:
1. Paxton 5 will be an onshore, deviated exploratory gas well located in the Ninilchik Unit,
Kenai Peninsula Borough, Alaska.
2. Paxton 5 will have a surface location 798' from the north line and 3019' from the east
line of Section 13, T1S, R14W, Seward Meridian (S.M.) and a planned bottom -hole
location 336' from the north line and 2274' from the west line of Section 13, T1S, R14W,
S.M.
3. Paxton 5 will be located on private land within the Ninilchik Unit. Hilcorp is the owner
and operator of the Ninilchik Unit and Paxton 5.
Order 672
July 17, 2013
4. Hilcorp selected the planned location of Paxton 5 based on interpretation of seismic data,
information from nearby wells, and the boundaries of Hilcorp's leased acreage. Paxton 5
is necessary to log and test intervals not open to existing wells.
5. There are many potentially affected owners, landowners, and operators within a 3,000-
foot radius of the well. Hilcorp sent notice of its application to these entities by certified
mail on May 21 and 29, 2013 and provided proof of certified mailing for each.
6. The AOGCC received no comments, objections, or protests in response to the notification
sent by Hilcorp to all owners, landowners, and operators within 3,000' of Paxton 5.
CONCLUSIONS:
1. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) is necessary to test
and regularly produce the Paxton 5 exploratory gas well.
2. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) for Paxton 5 is
consistent with sound engineering and geoscience principles and will not result in waste
or jeopardize correlative rights of adjoining or nearby owners.
NOW THEREFORE IT IS ORDERED:
Hilcorp's May 22, 2013 application for an exception to the well spacing provisions of 20 AAC
25.055(a)(2) to allow test and regularly produce the Paxton 5 exploratory gas well is hereby
approved as long as Hilcorp complies with the terms of all lease agreements, apple 5.
laws, and all other legal requirements. /15P \

filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision
on reconsideration. As provided in AS 31.05.080(b), " [tlhe questions reviewed on appeal are limited to the questions presented to the
AOGCC by the application for reconsideration."
In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in
the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00
p.m. on the next day that does not fall on a weekend or state holiday.

Jody,
The primary concern with this exploratory well is proximity to property lines. Hilcorp lists 30 affected owners and
landowners, and they have provided us with photocopies of the 30 envelopes that were sent out to these parties. If no
one has requested a hearing, I don't see a reason to hold one.
Thanks,

Just a quick follow-up on our PAX-5 spacing exception: were any requests for a hearing filed? If not, will AOGCC
consider the matter without a hearing?
Hilcorp is on schedule to commence drilling this new exploratory well in late August. Because this is a relatively shallow
gas well, drilling will only take 30 days and we anticipate testing/production by September 30, 2013.
If no hearing is required, please do not hesitate to contact me should you need additional information.

When you can, could you please provide copies of the certified mail receipts for all affected openers and landowners?
I also noticed that the size of the parcel is only 33 acres, and that there are a number of nearby land parcels shown on
the map shown in Exhibit A. Regulation 20 AAC 25.055(b) states:
"(b) A well may not begin regular production of oil from a property that is smaller than the governmental quarter
section upon which the well is located or begin regular production of gas from a property that is smaller than the
governmental section upon which the well is located, unless the interests of the persons owning the drilling rights
in and the right to share in the production from the quarter section or section, respectively, have been pooled
under AS 31.05,100."
How will the proposed Paxton 5 well meet this requirement?

David,
At the bottom of the first page of Hilcorp's application for spacing exception for Paxton 5, is the sentence: "However,
there a number of affected owners and landowners within 1500' of this plot..."
Regulation 20 AAC 25.055 (d) requires notification of all owners, landowners, and operators of all properties within
3,000' of a well drilling for gas for which an exception is sought. Has Hilcorp notified all affected owners and landowners
within 3000' of the proposed well? Are the names of those owners and landowners included in the list in Exhibit B of
the application?

Anchorage, Alaska 99501
RE: Application for exception to 20 AAC 25.055(a)(2) for Exploratory Gas Well PAX-5
within the Ninilchik Unit
Dear Commissioner Foerster,
To date, no special Pool Rules have been established within the Ninilchik Unit, and all
gas produced within the Susan Dionne -Paxton Participating Area has been reported as
either "SD Tyonek Undefined" (Field Pool Code 562560) or "SD Beluga Undefined" (Field
Pool Code 562550). Therefore, statewide spacing regulation, 20 AAC 25.055(a)(2) is
controlling. In relevant part, this regulation provides...
For a well drilling for gas, a wellbore may be open to test or regular
production within 1,500 feet of a property line only if the owner is the
same and the landowner is the same on both sides of the line.
The surface and bottom -hole location of the proposed exploratory well are located
within the Ninilchik Unit, but outside of the Susan Dionne -Paxton Participating Area.
Hilcorp holds leases for both the mineral and surface owners of the proposed drilling
location.
The proposed drilling location (including the surface, bottom -hole and proposed take
points) are located on a 33.21 acre parcel within NE4 NW4, Section 13, Township 1
South, Range 15 West, Seward Meridian, Alaska (Govt. Lot 1, KPB Parcel 15703001).
The location of PAX-5 and its relationship to adjoining properties and wells within 1500'
is depicted on Exhibit A. As demonstrated by this plat, no other wells with perforations
in the Upper Beluga / Lower Sterling exist. However, there are a number of affected
owners and landowners within 1,500' of this plot (all of which is located within the
Ninilchik Unit Boundary). See Exhibit B.
Ninilchik Unit
PAX-5 Spacing Exception
May 21, 2013
If the proposed exploratory well is successful, Hilcorp anticipates forming a new
Participating Area (or expanding the existing Susan Dionne Paxton Participating Area)
to include the Upper Beluga and Lower Sterling Formation.
Because all affected owners and landowners are within the Ninilchik Unit, and Hilcorp,
as operator, owns a 100% working interest in the unit, the correlative rights of all
affected owners, landowners will be protected by approval of the requested spacing
exception.
At the date of this mailing, a copy of this proposed amendment was sent by certified
mail to the all affected owners and landowners. Also enclosed is an affidavit stating the
undersigned is acquainted with the facts and verifying that all facts asserted herein are
true.
Hilcorp anticipates drilling this well in August 2013, and completing the well
immediately thereafter. Following routine testing and completion, Hilcorp seeks to
have this well operational prior to the onset of cold weather conditions this fall.
Therefore, we respectfully request the Commission expedite its ruling on this particular
request.
Should you have any technical questions, please contact Mr. David Buthman, Senior
Geologist, at 777-8395, or you may contact the undersigned at 777-8414.

Well Pax-5
I, DAVID W. DUFFY, Landman, Hilcorp Alaska, LLC, do hereby verify the following:
I am acquainted with Hilcorp Alaska, LLC's Application For Sundry Approval
submitted on or about May 20, 2013; AOGCC subsequent approval of well work
associated with Well PAX-5 within the Ninilchik Unit, and relevant laws and
regulations, including 20 AAC 25.055.
I assert all facts outlined in the above -referenced application for an exception to
20 AAC 25.055(a)(2) are true. I further assert the requested spacing exception is
necessary to explore this particular location of the Ninilchik Unit for shallow gas.
I have reviewed the plat attached to said application and it correctly portrays
the pertinent and required data for the Commission to take action on this
request.

I'm checking through all of the certified mailing information, and I believe one copy of the
certified mailing envelope is missing for Lind & Games Brown of Farmington, ME. They are
listed in Exhibit B (attached to your May 21st email), but I don't see a copy of the

Steve -
Per your request, and in conformance with 20 AAC 25.055(d), Hilcorp has issued a supplemental notice to all owners and
landowners (there are no other operators) within 3000' of the proposed PAX-5 exploratory well. The original mailing
gave notice to all owners/landowners within 1500' of the well. A copy of the mailing list (and proof of certified mailing)
is attached.
If you need additional information regarding this spacing exception application, Hilcorp would be pleased to provide
AOGCC with a technical briefing.

Subject: Paxton 5 Spacing Exception
David,
At the bottom of the first page of Hilcorp's application for spacing exception for Paxton 5, is the sentence: "However,
there a number of affected owners and landowners within 1500' of this plot..."
Thanks,
Steve Davies
