APPEARING THAT: Docket Number: CO-13-07 Conservation Order No. 672 Paxton No. 5 Exploratory Gas Well Ninilchik Unit Kenai Peninsula Borough, Alaska July 17, 2013 Hilcorp, by letter received May 22, 2013, requested the Alaska Oil and Gas Conservation Commission (AOGCC) issue an order for an exception to the spacing requirements of 20 AAC 25.055(a)(2) to test and produce the planned Paxton 5 exploratory gas well within 1,500' of a property line where the owner and landowner are not the same on both sides of the line. 2. On May 21 and May 29, 2013, by certified mail, Hilcorp sent notice of the application to all owners, landowners, and operators of all properties within 3,000' of the planned Paxton 5 well. Hilcorp provided the AOGCC the notice, dates of mailing, addresses to which the notice was sent, and proof of certified mailing. A public hearing was scheduled for July 16, 2013. On May 30, 2013, the AOGCC mailed copies of the Notice of Public Hearing to all persons on the AOGCC's mailing distribution list, published notice of that hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, and electronically transmitted the notice to all persons on the AOGCC's email distribution list. On June 9, 2013, the notice was published in the ALASKA JOURNAL OF COMMERCE. 4. No protest to the application or request for hearing was received. 5. The tentatively scheduled public hearing was vacated on July 2, 2013. 6. Because Hilcorp provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. FINDINGS: 1. Paxton 5 will be an onshore, deviated exploratory gas well located in the Ninilchik Unit, Kenai Peninsula Borough, Alaska. 2. Paxton 5 will have a surface location 798' from the north line and 3019' from the east line of Section 13, T1S, R14W, Seward Meridian (S.M.) and a planned bottom -hole location 336' from the north line and 2274' from the west line of Section 13, T1S, R14W, S.M. 3. Paxton 5 will be located on private land within the Ninilchik Unit. Hilcorp is the owner and operator of the Ninilchik Unit and Paxton 5. Order 672 July 17, 2013 Page 2 of 2 4. Hilcorp selected the planned location of Paxton 5 based on interpretation of seismic data, information from nearby wells, and the boundaries of Hilcorp's leased acreage. Paxton 5 is necessary to log and test intervals not open to existing wells. 5. There are many potentially affected owners, landowners, and operators within a 3,000- foot radius of the well. Hilcorp sent notice of its application to these entities by certified mail on May 21 and 29, 2013 and provided proof of certified mailing for each. 6. The AOGCC received no comments, objections, or protests in response to the notification sent by Hilcorp to all owners, landowners, and operators within 3,000' of Paxton 5. CONCLUSIONS: 1. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) is necessary to test and regularly produce the Paxton 5 exploratory gas well. 2. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) for Paxton 5 is consistent with sound engineering and geoscience principles and will not result in waste or jeopardize correlative rights of adjoining or nearby owners. NOW THEREFORE IT IS ORDERED: Hilcorp's May 22, 2013 application for an exception to the well spacing provisions of 20 AAC 25.055(a)(2) to allow test and regularly produce the Paxton 5 exploratory gas well is hereby approved as long as Hilcorp complies with the terms of all lease agreements, apple 5. laws, and all other legal requirements. /�15P \ DONE at Anchorage, Alaska and dated July 17, 2013. o Cathy P. Foerster Norman Chair, Commissioner Commissioner RECONSIDERATION AND APPEAL NOTICE As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the AOGCC grants for good cause shown, a person affected by it may file with the AOGCC an application for reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10-days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), " [tlhe questions reviewed on appeal are limited to the questions presented to the AOGCC by the application for reconsideration." Regulation 20 AAC 25.055(b) states: "(b) A well may not begin regular production of oil from a property that is smaller than the governmental quarter section upon which the well is located or begin regular production of gas from a property that is smaller than the governmental section upon which the well is located, unless the interests of the persons owning the drilling rights in and the right to share in the production from the quarter section or section, respectively, have been pooled under AS 31.05,100." Therefore, statewide spacing regulation, 20 AAC 25.055(a)(2) is controlling. In relevant part, this regulation provides... For a well drilling for gas, a wellbore may be open to test or regular production within 1,500 feet of a property line only if the owner is the same and the landowner is the same on both sides of the line. The surface and bottom -hole location of the proposed exploratory well are located within the Ninilchik Unit, but outside of the Susan Dionne -Paxton Participating Area. Hilcorp holds leases for both the mineral and surface owners of the proposed drilling location. The proposed drilling location (including the surface, bottom -hole and proposed take points) are located on a 33.21 acre parcel within NE4 NW4, Section 13, Township 1 South, Range 15 West, Seward Meridian, Alaska (Govt. Lot 1, KPB Parcel 15703001). The location of PAX-5 and its relationship to adjoining properties and wells within 1500' is depicted on Exhibit A. As demonstrated by this plat, no other wells with perforations in the Upper Beluga / Lower Sterling exist. However, there are a number of affected owners and landowners within 1,500' of this plot (all of which is located within the Ninilchik Unit Boundary). See Exhibit B.
