By a letter received October 22, 2013, Hilcorp Alaska, LLC (Hilcorp) requested amendment of Conservation Order No. 531 (CO 531) to grant a spacing exception to allow sidetrack drilling, testing, completion, and production of the Susan Dionne No. 2A gas development well within 1,500' of a property line where the owner and landowner are not the same on both sides of the line and within 3,000' of a well that is, or may be capable of, producing from the same pool. 2. Pursuant to 20 AAC 25.540, the Alaska Oil and Gas Conservation Commission (AOGCC) tentatively scheduled a public hearing for December 3, 2013. On October 25, 2013, the AOGCC published notice of the opportunity for that hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, electronically transmitted the notice to all persons on the AOGCC's email distribution list. On October 28, 2013, the AOGCC mailed printed copies of the notice to all persons on the AOGCC's mailing distribution list. On October 28, 2013, the notice was published in the ANCHORAGE DAILY NEWS. 3. Pursuant to 20 AAC 25.055(d)(1), Hilcorp sent by certified mail notice of the application to all owners, landowners, and operators of all properties within a 3,000-foot radius of the proposed Susan Dionne 2A well. Hilcorp provided the AOGCC with a copy of the notice, date of mailing, Certified Mail Receipts, and addresses to which the notice was sent. 4. No protest to the application or request for hearing was received. 5. On November 19, 2013, the tentatively scheduled public hearing was vacated. 6. Because Hilcorp provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. Conservation Order 682 • December 26, 2013 Page 2 of 3 FINDINGS: 1. Hilcorp is the operator of the Ninilchik Field, the Ninilchik Unit, and the proposed Susan Dionne 2A gas development well, which are located in the Kenai Peninsula Borough, Alaska. 2. Susan Dionne 2A will be a deviated re -drill (sidetrack) of existing gas development well Susan Dionne No. 2 (Susan Dionne 2), which has an onshore surface location 219' from the south line and 1,418' from the east line of Section 6, Township 1 South, Range 13 West, Seward Meridian (S.M.). The projected offshore bottom -hole location for Susan Dionne 2A is 2,339' from south line and 2,094' from west line of Section 6, Township 1 South, Range 13 West, S.M. 3. The deeper portion of the Susan Dionne 2 well will be permanently plugged and abandoned. Susan Dionne 2A will re -use the shallow casing of Susan Dionne 2. Susan Dionne 2A will be kicked off and drilled to a new bottom -hole location. 4. The surface location of Susan Dionne 2 and Susan Dionne 2A is situated on Kenai Peninsula Borough Parcel No. 15701073. The landowner of this parcel is a private person; Hilcorp is the owner and surface estate owner. The bottom -hole location of Susan Dionne 2A will lie within State of Alaska lease ADL 359242. 5. Susan Dionne 2A will target reservoir sandstone beds within the Susan Dionne Beluga Undefined Gas Pool (SD Beluga Undefined Pool). Gas development well Susan Dionne No. 7 is, or may be capable of, producing from reservoirs assigned to this pool and lies within 3,000' of planned well Susan Dionne 2A. 6. Susan Dionne 2A will access gas reserves that are not accessible to other wells because Beluga sandstone reservoirs are lenticular and discontinuous. Wells producing from the SD Beluga Undefined Pool in this area reportedly drain areas ranging from 10 to 180 acres in size. 7. On October 18, 2013, Hilcorp sent the application for exception by certified mail to all affected owners, landowners, and operators—i. e., State of Alaska, CIRI, and eight private persons. Hilcorp provided addresses and Certified Mail Receipts to the AOGCC as proof that the application was mailed to all affected owners, landowners, and operators. 8. The AOGCC received no comments, objections, or protests in response to the public notice regarding the proposed Susan Dionne 2A well or to the notification sent by Hilcorp to all affected owners, landowners, and operators within 3,000' of Susan Dionne 2A. 9. CO 531 granted an exception to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) for the purpose of drilling and producing the Susan Dionne 2 gas development well. CONCLUSIONS: 1. Susan Dionne 2A will recover reserves that are not accessible to existing gas development wells. Conservation Order 682 • December 26, 2013 Page 3 of 3 2. CO 531 granted an exception to spacing provisions for the Susan Dionne 2 gas development well. Since Susan Dionne 2A will be a separate well, statewide regulations 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) govern spacing for Susan Dionne 2A. 3. The AOGCC considers Hilcorp's October 22, 2013 letter to be an application for an exception to spacing provisions filed pursuant to 20 AAC 25.055(d). 4. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) is necessary to allow drilling, testing, completion, and production of the Susan Dionne 2A gas development well. 5. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) for the Susan Dionne 2A gas development well is consistent with sound engineering and geoscience principles and will not result in waste or jeopardize correlative rights of adjoining or nearby owners. NOW THEREFORE IT IS ORDERED: Hilcorp's October 22, 2013 application for an order granting an exception to well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) to allow drilling, testing, completion, and production of the Susan Dionne 2A gas development well within the Ninilchik Field, Ninilchik Unit, Ninilchik, Susan Dionne Beluga Undefined Gas Pool is hereby approved as long as Hilcorp complies with the terms of all lease agreements, applicable Alaska laws, and all other legal requirements. Seamount, Jr. Chair, Commissioner Commissioner RECONSIDERATION AND APPEAL NOTICE As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the AOGCC grants for good cause shown, a person affected by it may file with the AOGCC an application for reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10-days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited to the questions presented to the AOGCC by the application for reconsideration." Former Unit Operator, Marathon Oil Company ("Marathon") then drilled and completed SD-2 in 2004. Several Tyonek zones produced for short periods, but the well did not deliver on its potential. In early 2013, Hilcorp Alaska, LLC ("Hilcorp"), as successor Operator of the Ninilchik Unit, abandoned the zones below 6700' with a through -tubing bridge plug but was unsuccessful at returning the well to production following a rig workover. Hilcorp now proposes to plug and abandon the open perforations, followed by sidetracking with a drilling rig, testing, completion and production of the Undefined Beluga Pool. To date, no special Pool Rules have been established within the Ninilchik Unit, and all gas produced been reported as either "SD Tyonek Undefined" (Field Pool Code 562560) or "SD Beluga Undefined" (Field Pool Code 562550). Therefore, statewide spacing regulations are controlling. In relevant part, 20 AAC 25.055(a) provides: (2) for a well drilling for gas, a wellbore may be open to test or regular production within 1,500 feet of a property line only if the owner is the same and the landowner is the same on both sides of the line. (4) if gas has been discovered, the drilling unit for the pool is a governmental section; not more than one well may be drilled to 9 Ninilchik Unit Application to Amend CO 531 October 17, 2013 Page 2 of 7 and completed in that pool on any governmental section; a well may not be drilled or completed closer than 3,000 feet to any well drilling to or capable of producing from the same pool. The location of SD-2A and its relationship to adjoining properties and wells is depicted in Exhibit A. As demonstrated by the plat: • Hilcorp is the only "operator" within the affected area. • Hilcorp is the "owner" of all the leases shown within 1500' of the proposed Top of Productive Horizon (TPI);1 all said leases are contained within the Ninilchik Unit;2 none are segmented with respect to depth. • The distance to the nearest point where "landownership" changes is —965' from the proposed TPI.3 However, Hilcorp is the surface estate owner of the affected parcel (KPB Parcel Id. 15701073), which also serves as the Surface Hole Location (SHL) of the well. • The next closest point where "landownership" changes is approximately 1381' from the proposed TPI. The subsurface of the affected parcel is leased to Hilcorp Alaska (Ninilchik Unit Tract 144) and the private lessor also owns the surface estate. • The nearest well (SD-7) open to the Undefined Beluga Pool is located 2,914' to the south. See Exhibit B (Confidential). Based on confidential geological and engineering data available to Hilcorp, it is apparent that the Beluga sandstones particularly discontinuous and unpredictable, that they drain small areas as small as —40 to 60 acres, with the majority of Beluga sands drain less than 180 acres or—1,575ft radius), and that the proposed development of SD- 2A is necessary to maximize recovery of gas from the Undefined Beluga Pool. Hilcorp owns a 100% working interest in the Ninilchik Unit. At the date of this mailing, a copy of this proposed amendment was sent by certified mail to the all affected owners, landowners and operators. Also enclosed is an affidavit stating the undersigned is acquainted with the facts and verifying that all facts asserted herein are true.
