By letter received October 25, 2013 and by letter of correction received November 21, 2013, Hilcorp Alaska, LLC (Hilcorp) requested the Alaska Oil and Gas Conservation Commission (AOGCC) issue an order authorizing Hilcorp to test and produce development gas well Susan Dionne No. 8 within 1500' of a property line where the owner and landowner are not the same on both sides of the line; and where the well is within the same governmental section as, and within 3000' of, another well that is, or may be capable of, producing from the same pool. 2. Pursuant to 20 AAC 25.540, the AOGCC tentatively scheduled a public hearing for January 2, 2014. On November 25, 2013, the AOGCC published notice of the opportunity for that hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, electronically transmitted the notice to all persons on the AOGCC's email distribution list. On November 25, 2013, the AOGCC mailed printed copies of the notice to all persons on the AOGCC's mailing distribution list. On November 26, 2013, the notice was published in the ANCHORAGE DAILY NEWS. 3. Pursuant to 20 AAC 25.055(d)(1), Hilcorp sent by certified mail notice of the application to all owners, landowners, and operators of all properties within a 3,000-foot radius of the proposed Susan Dionne No. 8 well. Hilcorp provided the AOGCC with a copy of the notice, date of mailing, Certified Mail Receipts, and addresses to which the notice was sent. 4. No protest to the application or request for hearing was received. 5. On December 27, 2013, the tentatively scheduled public hearing was vacated. 6. Because Hilcorp provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. Conservation Order 683 • • January 14, 2014 Page 2 of 3 FINDINGS: 1. Hilcorp is the owner and operator of the Ninilchik Field, the Ninilchik Unit, and the proposed Susan Dionne No. 8 development gas well, which are located in the Kenai Peninsula Borough, Alaska. 2. Susan Dionne No 8 has an onshore surface location 243' from the north line and 2629' from the east line of Section 6, T1S, R13W, Seward Meridian (S.M.). The offshore bottom -hole location for Susan Dionne No. 8 is 792' from the north line and 2051' from the west line of Section 7, T1S, R13W, S.M. 3. The surface location of Susan Dionne No. 8 is situated on privately held property. The wellbore passes through Cook Inlet Region, Inc. property, State of Alaska lease ADL- 359242, and reaches total depth in State of Alaska lease ADL-384372. 4. Susan Dionne No. 8 was drilled as an exploratory well from July to September 2013. After reaching a total measured depth of 12,130', open -hole logs and short-term drill stem tests were conducted in deep, exploratory target formations. These tests were unsuccessful. 5. As originally drilled, Susan Dionne No. 8 did not require exceptions to spacing requirements for drilling and testing due to the location of the target formations. 6. Hilcorp now proposes to test and complete Susan Dionne No. 8 as a development gas well in shallower reservoir sandstone beds within the Susan Dionne Beluga Undefined Gas Pool (SD Beluga Undefined Gas Pool) and the Susan Dionne Tyonek Undefined Gas Pool (SD Tyonek Undefined Gas Pool). A spacing exception is now required because Susan Dionne No 8 will open these gas pools within 1500' of a property line where the owner and landowner are not the same on both sides of the line and within the same governmental section as, and within 3000' of, another well that is, or may be capable of, producing from the same pool. 7. The Susan Dionne No. 8 will access gas reserves that are not accessible to other wells because Beluga and Tyonek sandstone reservoirs are lenticular and discontinuous. Wells producing from the SD Beluga Undefined and the SD Tyonek Undefined Gas Pools in this area drain areas less than 180 acres in size. 8. On October 23, 2013, Hilcorp sent the application for exception by certified mail to all affected owners, landowners, and operators—i.e., State of Alaska, Cook Inlet Region, Inc., and 16 private persons. Hilcorp provided addresses and Certified Mail Receipts to the AOGCC as proof that the application was mailed to all affected owners, landowners, and operators. 9. The AOGCC received no comments, objections, or protests in response to the public notice regarding the proposed Susan Dionne No. 8 well or to the notification sent by Hilcorp to all affected owners, landowners, and operators within 3,000' of Susan Dionne No. 8. CONCLUSIONS: Conservation Order 683 • • January 14, 2014 Page 3 of 3 1. Susan Dionne No. 8 will recover reserves that are not accessible to existing development gas wells. 2. Statewide regulations 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) govern spacing for the Susan Dionne No. 8. 3. The AOGCC considers Hilcorp's October 25, 2013 and November 21, 2013 letters to be an application for an exception to spacing provisions filed pursuant to 20 AAC 25.055(d). 4. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) is necessary to allow testing, completion, and production of the Susan Dionne No 8 development gas well. 5. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) for the Susan Dionne No. 8 development gas well is consistent with sound engineering and geoscience principles and will not result in waste or jeopardize correlative rights of adjoining or nearby owners. NOW THEREFORE IT IS ORDERED: Hilcorp's application for an order granting an exception to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) to allow testing, completion, and production of the Susan Dionne No. 8 development gas well within the Ninilchik, Susan Dionne Beluga Undefined Gas Pool and Susan Dionne Tyonek Undefined Gas Pool is hereby approved as long as Hilcorp complies with the terms of all lease agreements, applicable Alaska laws, and all other legal requirements. Seamount, Jr. Chair, Commissioner Commissioner RECONSIDERATION AND APPEAL NOTICE As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the AOGCC grants for good cause shown, a person affected by it may file with the AOGCC an application for reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10-days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. Having retired from the permitting and public involvement field, I was surprised to see that AOGCC didn't notify nearby landowners of public meetings. While I realize that noise issues are in the scope of the AOGCC, I feel it would have been an opportunity to address this noise issue earlier in the process. As for a resident on the Kenai Peninsula, I don't read the ADN or the Journal of Commerce on a regular basis. It is my feeling that the applicant could provide notification of the public meeting in their mailing, or they could provide AOGCC with a list of property owners to be added to AOGCC's mailing list. Generally speaking, publication in a newspaper of general circulation such as the Anchorage Daily News or the Alaska Journal of Commerce is deemed notice to the public. However, as a result of the concerns you express, the Commission will undertake a review of its notice requirements to see if those requirements should be amended. With regard to the specifics of your concerns (i.e., the noise issues), when the AOGCC makes a determination as to whether to grant or deny a spacing exception, the commission has not historically considered noise issues as a basis for its grant or denial of a spacing exception. More simply put, a request for a well spacing exception typically encompasses issues of petroleum geology and petroleum engineering. Please feel free to contact me if you have additional questions. As an adjacent landowner within 1500', 1 received notice of the drilling in May 2013. 1 have been in discussion with Hilcorp regarding some noise issues from the site. At this time, Hilcorp has indicated they are trying to address the issue. In reviewing AOGCC files regarding this site, I read the following in AOGCC's decision: A public hearing was scheduled for July 16, 2013. On May 30, 2013, the AOGCC mailed copies of the Notice of Public Hearing to all persons on the AOGCC's mailing distribution list, published notice of that hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, and electronically transmitted the notice to all persons on the AOGCC's email distribution list. On June 9, 2013, the notice was published in the ALASKA JOURNAL OF COMMERCE. As an adjacent landowner I did not receive any information regarding a public hearing. I have attached a copy of the mailing which I received from Hilcorp. I did not receive anything from AOGCC. Shouldn't the adjacent landowners be on AOGCC's mailing list? If we had been informed that we had an opportunity to comment we may have been able to avoid the current noise issues that we have with the site. I would like to say that • Hilcorp has been responsive to our concerns so far and I hope that this continues in the future. I would appreciate your looking into this matter of not informing the adjacent landowners of an opportunity to comment on the proposed action. The AOGCC approved said application on April 25, 2013. On June 18, 2013, Hilcorp proposed minor changes to the drilling program. These modifications were approved on June 28, 2013. The drilling of SD-8 commenced on in July 2013 with the Saxon 147 drill rig. After reaching a total depth of 12,130 and completion of open -hole wireline logging in early September, the AOGCC granted approval for short term drill stem tests of proposed exploratory oil zones. These tests proved unsuccessful. Hilcorp now proposes to test and complete SD-8 as a developmental gas well from the Undefined Tyonek and Beluga Pools. The location of the well is as follows: • Surface: 243' FNL, 2629 FEL, Section 6, . The SD-8 well design includes dual string with packer isolation to segregate Undefined Tyonek Pool from the Undefined Beluga Pool. This design is warranted to develop gas appropriately with respect to reservoir pressure differences because it precludes cross flow and down -hole commingling issues. Moreover, this design allows for appropriate allocation and reporting of production from each respective pool. To date, no special Pool Rules have been established within the Ninilchik Unit, and all gas produced been reported as either "SD Tyonek Undefined" (Field Pool Code 562560) or "SD Beluga Undefined" (Field Pool Code 562550). Therefore, statewide spacing regulations are controlling. In relevant part, 20 AAC 25.055(a) provides: C: 0 Ninilchik Unit SD-8 Spacing exception Application October 22, 2013 Page 2 of 9 (2) for a well drilling for gas, a wellbore may be open to test or regular production within 1,500 feet of a property line only if the owner is the same and the landowner is the same on both sides of the line. (4) if gas has been discovered, the drilling unit for the pool is a governmental section; not more than one well may be drilled to and completed in that pool on any governmental section; a well may not be drilled or completed closer than 3,000 feet to any well drilling to or capable of producing from the same pool. The location of SD-8 and its relationship to adjoining properties and wells is depicted in Exhibit Al and A2. As demonstrated by Exhibit Al (Tyonek 140): • Hilcorp is the only owner and operator within the affected area. • The affected "landowners" within 1500' of the proposed Tyonek perforations include Ninilchik Unit Tract Nos. 10, 30, and 145.2 All such tracts are contained within the Susan Dionne -Paxton Participating area (applicable only to the Undefined Tyonek Pool). None are segmented with respect to depth. • The distance to the nearest point where landownership changes is —710' from the proposed Tyonek 140 Top of Productive Horizon. • There are no other wells open to the Undefined Tyonek Pool within Section 7, Township 1 South, Range 13 West, Seward Meridian, Alaska. See Exhibit B (Confidential). • There are no other wells capable of producing from the Undefined Tyonek Pool within 3000' of the proposed SD-8 Tyonek 140 perforations. See Exhibit B (Confidential). As demonstrated by Exhibit A2 (Beluga 135): • I filcorp is the only owner and operator within the affected area. The affected "landowners" within 1500' of the proposed Beluga perforations include Ninilchik Unit "tract Nos. 10, 30, 145 and 146. All tracts are contained within, but vertically above the Susan Dionne -Paxton Participating area (not applicable to the Undefined Beluga Pool). None are segmented with respect to depth. ' Per AS 31.05.170(10), "owner" means the person who has the right to drill into and produce from a pool and to appropriate the oil and gas the person produces from a pool for that person and others. 2 Per AS 31.05.170(7) "landowner" means the owner of the subsurface estate of the tract affected. • • Ninilchik Unit SD-8 Spacing exception Application October 22, 2013 Page 3 of 9 • The distance to the nearest point where landownership changes is —55' from the proposed Tyonek 140 Top of Productive Horizon. • Other wells capable of producing from the Undefined Beluga Pool within Section 6, Township 1 South, Range 13 West, Seward Meridian, Alaska include SD-1, SD-2A (proposed), and SD-4. Other wells capable of producing within 3000' of the proposed SD-8 Beluga 135 perforation include: SD-5 (located 2816' to the south) and SD-6 (located 2898' to the west). See Exhibit B (Confidential). Based on confidential geological and engineering data available to Hilcorp, it is apparent that the Tyonek and Beluga formations arc particularly discontinuous and unpredictable, that they drain small areas (the majority of sands drain less than 180 acres or—1,575' radius), and the proposed development of SD-8 is necessary to maximize recovery of gas from the Undefined Tyonek and Beluga Pools.3 Hilcorp owns a 100% working interest in the Ninilchik Unit and is the only operator within the affected area. At the date of this mailing, a copy of this application was sent by certified mail to the all affected owners, landowners and operators. Also enclosed is an affidavit stating the undersigned is acquainted with the facts and verifying that all facts asserted herein are true. If the proposed well completions are both successful Hilcorp anticipates expanding the existing Susan Dionne Paxton Participating Area and submitting proposed Pool Rules to formally define both the Tyonek and Beluga formations. As demonstrated above, the correlative rights of all affected owners, landowners and operators will be protected by the proposed spacing exception order. The AOGCC approved said application on April 25, 2013. On June 18, 2013, Hilcorp proposed minor changes to the drilling program. These modifications were approved on June 28, 2013. The drilling of SD-8 commenced on in July 2013 with the Saxon 147 drill rig. After reaching a total depth of 12,130 and completion of open -hole wireline logging in early September, the AOGCC granted approval for short term drill stem tests of proposed exploratory oil zones. These tests proved unsuccessful. Hilcorp now proposes to test and complete SD-8 as a developmental gas well from the Undefined Tyonek and Beluga Pools. The location of the well is as follows: Surface: 243' FNL, 2629 FEL, Section 6, TIN, R12W, SM, AK. • Top of Productive Horizon: o Tyonek: 242' FNL, 1548' FWL, Section 7, TIN, R12W, SM, AK. o Beluga: 135' FSL, 2105' FEL, Section 6, TIN, R12W, SM, AK. • Total Depth: 792' FNL, 2051' FWL, Section 7, TIN, R12W, SM, AK. The SD-8 well design includes dual string with packer isolation to segregate Undefined Tyonek Pool from the Undefined Beluga Pool. This design is warranted to develop gas appropriately with respect to reservoir pressure differences because it precludes cross flow and down -hole commingling issues. Moreover, this design allows for appropriate allocation and reporting of production from each respective pool. To date, no special Pool Rules have been established within the Ninilchik Unit, and all gas produced been reported as either "SD Tyonek Undefined" (Field Pool Code 562560) or "SD Beluga Undefined" (Field Pool Code 562550). Therefore, statewide spacing regulations are controlling. In relevant part, 20 AAC 25.055(a) provides: Ninilchik Unit SD-8 Spacing exception Application October 22, 2013 Page 2 of 9 (2) for a well drilling for gas, a wellbore may be open to test or regular production within 1,500 feet of a property line only if the owner is the same and the landowner is the same on both sides of the line. (4) if gas has been discovered, the drilling unit for the pool is a governmental section; not more than one well may be drilled to and completed in that pool on any governmental section; a well may not be drilled or completed closer than 3,000 feet to any well drilling to or capable of producing from the same pool. The location of SD-8 and its relationship to adjoining properties and wells is depicted in Exhibit Al and A2. As demonstrated by Exhibit Al (Tyonek 140): • Hilcorp is the only owner and operator within the affected area.1 • The affected "landowners" within 1500' of the proposed Tyonek perforations include Ninilchik Unit Tract Nos. 10, 30, and 145.2 All such tracts are contained within the Susan Dionne -Paxton Participating area (applicable only to the Undefined Tyonek Pool). None are segmented with respect to depth. • The distance to the nearest point where landownership changes is —710' from the proposed Tyonek 140 Top of Productive Horizon. • There are no other wells open to the Undefined Tyonek Pool within Section 7, Township 1 South, Range 13 West, Seward Meridian, Alaska. See Exhibit B (Confidential). • There are no other wells capable of producing from the Undefined Tyonek Pool within 3000' of the proposed SD-8 Tyonek 140 perforations. See Exhibit B (Confidential). Other wells capable of producing within 3000' of the proposed SD-8 Beluga 135 perforation include: SD-5 (located 2816' to the south) and SD-6 (located 2898' to the west). See Exhibit B (Confidential). Based on confidential geological and engineering data available to Hilcorp, it is apparent that the Tyonek and Beluga formations are particularly discontinuous and unpredictable, that they drain small areas (the majority of sands drain less than 180 acres or —1,575' radius), and the proposed development of SD-8 is necessary to maximize recovery of gas from the Undefined Tyonek and Beluga Pools.3 Hilcorp owns a 100% working interest in the Ninilchik Unit and is the only operator within the affected area. At the date of this mailing, a copy of this application was sent by certified mail to the all affected owners, landowners and operators. Also enclosed is an affidavit stating the undersigned is acquainted with the facts and verifying that all facts asserted herein are true.
