Hilcorp Alaska, LLC (Hilcorp), by letter received March 4, 2014, requested the Alaska Oil and Gas Conservation Commission (AOGCC) issue an order allowing testing, completion, and regular production of exploratory gas well Frances No. 1 within 1500' of a property line where the owner and landowner are not the same on both sides of the line and within the same governmental section as, and within 3000' of, another well that is, or may be capable of, producing from the same pool. 2. Pursuant to 20 AAC 25.540, the AOGCC tentatively scheduled a public hearing for February 25, 2014. On March 11, 2014, the AOGCC published notice of the opportunity for that public hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, and the AOGCC electronically transmitted the notice to all persons on the AOGCC's email distribution list. On March 11, 2014, the AOGCC mailed printed copies of the Notice of Public Hearing to all persons on the AOGCC's mailing distribution list. On March 12, 2014, the notice was published in the ANCHORAGE DAILY NEWS. On March 25, 2014, the AOGCC mailed printed copies of the Notice of Public Hearing to all persons on the Certified Mailing List provided in Hilcorp's letter received March 4, 2014. 3. Pursuant to 20 AAC 25.055(d)(1), Hilcorp sent by certified mail notice of the application to all owners, landowners, and operators of all properties within a 3000-foot radius of the proposed Frances No. 1 well. Hilcorp provided the AOGCC with a copy of the notice, date of mailing, Certified Mail Receipts, and addresses to which the notice was sent. 4. No protest to the application or request for hearing was received. Conservation Order 690 • May 12, 2014 Page 2 of 3 5. Because Hilcorp provided sufficient information upon which to make an informed decision, the request could be resolved without a hearing. 6. On April 17, 2014, the tentatively scheduled public hearing was vacated. FINDINGS: 1. Hilcorp is the owner and operator of the Ninilchik Field, the Ninilchik Unit, and the proposed Frances No. 1 onshore exploratory gas well, which are located in the Kenai Peninsula Borough, Alaska. 2. Frances No. 1 has a surface location 243' from the north line and 2629' from the east line of Section 7, TIN, R12W, Seward Meridian (S.M.) and a bottom -hole location 651' from the north line and 1993' from the west line of Section 7, TIN, R12W, S.M. 3. Frances No. 1 lies within privately held property. 4. Frances No. 1 was drilled as an exploratory oil well during 2013, but subsequent testing proved the oil reservoir to be non-commercial.' Hilcorp's application requests approval to test, complete and produce Frances No. 1 as an exploratory gas well in reservoir sandstone beds within the Falls Creek Beluga Undefined Gas Pool and the Falls Creek Tyonek Undefined Gas Pool (FC Beluga and Tyonek Undefined Gas Pools). A spacing exception is required because Frances No. 1 will open these gas pools within 1500' of a property line where the owner and landowner are not the same on both sides of the line and within the same governmental section as, and within 3000' of, another well that is, or may be capable of, producing from the same pool. 5. Frances No. 1 will access gas reserves that are not accessible to other wells because the fluvial sandstone reservoirs within the FC Beluga and Tyonek Undefined Gas Pools are discontinuous. Hilcorp reports the majority of existing wells in the Falls Creek area that produce from fluvial sandstone reservoirs drain fewer than 155 acres.2 6. On March 4, 2014, Hilcorp sent the application for exception by certified mail to all affected owners, landowners, and operators—i.e., 54 private persons. Hilcorp provided addresses and Certified Mail Receipts to the AOGCC as proof that the application was mailed to all affected owners, landowners, and operators. Copies of the Notice of Public Hearing that Hilcorp mailed to four of the private persons were not deliverable and were returned to Hilcorp. Copies of the Notice of Public Hearing that the AOGCC mailed to five of the private persons were not deliverable and were returned to the AOGCC. On March 25, April 8, and April 23, 2014, Hilcorp provided the AOGCC with additional information indicating that Hilcorp has the proper mailing address or has made a good - faith effort to obtain the proper mailing address for each of these persons. 7. The AOGCC received no comments, objections, or protests in response to the public notice regarding the proposed Frances No. 1 well or to the notifications sent by Hilcorp and the AOGCC to all affected owners, landowners, and operators within 3000' of Frances No. 1. Statewide regulations 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) govern spacing for Hilcorp's Frances No. 1 well. 3. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) for Hilcorp's Frances No. 1 well is consistent with sound engineering and geoscience principles and will not result in waste or jeopardize correlative rights of adjoining or nearby owners. NOW THEREFORE IT IS ORDERED: Hilcorp's application for an order granting an exception to the well spacing provisions of 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) to allow testing, completion, and regular production of Hilcorp's Frances No. 1 exploratory gas well within the FC Beluga and Tyonek Undefined Gas Pools is hereby approved as long as Hilcorp complies with the terms of all lease agreements, Alaska law, and all other legal requirements. Seamount, Jr. Chair, Commissioner Commissioner RECONSIDERATION AND APPEAL NOTICE As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the AOGCC grants for good cause shown, a person affected by it may file with the AOGCC an application for reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10-days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rasher, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. The AOGCC approved Hilcorp's request on September 13, 2013. On October 1, 2013, Hilcorp requested a slight modification to the well's proposed surface location. AOGCC approved this request on October 4, 2013. By mid -November 2013, Hilcorp successfully drilled to 12,871' MD / 12,799' TVD. On November 26, 2013, Hilcorp requested authorization to plug -back and sidetrack the wellbore under a revised directional program. AOGCC approved this application, with conditions, on December 3, 2013. By mid -December 2013, the exploratory sidetrack reached to total vertical depth of 12,920.' On February 10, 2014, Hilcorp submitted an application to AOGCC to complete and test Frances #1 as an exploratory oil well. AOGCC approved this application, as revised, on February 12, 2014. Subsequent testing proved the oil reservoir to be non-commercial. Hilcorp now requests approval to test and complete Frances #1 as an exploratory gas well targeting production from the Ninilchik Unit's Undefined Beluga and Tyonek Gas Pools. To date, no special Pool Rules have been established within the Ninilchik Unit. Therefore, statewide spacing regulation 20 AAC 25.055(a) is controlling. In relevant part, subsections (a)(2) and (a)(4) provide: (a)(2) For a well drilling for gas, a wellbore may be open to test or regular production within 1,500 feet of a property line only if the owner is the same and the landowner is the same on both sides of the line. (a)(4) If gas has been discovered, the drilling unit for the pool is a governmental section; not more than one well may be drilled to and completed in that pool on any governmental section; a well may not be Ninilchik Unit • 0 Frances #1 Spacing Exception March 4, 2014 Page 2 of 11 drilled or completed closer than 3,000 feet to any well drilling to or capable of producing from the same pool. The location of Frances #1 and its relationship to adjoining properties and wells is depicted in Exhibit A. A confidential plat and well data is provided as Exhibit B. Based on confidential geological and engineering data available to Hilcorp, it is apparent that both the Undefined Tyonek and Beluga Pools are particularly discontinuous and unpredictable, and that they drain small areas. The existing wells in the Falls Creek area indicate that the majority of the fluvial sandstone reservoirs drain less than 155 acres or —1,466-ft radius. The Frances #1 well indicates several gas reservoirs cannot be produced from within the existing boundary of the Falls Creek Participating Area ("PA"), nor are they present in the recently drilled, as yet not completed, Falls Creek 5 well.' In order to prevent waste and maximize gas recovery from the Undefined Tyonek and Beluga Pools, we therefore request spacing exception. During the adjudication of this spacing exception application, Hilcorp specifically requests AOGCC to authorize a short duration test of gas bearing Tyonek sands in the Frances #1 wellbore. This production test will be held for one week (7 days) or for a maximum total of 70 MMcf with gas sent to flare. Given the significant investment required -to development exploratory gas reserves, the results of this short duration test will justify and validate the installation of gas conditioning facilities on the Bartolowits pad, including the cost of boring a pipeline under the Sterling Highway and hot tapping same to the Kenai-Katchemak Pipeline ("KKPL"). The proposed test will also aid in the design and procurement of properly sized gas facilities, and thus advance the construction and permitting timeline required to bring Frances #1 production into the pipeline system prior to the 2014/2015 winter season. Hilcorp, as sole unit operator (and 100% working interest owner) will account for all testing and production of Frances #1 as required by the Ninilchik Unit Agreement, including establishment of accounts for all affected properties currently outside the Ninilchik Unit and Falls Creek PA boundary. As a result, the correlative rights of all affected owners, landowners and operators will be protected by approval of the requested short duration test and spacing exception.
