By a letter received August 20, 2012, NordAq Energy, Inc. (NordAq) requests the Alaska Oil and Gas Conservation Commission (AOGCC) issue an order for an exception to the spacing requirements of 20 AAC 25.055(a)(2) to test and produce the Shadura Appraisal Well exploratory gas well within 1,500 feet of a property line where ownership or landownership changes. 2. On August 17, 2012, by certified mail, NordAq sent notice of the application to all owners, landowners, and operators of all properties within 3,000 feet of the planned Shadura Appraisal Well well. NordAq provided the AOGCC the notice, date of mailing, addresses to which the notice was sent, and proof of certified mailing. 3. Pursuant to 20 AAC 25.540, the AOGCC tentatively scheduled a public hearing for September 26, 2012. On September 6, 2012, the AOGCC mailed printed copies of the notice of the opportunity for public hearing to all persons on the AOGCC's mailing distribution list, published notice of the opportunity for that hearing on the State of Alaska's Online Public Notice website and on the AOGCC's website, and electronically transmitted the notice to all persons on the AOGCC' s email distribution list. On September 16, 2012, the notice was published in the ALASKA JOURNAL OF COMMERCE. 4. No protest to the application or request for hearing was received. 5. The tentatively scheduled public hearing was vacated on October 17, 2012. 6. Because NordAq provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. Order 665 • • November 29, 2012 Page 2 of 3 FINDINGS: 1. NordAq is the operator of the planned Shadura Appraisal Well exploratory gas well, which is located on the east side of Cook Inlet Basin within the Kenai Peninsula Borough, Alaska. 2. The Shadura Appraisal Well will be an onshore, deviated exploratory gas well with a surface location 130' from the south line and 868' from the west line of Section 11, TO8N, R1OW, Seward Meridian (S.M.). The projected bottom -hole location is 4,235' from the north line and 356' from the west line of Section 13, TO8N, R1OW, S.M. The surface location will be sited in State of Alaska lease ADL- 391596. The bottom hole location will lie within the boundaries of the Kenai National Wildlife Refuge, on lands where the subsurface estate is owned by Cook Inlet Region Inc. 3. Potentially affected owners, landowners, and operators —those within a 3,000 -foot radius of the well —are the State of Alaska, NordAq, and Cook Inlet Region, Inc. The Kenai National Wildlife Refuge is managed by the U.S. Fish and Wildlife Service, Alaska Regional Office. NordAq sent notice of its application to these entities by certified mail on August 17, 2012. 4. The Shadura Appraisal Well will be the only well within Sections 11, 13 and 14, TO8N, R1OW, S.M. The nearest well, Shadura No. 1, is located more than 5,000 feet to the south of the Shadura Appraisal Well. 5. The reservoir sands accessed by Shadura Appraisal Well are discontinuous fluvial sands. 6. The AOGCC received no comments, objections or protests in response to the public notice regarding Shadura Appraisal Well or to the notification sent by NordAq to all known owners, landowners and operators within 3,000 feet of Shadura Appraisal Well. CONCLUSIONS: 1. An exception to the well spacing provisions of 20 AAC 25.055(a)(2) is necessary to allow testing and production of the Shadura Appraisal Well in gas reservoirs in order to maximize recovery of reserves. 2. Shadura Appraisal Well will recover reserves that are not accessible to other existing wells. 3. A spacing exception to allow drilling and completion of Shadura Appraisal Well is consistent with sound engineering and geoscience principles and will not result in waste or jeopardize correlative rights of adjoining or nearby owners. 4. An exception to the requirements of 20 AAC 25.055(a)(2) will not promote waste or jeopardize correlative rights. NOW THEREFORE IT IS ORDERED: NordAq's August 20, 2012 application for an order granting an exception to the well spacing provisions of 20 AAC 25.055(a)(2) to allow drilling and completion of the Shadura Appraisal Well exploratory gas well is hereby approved. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10 -days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "(t]he questions reviewed on appeal are limited to the questions presented to the AOGCC by the application for reconsideration." On August 20th, the AOGCC received an application for spacing exception for this well. Based on that application, the AOGCC tentatively scheduled a public hearing for October 23rd, and we published a notice for that hearing on September 16th. Because the AOGCC did not receive any request for hearing, comments or protests, the public hearing was vacated on October 17, 2012. On October 31st, as I began to write the draft text for the spacing exception order, I noticed that the AOGCC had not received proof of mailing for the August 20 application. I emailed a request for this information to Steve Hennigan, then finished the draft text for the order and sent it to our legal group for review. That order is currently being finalized. Yesterday, Cynthia phoned to discuss the exception and mentioned that NordAq had resubmitted the spacing exception application. Her email, below, indicates that this application was resubmitted sometime on or shortly after November 12th. The AOGCC's workflow for processing of all applications is very rigid: upon receipt each application is date - stamped by our receptionist, then immediately given to our Special Assistant who Togs the application into the AOGCC's docket system, makes copies of it, creates a permanent file folder, places the original application in that folder, and then distributes the copies of the application to senior staff for processing and action. I have searched thoroughly, but cannot find this resubmitted application or any evidence that it was received by the AOGCC. If NordAq has revised the spacing exception application for the Shadura Appraisal Well, please resubmit is as soon as you can. Resubmitting the application will restart the public notice, 30 -day public comment period, and tentative hearing process, which will take approximately 6 to 8 weeks. If the spacing exception application has not been revised, please provide proof of certified mailing for the August 20 ' application, and we will complete the order that is currently being finalized. I can confirm that the November exception resubmission is an exact duplicate of what was submitted earlier in the year and to which the AOGCC went out to public notice with. As there is no new information within the November 12 submission, any guidance on how NordAq should address this duplicate that is now before the Commission would be greatly appreciated.
