IT APPEARING THAT:
ARCO Alaska, Inc. (AAI) by letter dated January 19, 1999, requested an exception to the
well spacing provisions of 20 AAC 25.055(a)(1). The exception would allow drilling the
Fiord #4 and Fiord #5 exploratory oil wells to undefined pools within 500' of a governmental
quarter section line.
2. The Commission published notice of opportunity for public hearing in the Anchorage Daily
News on January 27, 1999 pursuant to 20 AAC 25.540.
3. No protests to the application were received.
FINDINGS:
The Fiord #4 will be drilled as a directional well from a surface location of 250' from the
south line (FSL), 250' from the west line (FWL) of Section 22, T13N, R5E, Umiat Meridian
(UM) to a bottomhole location 565' FSL, 1030' FWL of Section 22, T13N, R5E, UM.

The Fiord #5 will be drilled as a directional well from a surface location of 375' from the
north line (FNL), 812' from the east line (FEL) of Section 32, T13N, R5E, Umiat Meridian
(UM) to a bottomhole location 205' FNL, 200' FEL of Section 32, T13N, R5E, UM.
3. Offset owners Anadarko Petroleum Corportion and Union Texas Alaska, LLC and offset
landowner the State of Alaska, Department of Natural Resources, have been duly notified.
4. An exception to the well spacing provisions of 20 AAC 25.055(a)(1) is necessary to allow
the drilling of these wells.
CONCLUSION:
Granting spacing exceptions to allow drilling of the Fiord #4 and Fiord #5 exploratory oil wells
will not result in waste nor jeopardize correlative rights.

AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file
with the Commission an application for rehearing. A request for rehearing must be received by 4:30 PM on the 23rd day
fbllowing the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall grant or
refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within
the 1 O-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise
distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court.
Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs
'from the date on which the request is deemed denied (i.e., l0th day after the application 'for rehearing was filed).

ARCO Alaska, Inc. (AAI) by letters dated January 19, 1999, has requested an
exception to the provisions of 20 AAC 25.055(a)(1) for the drilling of two directional
exploratory oil wells to undefined pools in the Colville River Unit.
The exception would allow AAI to drill the Fiord #4 and Fiord #5 wells within
500' of a governmental quarter section line. The Fiord #4 will be drilled from a surface
location 250' from the south line (FSL), 250' from the west line (FWL), Section 22,
T13N, R5E, Umiat Meridian (UM) to a bottomhole location 565' FSL, 1030' FWL,
Section 22, T13N, R5E, UM.
The Fiord #5 will be drilled from a surface location 375' from the north line
(FNL), 812' from the east line (FEL), Section 32, T13N, R5E, Umiat Meridian (UM) to a
bottomhole location 205' FNL, 200' FEL, Section 32, T13N, R5E, UM.
A person who may be harmed if the requested order is issued may file a written
protest prior to 4:00 PM, February 11, 1999 with the Alaska Oil and Gas Conservation
Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and request a hearing on
this matter. If the protest is timely filed and raises a substantial and material issue crucial
to the to the Commission's determinatiOn, a hearing on the matter will be held at the
above address at 9:00 AM on February 26, 1999, in conformance with 20 AAC 25.540.
If no protest is filed, the Commission will consider the issuance of the order without a
hearing.

1. My name is James R. Winegarner. I am over 19 years old and have personal
knowledge of the matters set forth herein.
2. I am a District Landman for the well operator, ARCO Alaska, Inc. ("ARCO").
3. I am acquainted with the facts associated with the drilling of Fiord #4.
4. I have reviewed the application submitted for the exception to 20 AAC 25.055.
To the best of my knowledge and belief all facts therein are true and accurate.
5. I have reviewed the plats attached as Exhibit "1" and it correctly portrays
pertinent and required data.
6. Pursuant to 20 AAC 25.055 (b), ARCO, the well operator, prepared a Notice of
Request for Exception to the Provision of 20 AAC 25.055. A copy of this notice is attached
hereto.
7. On January 19, 1999, pursuant to 20 AAC 25.055 (b), ARCO sent a copy of
said notice by certified mail to the last known address of all owners and operators of
governmental quarter sections directly and diagonally offsetting the governmental quarter section
of the proposed location of ARCO's Fiord #4. These names and addresses are set forth on
Exhibit 2 attached to ARCO's Request for Exception to Provisions of 20 AAC 25.055 dated
January 19, 1999.

James R. Winegarner, being first duly sworn, upon oath, deposes and states as follows:
1. My name is James R. Winegarner. I am over 19 years old and have personal
knowledge of the matters set forth herein.
2. I am a District Landman for the well operator, ARCO Alaska, Inc. ("ARCO").
3. I am acquainted with the facts associated with the drilling of Fiord #5.
4. I have reviewed the application submitted for the exception to 20 AAC 25.055.
To the best of my knowledge and belief all facts therein are true and accurate.
5. I have reviewed the plats attached as Exhibit "1" and it correctly portrays
pertinent and required data.
6. Pursuant to 20 AAC 25.055 (b), ARCO, the well operator, prepared a Notice of
Request for Exception to the Provision of 20 AAC 25.055. A copy of this notice is attached
hereto.
7. On January 19, 1999, pursuant to 20 AAC 25.055 (b), ARCO sent a copy of
said notice by certified mail to the last known address of all owners and operators of
governmental quarter sections directly and diagonally offsetting the governmental quarter section
of the proposed location of ARCO's Fiord #5. These names and addresses are set forth on
Exhibit 2 attached to ARCO's Request for Exception to Provisions of 20 AAC 25.055 dated
January 19, 1999.

Pursuant to the provisions of 20 AAC 25.055 (b), ARCO Alaska Inc. hereby gives notice of a request
sent to the Alaska Oil and Gas Conservation Commission ("AOGCC") for an exception to the well
spacing requirements of 20 AAC 25.055 for the drilling of the Fiord #5 well. ARCO's request, if
approved, will permit the drilling of the Fiord #5 well as a directional well to within 500' of the
following locations:
Surface Location: 375' FNL, 812' FEL, T13N, RSE, Sec. 32, UM
Target Location: 205' FNL, 200' FEL, T13N, RSE, Sec. 32, UM
Bottomhole Location: 205' FNL, 200' FEL, T13N, RSE, Sec. 32, UM
The Well is located on ADL-364471 (Colville River Unit Tract #3). The working interest of said
lease is owned by ARCO (56%), Union Texas Alaska, LLC (22%), and Anadarko Petroleum
Corporation (22%).
