The closure applications provided the required information describing the history of the reserve pit(s), the present condition of the reserve pits(s), results of any required water sampling and an assessment of the potential risks posed by the drilling waste to human health and the environment. ADEC coordinated field inspections and review of the closure plans with the appropriate land managers. ADEC has determined that the backfilled reserve pits at these sites do not present a material or probable risk to the public health or the environment. Public notice requesting comments on the closure requests was published February 21 and 22, 2002 in the Anchorage Daily News and posted on the state web site February 21, 2002. No public comments objecting to closure approval were received in response to this public notice. ADEC has determined that the reserve pits at these sites meet the closure requirements of 18 AAC 60.440. Closure fOr the pad as a whole (if required) must be coordinated between the owner/operator and the appropriate land owner/manager. Any person who disagrees with any portion of this decision may request an adjudicatory hearing in accordance with 18 AAC 15.200-310. If a hearing is not requested within thirty (30) days of the date of this letter, the right of appeal is waived. I further requested any and all other materials regarding development of the Point McIntyre Oil Field and the Gywder Bay unit, including without limitation all tests performed such as geophysical, chemical and paleontological tests, all maps, memoranda from all sources, information or knowledge concerning untapped formation such as, but not .limited to, the Sadlerochit and Lisburne formations. My clients sought all information accumulated from the inception of exploration on the North Slope concerning Point McIntyre Field whether complete or not, whether formal or informal. It is my understanding from correspondence from you that the Commission takes the position that all these materials are confidential under A.S. 31.05.035. O. Box 1601 Fairbanks, AK 99707 Dear Mr. Lowery: This letter is sent to follow-up our September 30 phone conversation. During that call we briefly discussed the drilling mud which is on the tundra close to the drilling reserve pit at Point McIntyre. The mud was detected on September 25, 1982 when visited by ARCO and AOGCC employees as part of the pad inspection to determine if it was adequately cleaned to meet abandonment status. At this time I've received various and conflicting descriptions of the amount of mud and the aerial extent of tundra impact. To be on the safe side, I assume the AOGCC estimate of 1800 BBLS is the correct amount and the enclosed map describes the area affected. I believe the primary reason for conflicting descriptions is the presence of snow on the site. An accurate description of the area impacted will have to wait until next Spring. Because the mud does not cOntain hydrocarbons, based on laboratory analysis of a grab sample taken on September 25, our primary response will be to stabilize/vegetate the affected area. At this point the vegetation plan is outlined as follows: October 198 2 ae Collect representative mud samples from the area, conduct soils analysis and establish best seed or seed/fertilizer mixture for vegetation. Be If the seed is available and snow cover permits we will attempt to sow a "native" plant seed this fall. If it's not possible, we will commence seeding in early spring 1983. We have requested that Bill Mitchell, Agricultural Experiment Station, Palmer, provide the seed and recommend the fertilizer, if necessary. Spring 1983 A. If seeding was possible in '82, check sprouting status. I believe the above schedule is reasonable and hope that a modification of this vegetation plan will not be necessary. However, you indicated that you desire to discuss this vegetation concept with other members of NRO and possibly other State employees. McIntyre 1 and 2. Upon arrival at the site, I observed that the overall condition of the drill pad was excellent; however, there were two discrepancies. The secondary pit in photo #1 needs to be filled and the drilling mud to the north side of the pad needs to be removed. There is approximately 10,000 sq. ft. of drilling mud in the area. A triangle of approximately 100' x 200' at a one foot depth would be about 1800 bbls (see attached photos 2 through 5). I filled out the A.O.G.C.C. surface abandonmnt report which is attached. Box 1392 B~kersfield, California 9 3302 Gentlemen: The Department of the Interior and the State of Alaska are progressing on schedule with preparation for the Joint Federal/State Beaufort Sea lease sale %~4qich is planned for Dec~ 1979. We are hopeful that several problems which have arisen will be solved so that the sale can proceed as scheduled. A major problem relates to the joint tract evaluation effort which is presently underway. The State of Alaska has access to confidential ~11 data from several key wells (see attached list) adjacent to the sale area. These key well data are not presently available to the Conservation Division of the U. S. Geological Survey. The professional staffs of the Alaska Department of Natural Resources and the U. S. Geological Survey are working together in preparing the required' pre-sale evaluation of leasing units to be offered in the Beaufort Sea sale. It is of critical importance that the State and the Department of the Interior concur in the evaluation of the disputed acreage. The b~orandum of Understanding (~DU) entered into by Governor Hanr~nd and Secretary Andrus re?~res the rejection of bids on disputed tracts unless the State and Federal tract evaluation groups reach agreements with regard to bid acceptance/rejection criteria for the disputed tracts. We have a copy of the MDU which sets forth the requirement in Section K, Bid Acceptance/ Rejection. Unless the U. S. Geological Survey and the Department of Natural Resources share a comnon data base, it is very unlikely that the State and Federal professional staffs will be able to reach agreement with regard to the evaluation of disputed acreage. If the two groups are forced to work separately, with different data bases and, as a result, reach differing de{erminations of tract values, bids on the disputed tracts will necessarily be _rejected. (2) As a matter of law, the U. S. Geological Survey must establish the fa{r market value and the Federal Government must receive fair market value for the leasing of OCS lands. As co-chairmen of the joint evaluation effort, we believe that the only w~y we can achieve the re~Akirements of federal law and meet the terms of the ~DU is to have cc~mon access to all of the relevant well data necessary to evaluate the disputed lands. Although these well data are currently on file with the State of Alaska, we have been advised by the State De~r~t of Law that the State's provisions for confidentiality ~Duld re~3]re your release of the data directly to the U. S. Geological Survey rather than through the State. These data will be held in strict confidence and will not be released to any tkird party. These data will be used solely by tract evaluation personnel responsible for the required evaluation in preparation for the joint Beaufort Sea sale. The U. S. Geological Survey has been assured by counsel that these data can be maintained in the strictest confidence. We are satisfied with the action taken to date by Gulf Oil and Arctic Oilfield Services, Inc. in cleaning up the spill. Our last inspection of the site on September 26, 1978 revealed small quantities of oil still leaching from the pad and surrounding tundra. At that time we rended, and Gulf Oil agree,d to take steps necessary until freeze-up to collect the oil leaching from the pad. Further, it was agreed that the pad' Would. be monitored during and following break-up in the spring of 1979 and necessary clean-up action would be taken. We have no objections to Gulf Oil and Atlantic Richfield Company concluding agreements regarding control of the:~. Mr. NewtOn became aware that Mr. Harold Hawkins of the Division of Oil and Gas Conservation was on the Slope in connection with an inspection of, another company's-drilling operation; and Mr. Newton asked him to examine the site, which he did. On Saturday, July 15, at the sugges- tion of Mr. Newton, I accompanied Mr. Larry Safford, Assistant Operations Manager of Crowley Environmental Services, to the location, and he recommended certain remedial measures which he felt would be'helpful in taking care of the situation· On Monday, July 17, after talking to you, [ phoned Mr. Paul Bateman in the Fairbanks DEC Office, and he re- ferred me to Mr. Janssen, who agreed to consult with Crowley's Mr. Sar- ford on the phone in an effort to 'work out procedures which might be most effective in keeping the seepage'under firm c~t~r~(71~:a~n~E, ~,nl~xpedlt~ng the final-clean-up as much as possible. AOS will proceed tO complete the clean-up of the drill site, working closely with Crowley Environmental's Mr. Safford on the matter of the seepage; when we are convinced that the location is in condition to be inspected 'by representatives of the State, we shall notify you and Mr. Hami I ton. DESCRIPTION OF NATURAL SETTING II. CONSTRUCTION AND OPERATION PLAN A. OPERATING PLAN AND ACCESS The proposed location is 1445' FSL and 589' r=.~ of Sec. 16, TI2N, R14E, U.M., AK (Latitude: 70° 23' 27,098" Longitude: 148° 34' 50.235"). This location is a drilling pad constructed by Atlantic Richfield Company on State Oil and Gas Lease No. ADL -~8297 under L.O. 74-1 9. This location is near the Prudhoe Bay field and its assOCiated roads, airstrips and facilities. ,: The drilling pad was constructed in 1974, allowing more than two years settling and natural compaction. A heli-hoist rig will be air lifted into the location in time to allow summer drilling season operations. (See attached Rig Floor Plan). Upon freeze up the rig. will be trucked out to the current storage point.  Access will be by existing roads through Prudhoe Bay, along the beach and across tundra using Rolligons. Major rig support will ~~ f be by helicopter. B. LOCATION CONSTRUCTION Areas of construction are shown on the attached photo plates. Details of the drilling pad can be provided on request. 1. Drilling Pad - Approximately 200' X 400" to accommodate the drilling rig and camp. Parker Drilling Company Rig No. 128, a heli-hoist rig, has been selected for this proposed oper- ation. The pad is constructed of gravel approximately 5' thick. Timber sills will be utilized to support the rig's substructure. 2. Sumps - Two sumps have been constructed adjoining the pad. These sumps are approximately 250' X 250' and 250' X 30' respectively. A 50' X 50' flare pit has been constructed just beyond the sumps. These pits are constructed with 6' gravel walls leaving undisturbed tundra for bottoms. Any formation cuttings, mud or wash water which contain hydrocarbons will be treated for hydrocarbon removal and transported to an approved land disposal site in the area. 3. Camp Area- The camp will 'be ~,ocated on '-~,,,~ dril~,~c~-'~ pad adjacent to tile rig. Complete details of this equipment can be provided if required. D. WASTE Combustiblewastewill be disposed of by incinerating at the drill site. The incinerator has been inspected by the Alaska Department of Environmental Conservation. Raw sewage will be treated using a waste water treatment plant furnished by Parker Drilling Company. Information reqarding this plant was previously submitted to Alaska Department of Environmental Conservation , who have previously made site operational inspections of this equipment. Detailed description of the equipment can be fur- nished if required. F. FUEL STORAGE Fuel required at the drill site and staging area will be limited to diesel and gasoline. All storage will be in steel tanks and will be contained within a diked storage area. Pumps will be available to transfer fuel from one container to another. Any spilled fuel which becomes contaminated and cannot be used will be picked up and burned in a burn pit located a safe distance from the well bore. (See Section "H"). ,/ G. WELL TESTING Any well test in which hydrocarbon is recovered will be handled through a separator and the.hydwoc2'rbon contained in a steel tank. Free gas will be burned.-at a flare located a safe dis- tance from the well bore, and. water that meets regulatory re- quirements will be disposed.of'in the sump at the well site. H. OIL OR DIESEL OIL SPILLAGE An oil spill contingency plan will be in effect from the begin- ning to the end of this opera$ion and will cover the reporting, containment, cleanup and disposal of any spillage.
