IT APPEARING THAT:
By letter received February 5, 2021, Hilcorp Alaska, LLC, (Hilcorp) requested the Alaska Oil
and Gas Conservation Commission (AOGCC) issue an order for an exception to the spacing
requirements of 20 AAC 25.055(a)(1) and (a)(2) to allow the Whiskey Gulch No. 1 exploratory
well to be drilled, completed, tested, and produced in an undefined oil pool within 500' of a
property line where the owner and the landowner are not the same on both sides of the line,
and to be drilled, completed, tested, and produced in an undefined gas pool within 1,500 feet
of a property line where the owner and the landowner are not the same on both sides of the
line.
2. Pursuant to 20 AAC 25.540, the AOGCC tentatively scheduled a public hearing for March 16,
2021. On February 8, 2021, the AOGCC published notice of the opportunity for that hearing
on the State of Alaska's Online Public Notices website and on the AOGCC's website,
electronically transmitted the notice to all persons on the AOGCC's email distribution list, and
mailed printed copies of the notice to all persons on the AOGCC's mailing distribution list.
On February 10, 2021, the AOGCC published the notice in the Anchorage Daily News.
3. Hilcorp sent, by certified mail, notice of the application to all owners, landowners, and
operators of all properties within 1,000' (Undefined Oil Pool) and 3,000 feet of the proposed
Whiskey Gulch No. 1's anticipated productive interval within the Undefined Gas Pool, and
provided the AOGCC proof of mailing.
4. The only comments received by the AOGCC were from Cook Wet Region, Incorporated
(CIRI), stating it does not object to the spacing exception at this time and did not request a
hearing.
5. The tentatively scheduled public hearing was vacated on March 15, 2021.
6. Hilcorp's application provided sufficient information upon which to make an informed
decision on the spacing exception.

FINDINGS:
1. Hilcorp is the operator for the Whiskey Gulch No. 1 well, located within the Kenai Peninsula
Borough, Alaska (KPB) and is the 100% Working Interest owner of Alaska Department of
Natural Resources (DNR) State Lease Tract 001, ADL 0392666. Mineral landowners for the
properties within 3,000' of Whiskey Gulch No. 1 include:
a. State of Alaska, DNR
b. University of Alaska
c. Estate of Hazel Jeanne Howard
d. Clifford and Cheryl A. Shafer
e. Gary Williams/Margaret A. Parsons (50150)
f. Estate of Edna M. Williams
g. William Grant Hagerty
h. Darcy McBride
i. Terry A. Jones
j. Chris L. Otta/Arleatha Suing (50150)
2. The statewide well spacing provisions of 20 AAC 25.055 govern the Undefined Whiskey
Gulch Pool within the Kenai Unit.
3. The Whiskey Gulch No. 1 Pad is located on privately owned property (KPB Parcel
16508321). The surface location for Whiskey Gulch No. 1, the top of the target producing
interval, and the bottom -hole location will all lie within Alaska State Lease ADL0392666:
Surface Hole Location (SHL): 1374' FSL, 1557' FEL, Sec. 23, T04S, R15W, SM, AK
Top Target Location (TTL): 423' FNL, 337' FWL, Sec. 25, T04S, R15W, SW, AK
Bottom -Hole Location (BHL): 1083' FNL, 1021' FWL, Sec. 25, T04S, R15W, SW, AK
4. This spacing exception is necessary because Whiskey Gulch No. 1 will be: 1) open to test or
regular production of oil in an Undefined Oil Pool within 500 feet of a property line where
the owners or landowners are not the same on both sides of the line;' and 2) open to test or
regular production of gas in the Undefined Gas Pool within 1500 feet of a property line where
the owners or landowners are not the same on both sides of the line. Whiskey Gulch No. 1
will target unproven oil/gas reserves that cannot be reached by conforming to applicable
statewide spacing regulations. This spacing exception allows Hilcorp to penetrate the desired
sands for exploration and testing at the most prospective location on the top of the subsurface
structure. This feature was previously defined by shallow stratigrapbic test boreholes, existing
2D seismic data, and a gravity survey over the area. Drilling on this larger parcel also
minimizes the impact on residents within the adjacent community.

5. If operated as approved in Permit to Drill (PTD), Whiskey Gulch No. 1 will not cause waste
or result in an increased risk of fluid movement into freshwater.
CONCLUSIONS:
An exception to the well spacing provisions of 20 AAC 25.055 is necessary to allow the
drilling, testing, and production of the Whiskey Gulch Undefined Oil/Gas Pool in the Whiskey
Gulch No. 1 exploration potential oil and gas well in order to maximize ultimate resource
recovery.
2. Granting an exception to the well spacing provisions of 20 AAC 25.055 for Whiskey Gulch
No. I will not result in waste or jeopardize correlative rights of adjoining or nearby owners,
is based on sound engineering and geoscience principles, and will not result in an increased
risk of fluid movement into freshwater.
NOW THEREFORE IT IS ORDERED:
The AOGCC grants Hilcorp's February 5, 2021, application for an exception to the well spacing
provisions of 20 AAC 25.055 to allow the drilling, testing, and production of the Whiskey Gulch
No. 1 exploratory oil and gas well within the Whiskey Gulch Undefined Oil/Gas Pools. Hilcorp
may proceed and must comply with all applicable laws and all other legal requirements.

As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as
the AOGCC grants for good cause shown, a person affected by it may file with the AOGCC an application for reconsideration of
the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration
must set out the respect in which the order or decision is believed to be erroneous.
The AOGCC shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to
act on it within 10-days is a denial of reconsideration. If the AOGCC denies reconsideration, upon denial, this order or decision
and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days
after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the order or decision denying
reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on
which the application for reconsidemtion was filed.
If the AOGCC grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision
on reconsideration will be the FINAL order or decision of the AOGCC, and it may be appealed to superior court. That appeal
MUST be filed within 33 days after the date on which the AOGCC mails, OR 30 days if the AOGCC otherwise distributes, the
order or decision on reconsideration.
In computing a period of time above, the date of the event or default after which the designated period begins to run is not included
in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period nuns
until 5:00 p.m. on the next day that does not fall on a weekend or state holiday.

Dear Chairperson Price
This letter is submitted to notify the Alaska Oil and Gas Conservation Commission
(Commission) that Cook Inlet Region, Inc. (CIRI) owns oil and gas interest within
Section 36 of T4S R 15W SM, as depicted in the enclosed map. CIRI's oil and gas
ownership interests in Section 36 are not under lease to Hilcorp Alaska LLC (Hilcorp),
nor are they leased to any third party at this time.
In Hilcorp's February 5th application to the Commission, Hilcorp proposes to drill
Whiskey Gulch No. 1 well with a bottom hole location approximately one-half mile
from CIRI's property line. CIRI understands the proposed well will be drilled on State
of Alaska Lease ADL 392666 within Section 25 of T4S, R15W SM, and that CIRI
property is currently outside of the 1,500' regulatory spacing requirement for a gas
well. However, should geologic or geophysical evidence suggest the pool extends
further south than that proposed within the application, CIRI could be and affected
landowner.
Regulation 20 AAC 25.055 specifically disallows production without pooling, and while
Hilcorp does not appear to violate the regulation under the current application, the
pool as identified within the application may vary once the well is drilled to depth.
CIRI is not objecting to the spacing exception at this time but has an interest in
protecting its correlative rights should the Commission find there is geological shift
in the pool.

The AOGCC has tentatively scheduled a public hearing on this subject for March 16, 2021, at 10:00 a.m.
at 333 West 71 Avenue, Anchorage, Alaska 99501. To request that the tentatively scheduled hearing be
held, a written request must be filed with the AOGCC no later than 4:30 p.m. on March 1, 2021.
If a request for a hearing is not timely filed, and the AOGCC deems the information submitted in support
of Hilcorp's application sufficient to make a decision, the AOGCC may issue an order without a hearing.
To learn if the AOGCC will hold the hearing, call (907) 793-1221 after March 3, 2021.
If a hearing is requested, the Covid-19 virus may necessitate that the hearing be held telephonically. Those
desiring to participate or be present at the hearing should check with AOGCC the day before the hearing to
ascertain if the hearing will be telephonic. If the hearing is telephonic, on the day of the hearing, those
desiring to be present or participate should call 1-800-315-6338 and, when instructed to do so, enter the
code 14331. Because the hearing will start at 10:00 a.m., the phone lines will be available starting at 9:45
a.m. Depending on call volume, those calling in may need to make repeated attempts before getting through.
In addition, written comments regarding this application may be submitted to the AOGCC, at 333 West 7th
Avenue, Anchorage, Alaska 99501. Written comments must be received no later than 4:30 p.m. March 12,
2021, except that if a hearing is held, comments will be accepted until the conclusion of the March 16, 2021
hearing.

I am reviewing Hilcorp's application for spacing exception for this proposed exploratory well. I would like to confirm the
number of this proposed well. The title of Hilcorp's application letter to Commissioner Price refers to "Whiskey Gunch
No. 14" as does the introductory paragraph of the letter, whereas the remainder of the letter refers to the well as
"Whiskey Gulch No. 1." The numbers of the existing Whiskey Gulch stratigraphic test wells range from "Whiskey Gulch
1B" to "Whiskey Gulch 13" so either 1 or 14 would work, but assigning the number of 1 to this exploratory well may
result in a bit confusion since there is already a 1B stratigraphic test well.

Hilcorp Alaska, LLC ("Hilcorp"), as sole working interest owner of the affected oil and
gas leases, requests permission to drill, test, and produce the Whiskey Gulch No. 14 Well
in the Undefined Oil Pool within 500 feet of a property line where the owners and
landowners are not the same on both sides of the line, and in the Undefined Gas Pool
within 1,500 feet of a property line where the owners and landowners are not the same on
both sides of the line, pursuant to 20 AAC 25.055(d).
In accordance with 20 AAC 25.005, Hilcorp plans to submit an application for a Permit to
Drill to AOGCC for approval, prior to the commencement of drilling Whiskey Gulch No.
1. This well will be drilled from the a pad site ("Whiskey Gulch Pad No. I") located on
privately owned property (KPB Parcel 16508321), within the Whiskey Gulch Prospect
area located in Anchor Point, Alaska. The land use authorization for the Whiskey Gulch
Pad No. 1 was granted by the private surface owner, under a certain Rights -of -Way and
Option to Purchase Agreement recorded in the Homer Recording District. Drilling
operations for Whiskey Gulch No.1 are expected to commence approximately June I",
2021.
To date, no pool rules have been established within the Whiskey Gulch Prospect area.
Therefore, statewide spacing regulation 20 AAC 25.055(a) is controlling. In relevant part,
subsections (a)(1) and (a)(2) provide:
• (a)(1) For a well drilling for oil, a wellbore may be open to test or regular
production within 500 feet of a property line only if the owner is the same
and the landowner is the same on both sides of the line.
• (a)(2) For a well drilling for gas, a wellbore may be open to test or regular
production within 1,500 feet of a property line only if the owner is the same
and the landowner is the same on both sides of the line.

The proposed Whiskey Gulch No. 1 well is an exploration well located approximately 2.5
miles north of Anchor Point, Alaska, within an exploration area referred to as the Whiskey
Gulch Prospect. The Whiskey Gulch Prospect is located directly north of the Seaview
Unit. Whiskey Gulch No. 1 will be the first exploration well drilled by Hilcorp in the
Whiskey Gulch Prospect; being in an area with no established unit or participating areas.
The Seaview No. 8 well is the closest well capable of production and is located
approximately 3.9 miles south of the proposed Whiskey Gulch No. 1 Well. There are
currently no productive wells, or wells capable of production, within the Whiskey Gulch
Prospect.
This spacing exception is necessary because (i) Whiskey Gulch No. 1 will be open to test
or regular production of oil in the Undefined Oil Pool within 500 feet of a property line
where the owners or landowners are not the same on both sides of the line (20 AAC
25.055(a)(1)), and (ii) this well will be open to test or regular production of gas in the
Undefined Gas Pool within 1,500 feet of a property line where the owners or landowners
are not the same on both sides of the line (20 AAC 25.055(a)(2)). Whiskey Gulch No. 1
will target unproven oil and/or gas reserves that cannot be reached by conforming to
applicable statewide spacing restrictions.
Hilcorp is the sole working interest owner of the affected oil and gas leases. Hilcorp has
made, and is continuing to make attempts to lease all landowner owners within Whiskey
Gulch Prospect. However, for a number of landowners, Hiloorp cannot locate or find heirs
for, or are unwilling to participate in our exploration efforts. Hilcorp is committed to
locating and contacting all landowners within the Whiskey Gulch Prospect, and offer an
option to participate in Hilcorp's exploration plans. In addition to the previous attempts
made by Hilcorp, a cover letter was sent along with the application notices, as required
under 20 AAC 25.055(d)(1). Said cover letter restates the landowner's option to
participate in Hilcorp's exploration plans (see Exhibit A).
Following successful completion of Whiskey Gulch No. 1, and prior to bringing the well
online, Hilcorp plans to submit to the Department of Natural Resources, Division of Oil
and Gas (" DNR'), an application to form the Whiskey Gulch Unit and Initial Participating
Area (" PA" ). Hilcorp understands there are complex ownerships involved in the Whiskey
Gulch Field, and AOGCC is tasked with protecting all parties' correlative rights. With this
in mind, Hilcorp commits to allocating production in accordance with DNB's decision
regarding the Whiskey Gulch Unit and PA. Production from Whiskey Gulch No. 1 will
commence only when an approved PA is in place. A copy of the decision and PA allocation
schedule will be provided to AOGCC prior to production.
Hilcorp also commits that all leased owners / landowners will be allocated royalties based
on their tract allocation percentage, mineral ownership, and lease royalty shown on the
approved PA allocation schedule. Hilcorp will establish and maintain —without cost to the
non -participating owners / landowners —a single, interest -bearing escrow account (Escrow
Account) for the non -participating owners / landowners. Hilcorp will provide AOGCC
with documentation sufficient to show that the Escrow Account has been established and
maintained in accordance with this spacing exception. For each non -participating owner /

landowner in a given parcel within the productive area, Hilcorp will deposit in that Escrow
Account an amount equal to the total of that non -participating owner's / landowner's
interest percentage (allocation percentage) for those parcels multiplied by the production
attributed to those parcels for the previous month multiplied by 0.125 (royalty rate)
multiplied by the prevailing value for Cook Inlet gas published for that quarter by the
Alaska Department of Revenue under 15 AAC 55.173(b). As a result, the correlative rights
of all affected owners, landowners and operators will be protected by approval of this
spacing exception.
In accordance with 20 AAC 25.055(d)(1), a copy of this application was sent via certified
mail to the all affected owners and landowners within 1,000' of Whiskey Gulch No. 1's
anticipated productive interval within the Undefined Oil Pool, and 3,000' of Whiskey
Gulch No. 1's anticipated productive interval within the Undefined Gas Pool (see Exhibit
B-1 and B-2). Copies of the certified mail receipts have also been enclosed. Hilcorp
requests that Exhibit B-2 and the copies of the certified mail receipts are held confidential
by AOGCC. No other affected operators or working interest owners exist.
The well path of Whiskey Gulch No. 1 is located entirely on a DNR State Lease (Tract
001, ADL 392666). In accordance with 20 AAC 25.055(d)(2), a map of the location of
Whiskey Gulch No. 1 and its relationship to adjoining properties, along with a tract
ownership schedule, are attached to this application (see Exhibits C-1 and C-2). Hilcorp
requests that Exhibits C-1 and C-2 are held confidential by AOGCC. The well's location
is further indicated as follows:

covering portions of the Whiskey Gulch Prospect located in Anchor Point Alaska, by
application submitted February 5, 2021, requested the Alaska Oil and Gas Conservation
Commission ("AOGCC'� grant a spacing exception to drill, test, and produce the Whiskey
Gulch No. 1 well in the Undefined Oil Pool within 500 feet of a property line where the
landowners are not the same on both sides of the line, and in the Undefined Gas Pool
within 1,500 feet of a property line where the landowners are not the same on both sides
of the line, pursuant to 20 AAC 25.055(d).
In accordance with 20 AAC 25.055(d)(1), Hilcorp is required to send a notice of
application via certified mail to the owners, landowners, and operators within 1,000 feet
of a well drilling for oil or within 3,000 feet of a well drilling for gas for which the spacing
exception is sought. This letter, along with the enclosed copy of Hilcorp's application,
senses as notice that your property is within 1,000 feet of Whiskey Gulch No.1's potential
oil horizon, or 3,000 feet of Whiskey Gulch No. 1's potential gas horizon. Drilling
operations for Whiskey Gulch No. I are expected to commence around June ln, 2021. but
possibly later in the year depending on pad construction. Please see the enclosed copy of
Hilcorp's application submitted to AOGCC, along with a map showing the well location
in relation to your property (Exhibit B-1 of the application), for additional details.
If you are receiving this letter and you have chosen to lease your property and participate
