Prior to August 2004, this WMRU gas was used at the WMRU unit as "lease use" but it is no longer needed for that purpose. Total volumes transferred from WMRU to the TBU were 8,469 MCF in August and 9,775 in September. Forest indicated if the gas was not transferred to TBU, it would be flared. Since the gas left the WMRU, the volumes are subject to royalty. Forest wants to know at what value they should report this transferred gas. In an August 20, 2004 letter, the Division approved a pricing methodology for gas transferred from West Foreland to the TBU similar to the settlement agreements that the State has with Unocal and Marathon. I asked Jim Arlington to write a letter to the Division asking for a pricing method for the gas transferred from the WMRU to then TBU. I also ask him to submit revised operator reports to show the transferred volumes as "sold". I suggest that until a determination is made, Forest should file royalty reports and use the same value methodology as approved in the August 20, 2004 letter. If a different value methodology is approved, Forest could then file revised royalty reports and adjust the value accordingly.
