Box 196105 Anchorage, AK 99~ 19-610 Re: CGF MI 180 Flaring Incident, December 11-14, 1997 Dear Mr. Roach: ~J TONY KNOWLES, GOVERNOR 3001 PORCUPINE DRIVE ANCHORAGE, ALASKA 99501-3192 PHONE: (907) 279-1433 FAX: (907) 276-7542 The Commission has reviewed the CGF flaring event, which occurred between December 11-14, 1997, for a determination of whether waste occurred and whether penalties under AS 31.0~.1~0 should be imposed. ARCO Alaska, Inc. ("AAI") reported approximately 165,461 Mscf of gas flared during four extended episodes. On May 26, 1998, the Commission expressed its concern that AAI may have prolonged the flaring event by not acting more aggressively to resolve the problem. We invited AAI to submit additional information for the Commission to consider before rendering a final decision. AAI submitted additional information on June 23, 1998 and July 24, 1998, and met with us on July 9, 1998. Under the Commission"s regulations, an operator is required to take action in accordance with good oil field engineering practices and conservation purposes to minimize the volume of gas released, burned, or permitted to escape into the air. 20 AAC 25.235(c). The flaring of gas is deemed to be waste unless authorized under ZO AAC 25.23. After reviewing the additional information, including copies of the actual control room log for the days in question, the Commission concludes that AAI undertook appropriate steps to minimize the amount of gas flared and acted in accordance with good oil field engineering practices in pursuing facility repairs to stop flaring. For these reasons, the Commission believes the flaring on December 11-14, 1997 was unavoidable because of an emergency that threatened life or property and necessary because of subsequent facility repairs (20 AAC 25.235(d)(5)(A)& (B)). Accordingly, the imposition of penalties is neither appropriate nor warranted. The Commission is disturbed, however, by the cavalier attitude expressed by AAI in the initial reporting of this incident. Had AAI submitted complete and accurate information to begin with, the matter could have been resolved quickly without any wasted of staff time.
