Beluga River Unit May 15, 1998 IT APPEARING THAT: ARCO Alaska, Inc. submitted an application dated March 5, 1998 requesting exception to the well spacing provisions of 20 AAC 25.055(a)(4) to allow drilling the ARCO Beluga River Unit 212-35 gas production well to a location within 1500 feet of a section line. 2. The Commission published notice of opportunity for public hearing in the Anchorage Daily News on April 15, 1998 pursuant to 20 AAC 25.540. 3. No protests to the application were received. FINDINGS: 1. The Beluga River Unit 212-35 gas production well will be drilled as a deviated hole with a surface location 1404' from the north line and 4557 from the east line of Section 35, T13N, R10W, Seward Meridian (SM) and a proposed bottomhole location 2153' from the north line and 165' from the west line of Section 35, T13N, R10W, SM. 2. Offset owners ARCO Beluga, Inc., Chevron USA Inc., Municipal Light and Power and the State of Alaska have been duly notified. An exception to the well spacing provisions of 20 AAC 25.055(a)(4) is necessary to allow the drilling of this well. CONCLUSION: Granting a spacing exception to allow drilling of the ARCO Beluga River Unit 212-35 gas production well will not result in waste nor jeopardize correlative rights. Christenson, P.E., Commissioner Cammy Oech ~, Commissioner AS 31.05.080 provides that within 20 days after receipt of written notice of the entry of an order, a person affected by it may file with the Commission an application for reheazing. A request for reheazing must be received by 4:30 PM on the 23"~ day following the date of the order, or next working day if a holiday or weekend, to be timely filed. The Commission shall gant or refuse the application in whole or in part within 10 days. The Commission can refuse an application by not acting on it within the 10-day period. An affected person has 30 days from the date the Commission refuses the application or mails (or otherwise distributes) an order upon rehearing, both being the final order of the Commission, to appeal the decision to Superior Court. Where a request for rehearing is denied by nonaction of the Commission, the 30-day period for appeal to Superior Court runs from the date on which the request is deemed denied i.e., 10`h day after the application For rehearing was filed).. ~2 ~ ~ Notice of Public Hearing STATE OF ALASKA Alaska Oil and Gas Conservation Commission Re: Beluga River Unit 212-35 gas production well. ARCO Alaska, Inc. by letter dated March 5, 1998 has requested an exception to the provisions of 20 AAC 25.055(a)(4) for the drilling of a gas production well within the Beluga River Unit. The exception would allow ARCO to drill the Beluga River Unit 212-35 gas production well to a producing location that is closer than 1500 feet from a section line and is the second producer from a common pool within a governmental section. The well will be drilled as a directional hole from a surface location 1404' from the north line (FNL) and 4557' from the east line of Section 35, T13N R10W, Seward Meridian (SM) to a bottomhole location 2153' FNL and 165' from the west line of Section 35 T13N R10W, SM. A person who may be harmed if the requested order is issued may file a written protest prior to 4:00 PM April 29, 1998 with the Alaska Oil and Gas Conservation Commission, 3001 Porcupine Drive, Anchorage, Alaska 99501, and request a hearing on the matter. If the protest is timely filed and raises a substantial and material issue crucial to the Commission's determination, a hearing on the matter will be held at the above address at 9:00 am on May 15, 1998 in conformance with 20 AAC 25.540. If a hearing is to be held, interested parties may confirm this by calling the Commission's office, (907) 279-1433 after April 29, 1998. If no protest is filed, the Commission will consider the issuance of the order without a hearing. ("ARCO"), as operator of the Beluga River Unit, hereby applies for an exception to the provisions of 20 AAC 25.055 for the drilling of the BRU 212-35 Twin (the "Well"). The Well is being drilled because the formations are not accessible or cannot be produced from the existing BRU-212-35 well due to the nature of its completion. The Well will be drilled as a directional hole from a surface location of 1,404' FNL and 4,557' FEL of Section 35, T13N-R10W, to a bottomhole location of 2,153' FNL and 165' FWL, Section 35, T13N-R10W. The Well will encounter the top of the Sterling formation at a location of 1,898' FNL and 263' FWL of Section 35, T13N-R10W and the top of the Beluga formation at a location of 1,979' FNL and 233' FWL of Section 35, T13N-R10W. The surface and bottomhole location of the Well are on ADL-029657 which lease is owned from surface to 7,000 feet by ARCO Beluga, Inc. (33.33%), Municipal Light & Power (33.3%) and Chevron (33.34%). The attached Exhibit 1 shows the location of the Well and all other adjoining governmental sections and wells located thereon. The completed wells on the property are the BRU-241-34, BRU-224-34, BRU-211-03, BRU-214-35, BRU-244- 04, BRU-212-25, BRU-232-26, BRU-214-265, BRU-214-26, and BRU-233-27. There are no other drilling wells on the property. The names and addresses of all owners and operators of the governmental sections directly and diagonally offsetting the Well are set forth in the attached Exhibit 2. Included in the attached Exhibit 3 is ORIGINAL ~J ARCO's request, if approved, will permit the location and production of the Well in the Sterling and Beluga formations within 1500' of the drillsite section line, within 3,000' of an existing well producing from said formation, and within the same section which produces from said formations.
