IT APPEARING THAT: Docket Number: CO-09-09 Conservation Order No. 619 Beluga River Unit No. 232-23 Gas Development Well Kenai Peninsula Borough, Alaska June 8, 2009 1. ConocoPhillips Alaska, Inc. (CPAI), by letter received March 18, 2009 by the Alaska Oil and Gas Conservation Commission (Commission), requests an order granting an exception to the well spacing requirements of 20 AAC 25.055 to allow drilling and completion of the proposed Beluga River Unit (BRU) No. 232-23 (BRU 232-23) gas development well within the same governmental section as, and within 3000 feet of, other BRU wells (i. e., the BRU 212-24, BRU 221-23 and BRU 224-23 wells) that are, or may be, capable of producing from the same pool (i. e., the Beluga River Undefined Gas Pool), which is in the Kenai Peninsula and Matanuska-Susitna Boroughs, Alaska. 2. On April 10, 2009, the Commission requested additional information from CPAI; on April 13, 2009, CPAI submitted the requested information. 3. On April 14, 2009, pursuant to 20 AAC 25.540, the Commission published in the ANCHORAGE DAILY NEws notice of the opportunity for a public hearing on May 19, 2009. 4. No protest to the application or request for a hearing was received. 5. The public hearing was vacated on May 7, 2009. FINDINGS: CPAI is the operator of the Beluga River Unit and will be the operator of the BRU 232-23 well, which will be within the Beluga River Unit, Beluga River Undefined Gas Pool, Kenai Peninsula Borough, Alaska. 2. The BRU 232-23 well is proposed as a deviated gas development well with a surface location 2,102 feet from the north line and 51 feet from the west line of Section 24, T13N, RlOW, Seward Meridian (S.M.), and a projected bottom hole location 2,037 feet from the north line and 2,371 feet from the east line of Section 23, T13N, R10W, S.M. 3. The BRU 232-23 well may open Beluga River Undefined Gas Pool reservoirs from which other wells within Section 23, T13N, R10W, S.M. (i. e., the active BRU 224-23 gas production well and the inactive BRU 221-23 gas production well) are, or may be, capable of producing. 4. The BRU 232-23 well is proposed to be drilled and completed within 3000 feet of other wells (i. e., the active BRU 224-23 gas production well and the inactive BRU 212-24 and 221-23 gas production wells) drilled to, or possibly capable of producing from, the same pool (i. e., the Beluga River Undefined Gas Pool). 5. By certified mail, CPAI sent notice of the application to all owners, landowners, and operators of all properties within 3000 feet of each anticipated productive pool of the proposed BRU 232-23 well. CPAI provided the Commission the notice, date of mailing, and addresses to which the notice was sent. 6. The BRU 232-23 well is needed to recover Beluga River Undefined Gas Pool reserves that are not accessible with existing wells because of the discontinuous nature of the reservoir sands. CONCLUSIONS: 1. An exception to 20 AAC 25.055(a)(4) is necessary to allow drilling and completion of the BRU 232-23 gas development well. This well is needed to recover Beluga River Undefined Gas Pool reserves that are not accessible with existing wells. 2. Granting a spacing exception to allow drilling and completion of the BRU 232-23 well will not result in waste or jeopardize the correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: Pursuant to the Commission's authority under AS 31.05.030 and 20 AAC 25.055, the Commission approves CPAI's application for an order granting an exception to the well spacing provisions of 20 AAC 25.055(a)(4) to allow drilling and completion of the BRU 232-23 well. CPAI may proceed with regular production as long as it complies with the terms of the Beluga River Unit agreement and all other legal requirements. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10 days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the Commission grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the Commission, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited to the questions presented to the Commission by the application for reconsideration." In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00 p•m• on the next day that does not fall on a weekend or state holiday. That I have been responsible for the geological work related to a Location Exception application for BRU we11232-23 with a surface location of 2,102' FNL, 51' FWL, Sec. 24, T13N, R10W, S.M. and a bottom hole location of 2037' FNL, 2371' FEL, Sec. 23, T13N, R10W, S.M. 5. The BRU 232-23 well targets gas bearing Beluga interval channel sands. The BRU 232-23 well is to be drilled as a development well within the existing Beluga River Unit targeting Beluga gas sands in State of Alaska lease ADL021128. A location exception is required because the productive interval of the well is within 3,000 feet of a well capable of producing from the same interval as shown in Exhibit A. BRU 224-23 is a producing well and BRU 212-24 and 221-23 are shut-in wells within 3,000 feet of 232-23. There are no other wells, productive or non-productive, that penetrate the Beluga within 3,000 feet. This spacing exception is necessary to efficiently drain the Beluga channel belt sands. Geologic analysis suggests the Beluga interval is a series of thin, discontinuous, stacked channel sands with a low net-to gross ratio.
