ConocoPhillips Alaska, Inc. (CPAI), by letter received March 18, 2009 by the Alaska Oil and Gas
Conservation Commission (Commission), requests an order granting an exception to the well spacing
requirements of 20 AAC 25.055 to allow drilling and completion of the proposed Beluga River Unit
(BRU) No. 242-04 (BRU 242-04) gas development well within 1,500 feet of a property line and
within the same governmental section as, and within 3000 feet of, other BRU wells that are, or may
be, capable of producing from the same pool (i.e., the Beluga River Undefined Gas Pool), which is in
the Kenai Peninsula and Matanuska-Susitna Boroughs, Alaska.
2. On April 10, 2009, the Commission requested additional information from CPAI; on April 13, 2009,
CPAI submitted the requested information.
3. On April 14, 2009, pursuant to 20 AAC 25.540, the Commission published in the ANCxo~GE
DA~LY NEws notice of the opportunity for a public hearing on May 19, 2009.
4. No protest to the application ar request for a hearing was received.
5. The public hearing was vacated on May 7, 2009.
6. On June 4 and 5, 2009, the Commission requested additional information from CPAI; on June 5,
2009, CPAI submitted the requested information.
FINDINGS:
CPAI is the operator of the Beluga River Unit and will be the operatar of the proposed BRU 242-04
well, which will be within the Beluga River Unit, Beluga River Undefined Gas Pool, Kenai
Peninsula Barough, Alaska.
2. The proposed BRU 242-04 well will be an onshore, deviated gas development well with a surface
location 201 feet from the north line and 368 feet from the east line of Section 4, T12N, RIOW,
Seward Meridian (S.M.), and a projected bottom hole location 1,602 feet from the north line and 968
feet from the east line of Section 4, T12N, R10W, S.M.
3. The BRU 242-04 well is proposed to be drilled and completed within 1500 feet of a property line
where landownership changes (i.e., the Cook Inlet shoreline that separates onshore federal lease
A029656 from offshore state lease ADL017592).
4. The proposed BRU 242-04 well may open Beluga River Undefined Gas Pool reservoirs from which
other wells within Section 4, T13N, RlOW, S.M. (i.e., the active BRU 232-04 and BRU 244-04 gas
production wells) are, or may be, capable of producing.

5. The BRU 242-04 well is proposed to be drilled and completed within 3000 feet of other wells (i.e.,
the active BRU 211-03, BRU 224-34, BRU 232-04, and BRU 244-04 gas production wells) drilled
to, or possibly capable of producing from, the same pool (i.e., the Beluga River Undefined Gas Pool).
6. By certified mail, CPAI sent notice of the application to all owners, landowners, and operators of all
properties within 3000 feet of each anticipated productive pool of the proposed BRU 242-04 well.
CPAI provided the Commission the notice, date of mailing, and addresses to which the notice was
sent.
7. The BRU 242-04 well is designed to recover Beluga River Undefined Gas Pool reserves that are not
accessible with existing wells because of the discontinuous nature of the reservoir sands.
CONCLUSIONS:
1. Exceptions to 20 AAC 25.055(a)(2) and 20 AAC 25.055(a)(4) are necessary to allow drilling and
completion of the BRU 242-04 gas development well. This well is needed to recover Beluga River
Undefined Gas Pool reserves that are not accessible with existing wells.
2. Granting a spacing exception to allow drilling and completion of the BRU 242-04 well will not result
in waste or jeopardize the correlative rights of adjoining ar nearby owners.
NOW, THEREFORE, IT IS ORDERED:
Pursuant to the Commission's authority under AS 31.05.030 and 20 AAC 25.055, the Commission
approves CPAI's application for an order granting exceptions to the well spacing provisions of 20 AAC
25.055(a)(2) and 20 AAC 25.055(a)(4) to allow drilling and completion of the BRU 242-04 well. CPAI
may proceed with regular production as long as it complies with the terms of the Beluga River Unit
agreement and all other legal requirements.

RECONSIDERATION AND APPEAL NOTICE
As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as
the Commission grants for good cause shown, a person affected by it may file with the Commission an application for
reconsideration of the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An
application for reconsideration must set out the respect in which the order or decision is believed to be erroneous.
The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed.
Failure to act on it within 10 days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this
order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be
filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the
order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within
40 days after the date on which the application for reconsideration was filed.
If the Commission grants an application for reconsideration, this order or decision does not become final. Rather, the order or
decision on reconsideration will be the FINAL order or decision of the Commission, and it may be appealed to superior court.
That appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission
otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on
appeal are limited to the questions presented to the Commission by the application for reconsideration."
In computing a period of time above, the date of the event or default after which the designated period begins to run is not
included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the
period runs until 5:00 p.m. on the next day that does not fall on a weekend or state holiday.

parties. These notices were mailed to their last known address or record address, and I believe that we have
mailed the notice letter to good current addresses.

Dear Mr. Davies:
ConocoPhillips Alaska, Inc. ("CPAI"), as operator of the Beluga River Unit, hereby applies for
an exception to the provisions of 20 ACC 25.055 for the drilling of BRU 242-04. This well is
being drilled to access the discontinuous channel sands in the Beluga interval that can not be
drained from existing wells.

The surface and bottom hole location of the well are on A029656. This lease is owned from
surface to 7,000 by ConocoPhillips Alaska, Inc. (33.33%), Municipal Light & Power (3333%)
and Chevron (33.33%). A spacing exception is required because the proposed well is within
3,000 feet of a well capable of producing in the same interval, as shown in E~iibit "A". The
following wells currently produce within 3,000 feet of the proposed well: 224-34, 232-04,
211-03 and 244-04. This spacing exception is necessary to efficiently drain the Beluga channel
belt sands. Geologic analysis suggests the Beluga interval is a series of thin, discontinuous,
stacked channel sands with a low net-to gross ratio. The channel belt widths are too narrow to
yield efficient drainage based on the current spacing for gas wells.

1. That I am over the age of 21 years and mentally competent to make this affidavit.
2. That I am lrnowledgeable and fully informed concerning the facts contained in the affidavit.
3. That for approximately the past 28 years I have worked as a geologist for ConocoPhillips Alaska, working
Cook Inlet geology for approximately 11 years. For the past 5 years I have been the geologist for the Cook
Inlet Asset team, responsible for Beluga River Unit and North Cook Inlet Unit geologic interpretation.
4. That I have been responsible for the geological work related to a Location Exception application for BRU
we11242-04 with a surface location of 201' FNL, 368' FEL, Sec. 4, T12N, R10W, S.M. and a bottom hole
location of 1602' FNL, 968' FEL, Sec. 4, T12N, R10W, S.M.
5. The BRU 242-04 well targets gas bearing Beluga interval channel sands.
6. The BRU 242-04 well is to be drilled as a development well within the existing Beluga River Unit targeting
Beluga gas sands in Federal Lease A029656. A location exception is required because the productive
interval of the well is within 3,000 feet of a well capable of producing from the same interval as shown in
E~ibit A. BRU 224-34, 232-04, 211-03 and 244-04 are productive wells within 3,000 feet of 242-04.
There are no other wells, productive or non-productive, that penetrate the Beluga within 3,000 feet. This
spacing exception is necessary to eff'iciently drain the Beluga channel belt sands. Geologic analysis
suggests the Beluga interval is a series of thin, discontinuous, stacked channel sands with a low net-to gross
ratio. The channel belt widths are too narrow to yield efficient drainage based on the current spacing for
gas wells.

04 well Location Exception application to the owners and landowners within a 3,000 foot radius of the
proposed well location by certified mail, return receipt requested. A list of these noticed owners is attached
to this affidavit as E~ibit "B". The postal return receipts will be made available for inspection by proper
parties. These notices were mailed to their last known address or record address, and I believe that we have
mailed the notice letter to good current addresses.
In view of the foregoing facts, affiant herein states and deposes that ConocoPhillips Alaska, Inc., as operator of the
proposed BRU 242-04 well has made a reasonable and diligent effort to identify, locate and contact all parties
legally due notice of the said Location Exception application.

Could you please? I checked the files for the BRU 232-23 and 242-04 spacing exceptions and did not find the
original, notarized affidavit for you (we do have the original af Rick Levinson's affidavit).
Also, as I was writing the text of the order, I noficed that the BRU 242-04 spacing excepfion file contains two
pages of photocopies of cer#ified mail receipts that include landowners (BLM, State), operators (CPAI), and
owners CPAI and MOA. I have a copy of the notice sent to Chevron, but I don't have the certified mail receipt for
Chevron. Could you please email me a copy of the receipt if you have it?

version of your affidavit for the BRU 242-04 exception. We received your notarized affidavit for BRU 232-23 on
April 13~', and I assumed that the companion affidavit for BRU 242-04 had arrived at the same time and had been
filed. I checked through the application files for both wells to see if the affidavit for BRU 242-04 had been miss-
filed, but apparently we never received it. Coutd you please submit the original, natarized affidavit for this well?

Re: The application of ConocoPhillips Alaska, Inc. for spacing exceptions under 20
AAC 25.055 to drill the Beluga River Unit No. 242-04 well.
ConocoPhillips Alaska, Inc. (ConocoPhillips), by a letter received March 18, 2009 by the
Alaska Oil and Gas Conservation Commission (Commission), requests an order for
exceptions to the spacing requirements of 20 AAC 25.055(a)(2) and 25.055(a)(4) to drill
the Beluga River Unit No. 242-04 (BRU 242-04) gas development well. The well would
be drilled within 1,500 feet of a property line dividing different land owners and within
the same governmental section as, and within 3,000 feet of, wells capable of producing
from the same pool.
The proposed surface and bottomhole locations of BRU 242-04 are as follows:
Surface Location: 201 feet from the north line and 368 feet from the east line of Section
4, T12N, R10W, Seward Meridian (S.M.).
Bottomhole Location: 1,602 feet from the north line and 968 feet from the east line,
Section 4, T12N, Rl OW, S.M.
The Commission has tentatively scheduled a public hearing on this application for May
19, 2009 at 9:00 a.m. at the Commission. To request that the hearing be held, a written
request must be filed by 4:30 p.m. on May 4, 2009.
If a request is not timely filed, the Commission may consider the issuance of an order
without a hearing. To learn if the Commission will hold a hearing, call 793-1221 after
May 6, 2009.
Written comments regarding the application may be submitted to the Commission, at 333
West 7th Avenue, Suite 100, Anchorage, Alaska 99501. Comments must be received no
later than 4:30 p.m. on May 18, 2009, except that, if a hearing is held, comments must be

ConocoPhillips Alaska, Inc. ("CPAI"), as operator of the Beluga River Unit, hereby applies for
an exception to the provisions of 20 ACC 25.055 for the drilling of BRU 242-04. This well is
being drilled to access the discontinuous channel sands in the Beluga interval that can not be
drained from existing wells.

Top of Beluga Interval, estimated: 4070' MD, 3535' SSTVD

The surface and bottom hole location of the well are on A029656. This lease is owned from
surface to 7,000 by ConocoPhillips Alaska, Inc. (33.33%), Municipal Light & Power (33.33%)
and Chevron (33.33%). A spacing exception is required because the proposed well is within
3,000 feet of a well capable of producing in the same interval, as shown in E~iibit "A". The
following wells currently produce within 3,000 feet of the proposed well: 224-34, 232-04,
211-03 and 244-04. This spacing exception is necessary to efficiently drain the Beluga channel
belt sands. Geologic analysis suggests the Beluga interval is a series of thin, discontinuous,
stacked channel sands with a low net-to gross ratio. The channel belt widths are too narrow to
yield efficient drainage based on the current spacing for gas wells.

3. That for approximately the past 28 years I have worked as a geologist for ConocoPhillips Alaska, working
Cook Inlet geology for approximately 11 years. For the past 5 years I have been the geologist for the Cook
Inlet Asset team, responsible for Beluga River Unit and North Cook Inlet Unit geologic interpretation.
4. That I have been responsible for the geological work related to a Location .Exception application for BRU
we11242-04 with a surface location of 201' FNL, 368' FEL, Sec. 4, T12N, RlOW, S.M. and a bottom hole
location of 1602' FNL, 968' FEL, Sec. 4, T12N, R10W, S.M.
5. The BRU 242-04 well targets gas bearing Beluga interval channel sands.
6. The BRU 242-04 well is to be drilled as a development well within the existing Beluga River Unit targeting
Beluga gas sands in Federal Lease A029656. A location exception is required because the productive
interval of the weli is within 3,000 feet of a well capable of producing from the same interval as shown in
E~-ibit A. BRU 224-34, 232-04, 211-03 and 244-04 are productive wells within 3,000 feet of 242-04.
There are no other wells, productive or non-productive, that penetrate the Beluga within 3,000 feet. This
spacing exception is necessary to efficiently drain the Beluga channel belt sands. Geologic analysis

being drilled to access the discontinuous channel sands in the Beluga interval that can not be
drained from existing we11s.

The surface and bottom hole location of the well are on A029656. This lease is owned from
surface to 7,000 by ConocoPhillips Alaska, Inc. (33.33%), Municipal Light & Power (33.33%)
and Chevron (33.33%). A spacing exception is required because the proposed well is within
3,000 feet of a well capable of producing in the same interval, as shown in Exhibit "A". The
following wells currently produce within 3,000 feet of the proposed well: 224-34, 232-04,
211-03 and 244-04. This spacing exception is necessary to efficiently drain the Beluga channel
belt sands. Geologic analysis suggests the Beluga interval is a series of thin, discontinuous,
stacked channel sands with a low net-to gross ratio. The channel belt widths are too narrow to
yield efficient drainage based on the cnrrent spacing for gas wells.

Inlet Asset team, responsible for Beluga River Unit and North Cook Inlet Unit geologic interpretation.
4. That I have been respbnsible for the geological work related to a Location Exception applicarion for BRU
we11242-04 with a surface location of 201' FNL, 368' FEL, Sec. 4, T12N, RlOW, S.M. and a bottom hole
location of 1602' FNL, 968' FEL, Sec. 4, T12N, R10W, S.M.
5. The BRU 242-04 well targets gas bearing Beluga interval channel sands.
6. The BRU 242-04 well is to be drilled as a development well within the existing Beluga River Unit targeting
Beluga gas sands in Federal Lease A029656. A location exception is required because the productive
interval of the well is within 3,000 feet of a well capable of producing from the same interval as shown in
Exhibit A. BRU 224-34, 232-04, 211-03 and 244-04 are productive wells within 3,000 feet of 242-04.
There are no other wells, productive or non-productive, that penetrate the Beluga withixi 3,000 feet. This
spaeing exception is necessary to efficiently drain the Beluga channel belt sands. Geologic analysis
suggests the Beluga interval is a series of thin, discontinuous, stacked channel sands with a low net-to gross
ratio. The channel belt widths are too narrow to yield efficient drainage based on the current spacing for
gas wells.
