IT APPEARING THAT:
1. On May 16, 2011, ConocoPhillips Alaska, Inc. (CPAI) requested the Alaska Oil and Gas
Conservation Commission (Commission) grant an exception to the spacing provisions of
20 AAC 25.055 to allow drilling of the Beluga River Unit (BRU) 224 -23 Twin
development gas well (BRU 224 -23T) within 3000 feet of other BRU wells that are, or
may be, capable of producing from the same pool, the Beluga River Undefined Gas Pool,
in the Kenai Peninsula and Matanuska - Susitna Boroughs, Alaska.
2. On May 19, 2011, a notice of a public hearing was published on the State of Alaska's
Online Public Notice website, and published on the Commission's Internet website. On
May 24, 2011, the notice was published in the PENINSULA CLARION newspaper.
3. By certified U.S. mail, CPAI sent notice of the application to all owners, landowners, and
operators of all properties within 3000 feet of the anticipated productive pool of the
proposed BRU 224 -23T well. CPAI provided the Commission the notice, date of
mailing, addresses to which the notice was sent, and proof of mailing.
4. No protest to the application or request for hearing was received.
5. Because CPAI provided sufficient information upon which to make an informed decision,
the request can be resolved without a hearing.
6. The public hearing was vacated on June 13, 2011.
FINDINGS:
1. CPAI, the operator of the BRU, will be the operator of BRU 224 -23T, to be located
within the BRU, Beluga River Undefined Gas Pool, Kenai Peninsula Borough, Alaska.
2. The BRU 224 -23T will be an onshore, deviated gas development well with a surface
location 560' from the south line (FSL) and 2628' from the west line (FWL) of Section
23, T13N, R1 OW, Seward Meridian (S.M.), and a projected bottom hole location 1094'
FSL and 2447' FWL of Section 23, T13N, R10W, S.M.
3. The BRU 224 -23T well will replace production lost when nearby well BRU 224 -23 was
shut -in due to mechanical problems. BRU 224 -23T will recover Beluga River Undefined
Gas Pool reserves that are not accessible with existing wells because of the discontinuous
nature of the Sterling and Beluga channel -belt reservoir sands. However, this well may
open reservoirs from which other wells (i.e., the active BRU 211 -26, BRU 232 -23 and
BRU 232 -26 wells and the inactive BRU 224 -23 well) are, or may be, capable of
producing.

CONCLUSIONS:
1. An exception to 20 AAC 25.055(a)(4) is necessary to allow drilling and completion of
the BRU 224 -23T well in order to recover Beluga River Unidentified Gas Pool reserves
that are not accessible with existing wells.
2. A spacing exception to allow drilling and completion of the BRU 224 -23T well is
consistent with sound engineering and geoscience principles and will not result in waste
or jeopardize correlative rights of adjoining or nearby owners.
NOW, THEREFORE, IT IS ORDERED:
Pursuant to the Commission's authority under AS 31.05.030 and 20 AAC 25.055, the
Commission approves CPAI's application for an order granting an exception to the well
spacing provisions of 20 AAC 25.055(a)(4) to allow drilling and completion of the BRU 224 -
23T well. CPAI may proceed with regular production as long as it complies with the terms of
the Beluga River Unit agreement, applicable Alaska laws, and all other legal requirements.

RECONSIDERATION AND APPEAL NOTICE
As provided in AS 31.05.080(a), within 20 days after written notice of the entry of this order or decision, or such further time as the
Commission grants for good cause shown, a person affected by it may file with the Commission an application for reconsideration of
the matter determined by it. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration
must set out the respect in which the order or decision is believed to be erroneous.
The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to
act on it within 10 -days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this order or decision
and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after
the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision denying
reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which
the application for reconsideration was filed.
If the Commission grants an application for reconsideration, this order or decision does not become final. Rather, the order or
1 decision on reconsideration will be the FINAL order or decision of the Commission, and it may be appealed to superior court. That
appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise
distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited
to the questions presented to the Commission by the application for reconsideration."
In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in
the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00
p.m. on the next day that does not fall on a weekend or state holiday.

May 16, 2011, requests the Alaska Oil and Gas Conservation Commission (Commission)
issue an order for an exception to the spacing requirements of 20 AAC 25.055 to drill the
Beluga River Unit No. 224 -23 Twin production gas well, in the Beluga River Unit within
3,000 feet of wells that are capable of, or may be capable of, producing natural gas from
the same geologic interval. The proposed surface and bottom -hole locations of the well
are as follows:
Beluga River Unit No. 224 -23 Twin
Surface Location: 559 feet from the south line (FSL) and 2,627 feet from the west line
(FWL) of Section 23, T13N, R1 OW, Seward Meridian (S.M.).
Bottom -hole Location: 1,093 feet FSL and 2,447 feet FWL of Section 23, T13N, RI OW,
S.M.
The Commission has tentatively scheduled a public hearing on this application for June 23, 2011
at 9:00 a.m. at the Alaska Oil and Gas Conservation Commission, at 333 West 7th Avenue, Suite
100, Anchorage, Alaska 99501. To request that the tentatively scheduled hearing be held, a
written request must be filed by 4:30 p.m. on May 31, 2011.
If a request for a hearing is not timely filed, the Commission may consider the issuance of an
order without a hearing. To learn if the Commission will hold the hearing, call 793 -1221 after
June 6, 2011.
In addition, written comments regarding this application may be submitted to the Alaska Oil and
Gas Conservation Commission, at 333 West 7 Avenue, Suite 100, Anchorage, Alaska 99501.

ConocoPhillips Alaska, Inc. ( "CPAI "), as operator of the Beluga River Unit, hereby applies for
an exception to the provisions of 20 ACC 25.055 for the drilling of BRU 224 -23 Twin ( "the
Well "). The Well is being drilled to replace BRU 224 -23. That well was recently shut -in and the
borehole was displaced with kill weight fluids due to tubing and annular communication
problems. The proposed Well 224 -23T is located as follows:

The surface and bottom hole location of the Well are on ADL 0.27 which lease is owned
from surface to 7,000 by ConocoPhillips Alaska, Inc. (33.33 %), Municipal Light & Power
(33.33 %) and Chevron (33.33 %). A spacing exception is required because the proposed well is
within 3,000 feet of a well capable of producing in the same interval, as shown in Exhibit "A ".
Gas Producer BRU 232 -23 (producing), BRU 224 -23 (killed), BRU 211 -26 (producing) and
BRU 232 -26 (producing) are located within 3,000' of the Well.
Enclosed please find Exhibit A, a plat showing the Well surface and bottom hole location,
Exhibit B, a notification list of parties entitled to notice of this application that have been duly
notified, Affidavit — Geological and Affidavit - Land.

parties. These notices were mailed to their last known address or record address, and I believe that we have
mailed the notice letter to good current addresses.

a bottom hole location of 1,093.27'FSL, 2,447.08' FWL, Section 23, T13N, R10W, S.M.
5. The BRU 224 -23 Twin well targets gas bearing Sterling and Beluga interval channel sands.
The BRU 224 -23 Twin well is to be drilled as a development well within the existing Beluga River Unit targeting
Sterling and Beluga gas sands in State of Alaska lease ADL021127. A location exception is required because the
productive interval of the well is within 3,000 feet of wells capable of producing from the same interval as shown in
Exhibit A. BRU 232 -23 (producing), BRU 224 -23 (killed), BRU 211 -26 (producing) and BRU 232 -26 (producing)
are wells located within 3,000 feet of 224 -23 Twin. There are no other wells, productive or non - productive, that
penetrate the Sterling or Beluga within 3,000 feet. This spacing exception is necessary to efficiently drain the
Sterling and Beluga channel belt sands. The BRU 224 -23 Twin well will replace production that was lost when the
BRU 224 -23 well was shut -in and displaced with kill weight fluids due to tubing and annular communication
problems.
