On June 22, 2010, ENI Petroleum (ENI) requested the Alaska Oil and Gas Conservation Commission (Commission) grant an exception to the spacing provisions of 20 AAC 25.055 (a)(3) to allow drilling and completion of the Nikaitchuq Unit No. OP12 -01 (OP12 -01) development oil well within the same governmental quarter section as wells that are producing from, or may be capable of producing from, the same pool (the Nikaitchuq Undefined Oil Pool), in the North Slope Borough, Alaska. 2. Pursuant to 20 AAC 25.540, on June 25, 2010 the Commission published in the ANCHORAGE DAILY NEWS notice of the opportunity for a public hearing on July 29, 2010. On June 29, 2010, to correct an error in the notice of public hearing published June 25, 2010, the Commission published in the ANCHORAGE DAILY NEWS notice of the opportunity for a public hearing on August 2, 2010. 3. By certified mail, ENI sent notice of the application to all owners, landowners, and operators of all properties within 1000 feet of the anticipated OP12 -01 well. ENI provided the Commission the notice, date of mailing, addresses to which the notice was sent, and proof of mailing. 4. No protest to the application or request for hearing was received. 5. Because ENI provided sufficient information upon which to make an informed decision, the request can be resolved without a hearing. 6. The public hearing was vacated on July 22, 2010. FINDINGS: 1. ENI is the operator of the Nikaitchuq Unit and will be the operator of the proposed 0P12- 01 development oil well that will be located within the Nikaitchuq Undefined Oil Pool, Nikaitchuq Unit, North Slope Borough, Alaska. 2. The proposed OP 12 -01 well will be an onshore, deviated oil development well with a surface location 3182' from the south line (FSL) and 1604' from the east line (FEL) of Section 5, T13N, RO9E, Umiat Meridian (U.M.), and a projected bottom -hole location 711' FSL and 3255' FEL, Section 30, T14N, RO9E, U.M. 1 3. The proposed OP 12 -01 well will be drilled as part of a series of alternating, extended - reach, horizontal production and injection wells that will lie parallel with one another and about 1200' apart. The directional orientation of the wells allows more than one well to be drilled within a single governmental quarter section. CONCLUSIONS: 1. An exception to 20 AAC 25.055(a)(3) is necessary to allow drilling and completion of the OP 12 -01 well in order to maximize recovery of Nikaitchuq Unidentified Oil Pool reserves. 2. A spacing exception to allow drilling and completion of the OP12 -01 well is consistent with sound engineering and geoscience principles and will not result in waste or jeopardize correlative rights of adjoining or nearby owners. NOW, THEREFORE, IT IS ORDERED: Pursuant to the Commission's authority under AS 31.05.030 and 20 AAC 25.055, the Commission approves ENI's application for an order granting exception to the well spacing provisions of 20 AAC 25.055(a)(3) to allow drilling and completion of the OP12 -01 well. ENI may proceed with regular production as long as it complies with the terms of the Nikaitchuq Unit agreement, applicable Alaska laws, and all other legal requirements. If the notice was mailed, then the period of time shall be 23 days. An application for reconsideration must set out the respect in which the order or decision is believed to be erroneous. The Commission shall grant or refuse the application for reconsideration in whole or in part within 10 days after it is filed. Failure to act on it within 10 -days is a denial of reconsideration. If the Commission denies reconsideration, upon denial, this order or decision and the denial of reconsideration are FINAL and may be appealed to superior court. The appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision denying reconsideration, UNLESS the denial is by inaction, in which case the appeal MUST be filed within 40 days after the date on which the application for reconsideration was filed. If the Commission grants an application for reconsideration, this order or decision does not become final. Rather, the order or decision on reconsideration will be the FINAL order or decision of the Commission, and it may be appealed to superior court. That appeal MUST be filed within 33 days after the date on which the Commission mails, OR 30 days if the Commission otherwise distributes, the order or decision on reconsideration. As provided in AS 31.05.080(b), "[t]he questions reviewed on appeal are limited to the questions presented to the Commission by the application for reconsideration." In computing a period of time above, the date of the event or default after which the designated period begins to run is not included in the period; the last day of the period is included, unless it falls on a weekend or state holiday, in which event the period runs until 5:00 p.m. on the next day that does not fall on a weekend or state holiday. 2 ~ ! This well will be an oil development well drilled into an oil reservoir. Its description as a gas development well in the notice is an error. Nikaitchuq OP12-01 is correctly described as a development oil well, single completion in AOGCC's online database that is available at http~//aogweb state ak us/publicdata/frmLogin.aspx. I have sent a message to AOGCC's attorney asking how best to correct my mistake. Please accept my apologies for any confusion. ("Eni") is applying for an exception to the provisions of 20 AAC 25.055 (a) (3) for the drilling of OP12-01 (the "Well) and request approval to drill the well as described in this Spacing Exception Application. A brief explanation for why the operator has chosen to drill the specified location. The well is part of the Nikaitchuq Viscous Oil Development to produce oil from the Schrader Bluff OA Sand reservoir. The development is a waterflood and has been planned with alternating producer. and injector extended reach horizontal wells. The optimum spacing between the wells has been determined to be 1200' based on available data. Due to the orientation of the wells this spacing allows for more than one well to be drilled within a governmental quarter section. The portion of the Well that requires a spacing exception lies within the SW quarter of Section 30, Township 14, Range 9, East of the Umiat meridian. The well is currently being permitted and is scheduled to be drilled in July of 2010. The production of the Well will commence in December 2010. ("Eni") is applying for an exception to the provisions of 20 AAC 25.055 (a) (3) for the drilling of OP12-01 (the "Well) and request approval to drill the well as described in this Spacing Exception Application. A brief explanation for why the operator has chosen to drill the specified location. The well is part of the Nikaitchuq Viscous Oil Development to produce oil from the Schrader Bluff OA Sand reservoir.. The development is a waterflood and has been planned with alternating producer and injector extended reach horizontal wells. The optimum spacing between the wells has been determined to be 1200' based on available data. Due to the orientation of the wells this spacing allows for more than one well to be drilled within a governmental quarter section. The portion of the Well that requires a spacing exception lies within the SW quarter of Section 30, Township 14, Range 9, East of the Umiat meridian. The well is currently being permitted and is scheduled to be drilled in July of 2010. The production of the Well will commence in December 2010.
